HomeMy WebLinkAbout630115.tiff AUTHORIZING CHAIRMAN TO SIGN AGREEMENT WITH UNION PACIFIC RAILROAD GRADE-CROSSING FLASHING LIGHT: WHEREAS, the Union Pacific Railroad Company has tendered an agreement covering the installation, maintenance and operation of flashing light highway grade " crossing signals at an existing public road crossing at Railroad Mile Post 148.39 at LaSalle, Colorado; said agreement being identified as Railroad Company' s C. D. No. 47532; and WHEREAS, the Board of County Commissioners, Weld County, Colorado, has said proposed agreement before it and has given it careful review and consideration, believes it to be to the best interests of the County to accept the terms of said agreement. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that the terms of the agreement submitted as aforesaid be and the same are hereby accepted and that the Chairman of the Board of County Commissioners is hereby authorized, empowered and directed to execute said agreement on behalf of the County. STATEMENT By the Commission: On November 15, 1963, Union Pacific Railroad Company (Union Pacific) filed its application according to the rules of this Commission, seeking approval for the installation of flashing - light type signals at a county road where crossing at grade is made by said roadway over an east-west main-line of Applicant railroad located some 2- miles northeasterly from La Salle, Colorado. Other explanatory material as submitted with the instant application includes: Exhibit A: Copy of fully executed Agreement C.D. No. 47532 made on September 11, 1963 between Union Pacific and County of Weld, State of Colorado, regarding installation, payment and maintenance of flashing light grade crossing signals at Railroad Mile Post 148.39, La Salle, Colorado. Exhibit B: (6 Sheets) Wiring plans for proposed Signals, Mile Post 148.39 Exhibit C: Blue Print map sheet to show location of County Road and crossing at Mile Post 148.39. With reference to the agreement herein, it appears the estimated cost of furnishing and installing the proposed flashing light signals is $109445.00. However, the actncl cost shall govern, and upon receipt of billing, Weld County agrees to re- imburse Union Pacific for 9 of all costs, labor and materials as assignable to the crossing installation. When and after the proposed flashing signals are installed, continued operation and maintenance thereof will be by Union Pacific and at its own expense. Upon investigation of the instant proposal, it appears that the instant county road is a paved north-south farm-to-market artery that serves a large agricultural area southeasterly from Greeley, Colorado. The crossing is located two miles east and one mile north from La Salle, Colorado. Other County road work in the area has resulted in the closing of a minor east-west grade crossing approximately one- fourth mile to the east, being the site of a serious School Bus accident that occurred in December 1961. In the new con- struction work, the gravel road has been relocated from the north side to the south side of the rail line, and traffic now comes to the instant paved road artery for northward travel over the crossing to be protected. Year around average rail traffic amounts to five trains per day; there are two regularly scheduled streamliner passenger trains, two regular freight trains and other local freight move- ments that are variable according to beet or harvest season needs when eight to ten daily trains may be operated. Vision in the area is generally quite open by reason of straight track, open farm area and no large buildings . However, the paved highway and increasing traffic volumes together with diversion of traffic of easterly crossing at Mile Post 1+8.12 all indicate -2- the need for added warning of approaching trains which the proposed signals will provide. By virtue of other investigations in this area the Commission is familiar with the general crossing situation and in fact has had a Staff recommendation for closing of the crossing at Mile Post 148.12 and relocation of the east- west County Road in the manner that has now been completed. Resulting then from other iaquiries by- local citizens, the Weld County Commissioners and Union Pacific have completed the joint agreement as noted above, and the instant applica- tion is submitted for Commission approval. In further review of the proposal, the Commission for- warded a copy of the application, together with a Notice to interested parties, including also the owners of adjacent property, to ascertain if any other action was desired within the period of twenty (20) days as designated in said Notice. No reply has been received by the Commission. After consideration of the instant proposal, it is the belief of the Commission that effectiveness of automatic signal protection is accepted by the utility and the public agencies affected herein. The signal installation will upgrade the crossing protection to meet the road improvements and in- creased use. Hence, it is apparent the safety devices as sought here, together with the crossing abandonment as already made, are all in the public interest and protect traffic on both the highway and the railroad. It is therefore the belief of the Commission that the above changes are compatible with the public interest, and the Commission determined to hear, and heard, said matter forthwith, without further notice, upon the records and files herein. -3- FINDINGS THE COMMISSION FINDS: That it is informed in the instant matter, and the foregoing Statement, by reference, is made a part hereof. That public safety, convenience and necessity require the installation and approval of standard flashing type auto- matic crossing signals at the County Road grade crossing over Union Pacific rail line at Mile Post 148.39, east of La Salle, Colorado. That closing of County Road grade crossing at Mile Post 148.12 eliminates a serious public hazard, and abandonment ap- proval should be granted herewith, since there will be a diver- sion of the traffic to the instant crossing being protected. That the authority sought in the instant application should be granted. ORDER THE COMMISSION ORDERS: That Applicant, Union Pacific Railroad Company, be, and it hereby is, granted a certificate of public convenience and necessity to authorize and approve the following: 1. Closing and abandonment of the old east-west gravel road grade crossing at Union Pacific Mile Post 148.12, being on the south section line in the SWj Sec. 27, Township 5, North, Range 65 West, Sixth Principal Meridian. 2. Installation, operation and maintenance of standard flashing light grade crossing signals at the County Road grade crossing over Union Pacific rail line, Mile Post 148.39, being on the west line of the NW 4 Section 34, Township 5 North, Range 65 West, Sixth Principal Meridian. said crossings being some 24 miles northeasterly from La Salle, Weld County, Colorado. That the work to be done, costs, installation and main- tenance of the protection devices, shall be as indicated in the preceding Statement, said Statement and Exhibits "A", "B", and -4- "C" are, by reference, made a part hereof. That the signal devices and installation shall all be in conformance with the current Bulletin of the Association of American Railroads' Joint Committee on Railroad Protection. In the matter of qualii ica.t i.oni6, we ask that i.nsta!iations and signal equipment be in conformance with Recommended Standards of the Association of American Railroads - Joint Committee on Grade Crossing Protection. (Bulletin No. 5) Now, perhaps the main question you might have is: "When are signals necessary?" You are probably aware that much has been said and written on that question. Numerous rating methods have been developed and have value when all crossings can be rated and then compared. In this department, we treat each crossing on a separate or individual basis, since there are different conditions in each case relating to: View; nature of terrain; approaches to track; vegetation; alinement - track and roadway; speeds - trains and vehicles; nature of use - branch and main-line; weather conditions - fog, snow, ice. Unfortunately, many of our requests only come after there have been one or more serious accidents, and it becomes rp4arent there .is need for the additional warning offered by flasher signals . As a general rule, this Commission is reluctant to open new crossings unless there is a i.osiive snowing of public need. Also, wher a crossing is improved, we are desirous that any ad- jacent or other unimportant crossing be closed in order that traffic be directed to the better crossing. We recognize the shorteomirfga of our approach because of the large number of crossings in the State. We, therefore, encourage the railroad cocipaelee to be alert to chancing condiLione where crossing betterments or changes shoLid be made. Ewing Chairman Board of Weld County Commissioners Court House Greeley, Colorado Re: Proposed Flashing-light signal protection at Union Pacific Mile Post 1L1.8.39, east of La Salle, Colorado. Dear Mr. Ewing: This is to acknowledge your inquiry of April 3, 1963, in the above matter. You mention the Board of Commissioners have been advised by Mr. E. H. Fairchild, of the Union Pacific Railroad Company, that • in order for such an installation to be accomplished, it will be necessary for you to determine the hazard rate of the crossing, and to decide percentage to be assessed both to the County and the rail- road: I regret that I am not acquainted frith Mr. Fairchild and am not aware of the procedure he has outlined for your action in this instance. You z rill no doubt recall that in the matter of the Pierce signals, I had no part in these negotiations. Your agreement bras completed with the railroad and the whole application vas submitted to this Commission; an investigation was then made from this office and the installation was approved by the Commission in its Decision No. 60370, dated March 27, 1963. For your guidance in the matter of planning for division of signal costs, there has been aside acceptance of the policy as developed in the expenditure of Federal and State funds for this work. Agreements coming to this Commission are on a 90 - 10 basis. That is - costs of installation are shared, 90c; by the Government Agency and 10% by the Railroad; with the full operation and main- tenance expense of the signals to then be provided by the Railroad. The reasoning for this distribution has come from the constantly increasing volume of vehicles on all roads and the declining or fearer number of trains that are being operated. However, this is not a fixed pattern, since the Commission encourages the re-routing of traffic to a protected location in order to possibly secure the closing of any nearby crossing or others not heavily used. In this manner, approvals are granted that may vary from the 50-50 Pierce division to 100;0 by either the Railroad or the Government agency, according to the conditions involved. I trust this explanation may help you in your further negotiations. It occurs to me that Mr. Fairchild may be employed on the Nebraska Division of the railroad and he has possibly given you a procedure followed in that state. Fairchild: Your letter March 18, 1963, referring to previous correspond- ence resolved free Board of County CemMissioners, Greeley, Colorado, in eoensetion with rerouting of County Road to just west of the site where the school bus-train accident occurred in December, 1961, near LaSalle, Colorado at Mile Post 148.39. You indicate in your report that the County would lib to install flashing lights on a 90/10% basis. Please investigate and advise if this read is any part of a Federal Highway System, as I know of no ether may that a 90/1O% basis can be worked. If it is net a State read, but merely a County read with ne designation number, it will be necessary for the County to make application to the Colorado Public Utilities Commission for such an installation, they in turn they will send their engineering forces out to determine the hazard rate of the crossing and then will decide what percentage is to be assessed. Please investigate further and in the meantime we will progress the necessary agreement with the County for the relocating of read erecting as indicated in your report referred to above. Advise. Gentlemen: In accordance with the request of our Governor, this Commission has been involved in a statewide study of highway-railroad grade crossings involving high-speed trains. More particularly, we are asked to give special attention to those crossings on the county roads that are used by school buses. In this regard, we realize that with the recent consolidation of many school districts, there has been a big increase in school bus travel. In like mariner, there has been extensive missile base construction, requiring truck transportation of explosives and inflammable petroleum products; hence, many county roads and rail crossings are now being used where there has never been this type of bus and truck traffic. In order to secure a thorough coverage of the situation, we will appreciate your assistance of carefully checking the grade crossings in your county to correct dangerous or unnecessary crossing travel by school buses and transport trucks. Meanwhile, our investigation work is continuing to seek out corrections for the problems of poor crossing locations, limited vision, steep approach grades and need for improved warning devices. In this manner, we hope to be of some assistance to you people and herewith make offer of our cooperation in the review of any hazardous conditions you may discover.
