RE: Conflict of Interest of Victor Jaccobucci ,
County Commissioner
WHEREAS, in a letter dated December 8, 1976, the Weld County District
Attorney requested a determination of conflict of interest for County
Commissioner Victor Jaccobucci concerning his use of County equipment and
labor on his farm in exchange for dirt to be used on County road 2,
pursuant to Section 16-9 of the Weld County Home Rule Charter, and
WHEREAS, the Weld County Council has considered the reports of the
District Attorney as well as testimony given by Mr. Jaccobucci , and
further has conducted its own investigation of the facts related to this
matter, and
WHEREAS, the Weld County Council finds that Mr. Jaccobucci was
personally involved in deciding to build County Road 2, adjacent to his
own property and further that he was personally involved in deciding the
source of fill dirt to be used on the road, and
• WHEREAS, Mr. Jaccobucci obtained substantial benefit for his farm
property as a result of the decision to use the fill dirt from his
farm, and
WHEREAS, the above mentioned personal interests did or gave the
appearance of interfering with Mr. Jaccobucci 's unbiased discharge of
his duties to the public as a County Commissioner, and
WHEREAS, the Weld County Council finds that the provisions of Article
II, III and IV of the Weld County Home Rule Charter concerning the
establishment of five departments with one commissioner as coordinator
for each of the five major areas was not complied with.

NOW, THEREFORE, BE IT RESOLVED, that under the above facts , a
conflict of interest does exist for Mr. Jaccobucci .
BE IT FURTHER RESOLVED, that because of this conflict of interest,
Mr. Jaccobucci should resign as coordinator of the Engineering Department
and hold no other official positions in the Engineering or Road and Bridge
departments for the remainder of his term in office.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote:
