Staff has reviewed your request and has determined that Special Review Permit for mining operations is required. Section 23-3-20.R of the Weld County Code lists the following as a use by right in the A (Agricultural) Zone District: "...sand, soil and aggregate mining, regardless of the use of the material, which qualifies for a single limited impact operation (a 110 permit) or is exempt from any permits from the Division of Minerals and Geology, generates no more that five thousand (5,000) cubic yards of material per year for off-site use and does not involve crushing, screening or other processing." Your proposed operation involves screening of mined materials and also it appears it will exceed the limit of five thousand (5,000) cubic yards of material per year for off-site use. Therefore a special review permit will be required per section 23-3-40.A.3 (Open Pit Mining and Materials Processing) of the Weld County Code. In addition, the County Code was amended in March 2004 to include Open Pit Mining and Materials Processing as a Use by Special Review in the 1-3 (Industrial) Zone District. In particular, we were interested in the Planning Department's opinion as to whether Weld County would require an application for Use by Special Review (USR). During this meeting, you requested that Arnheim provide further information as to the scope and logistics of their proposed sand and gravel mining operation, so that the county may advise to the need for a USR application. Enclosed you will find a letter from Kane Turner, President of AISA Civil and Arnheim, providing the details you desired. Wade Jensen Permitting and Zoning Specialist Enclosure: Letter from Kane Turner Cc: Project File Wilhelm BC 1575 WCR 27.Brighton.CO 80601 Banks&Gesso,LLC 720 Kipling,Suite 117 Lakewood,CO 80215 4/5/04 Mr.Gesso, The following describes our desired course of operation and remediation for our land at 1575 WCR 27, Brighton,CO 80601,should we be granted the ability to mine the existing gravel: Area of land to be mined=less than 10 acres;and with a 3:1 side-slope,the overall mined acreage will be closer to 7 acres. Depth of excavation=down to two to three feet ABOVE water table;the water table exists at an approximate depth of 20',so we would expect to excavate down to around 17'. At no time will groundwater be exposed to potential evaporative loss. Location of land to be mined=southern Y2 of our 19.75 acre property at 1575 WCR 27,Brighton,CO 80601. Use of mined gravel=Arnheim's sister company is AISA CIVIL,Inc.,a pipeline contractor that works throughout the Front Range and has its office and yard on the northern'A of the property at 1575 WCR 27, Brighton,CO 80601. AISA intends to use the excavated gravel as a suitable backfill material for its various pipeline projects in the Front Range. Form of remediation for gravel pit=Arnheim would like to fill the excavation back in entirely with inert fill(suitable soil&concrete debris)so as to have the land available for future industrial development (storage lockers,dry storage,etc.). Expected number of trucks needed to haul gravel in and out of gravel pit each day=On a busy day when AISA CIVIL would need reasonable amounts of bedding to keep up with a high-production pipeline job nearby(say 150 tons/day),it can be expected that there would be 1 end-dump truck/hour hauling out and bringing fill back in. AISA operates on a typical 8-hour workday,so it is expected that at a maximum there would be 8 trucks/day hauling gravel and fill in and out. When AISA wouldn't have any pipeline work in the immediate vicinity,and this likely will be often,there will be 0 trucks hauling per day. General appearance of excavation as it progresses=As a truckload of gravel is taken out,a truckload of inert fill(excavated from AISA's pipeline trenches and displaced by bedding and pipe)carried by the same truck will be delivered right back in to the gravel pit,so that at any time the size of the gravel pit's excavation will be relatively small. It is the intent of Arnheim to keep a continuous cut-&-fill operation going in the gravel pit. Specialized equipment necessary to operate gravel pit=Arnheim would employ a simple power screener to sort the large rock from the gravel,and would use a hydraulic excavator(CAT 345)and a wheel loader (CAT 938)to handle and load the product. Since the reclamation would require hauling in off-site fill, we will be applying for a Certificate of Designation(CD). In searching through the county statutes and regs, I haven't been able to find much(if any)information regarding requirements in filing for a CD. I have the state checklist of items to address,but am just wondering whether Weld may have its own requirements above and beyond what the state may request. Any help would be much appreciated. In addition, I have a question related to a separate matter... I spoke to a woman in your office briefly the other day,but didn't receive a definitive answer(my poor explanation surely didn't help). We have a client that is looking to purchase a Weld Cty property,on which the current owner(Aggregate Inds.)received a USR permit(#1354)in Sept. 2002. Evidently Aggregate Industries has not recorded the plat drawings, and our client wishes to do so. We have been retained to examine the existing drawings(from the USR submittal)and examine their adequacy in filing as a plat. I am trying to find any drawing standards the county may have in this regard,be they formal or informal. It does not appear that there are codified plat requirements,as is the case for subdivisions,but I want to make sure this is the case before submitting. Perhaps an example of a plat the county found acceptable from a similar site would be helpful? I did notice a few changes the County Commissioners requested, but I am wondering if any other standards need be met. Thank you for your time and consideration.
