Subject : Voortmans Egg Ranch - Fly Complaint
Dear Mr. Voortman :
The Weld County Department of Public Health and Environment has received numerous
complaints concerning flies coming from your facility. The facility is located at 43747 Weld
County Road 37 , east of Pierce. In response to the complaints , I observed the facility on
September 10, 2001 . The purpose of the site visit was to inspect and assess the facilities
compliance with the Section 25 - 1 -613 of the Colorado Revised Statutes, as amended, concerning
removal of nuisances , and Section 23 -4-710 of the Weld County Code (WCC).
Based upon my observations on the above date, the fly control measures being incorporated at
the facility is not adequate and an apparent nuisance condition exists .
Section 25 - 1 -613 provides the following:

"Removal of nuisances. The board of health shall examine all nuisances, sources
of filth, and causes of sickness, which, in its opinion, may be injurious to the
health of the inhabitants, within its town, city or county....., and it shall destroy,
remove, or prevent the same as the case may require."
Additionally, the fact that an apparent fly nuisance condition exists on this facility causes this
facility to potentially be in violation of Section 23-4-710 of the WCC.
As a result, in accordance with Section 23-4-710 of the WCC,we are requesting that you submit
a written plan of correction within five (5) days of receipt of this letter. It is important to note
that this facility will only be considered in violation of this Section of the WCC if you fail to
respond to this letter within five (5) days,and if you fail to control the flies at this facility.

We appreciate your cooperation and the effort you are making to control flies. However, please
be aware that in the event this facility continues to generate flies, causing nuisance conditions,
we will have no other option but to pursue legal action and relief in accordance with the WCC
and 25-1-613, C.R.S., as amended.
Please notify me in wnting within five (5) days of the receipt of this letter, of the corrective
measures you are taking and a detailed time that it will take to correct the fly nuisance condition.
