RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST HOWARD BINDER FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Howard Binder, VI #0000187, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of August, 2001, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Howard Binder, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until September 11, 2001, to allow adequate time for the property
owner to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0000187 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Howard Binder to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until September 11, 2001, to allow
adequate time for the property owner to bring the subject property into compliance.

Sections 29-7-10 and 29-7-130 of the Weld County Code. To bring the property
into compliance the property owner shall remove the mobile home without an
approved Zoning Permit for a Mobile Home. Additionally, the mobile home building
permits (originally issued in 1998) shall be finalized or the mobile homes shall
be removed from the property.

Dear Mr. Binder:
The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting with
the Board of County Commissioners on August 14,2001,at 10:00 a.m.,to consider the violations occurring on
the property. The above mentioned property is in violation of the following Section(s) of the Weld County
Code:
Chapter 23,Article Ill,Div I "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-20.11 "Mobile home subject to the additional requirements of Article IV,Division 3 of this Chapter."
Section 23-3-30 "Uses by special review."
Section 23-3-30.1 "Noncommercial junkyard."
Chapter 23,Article IV, Div 3 "Mobile Homes"
-No mobile home may be located or relocated in the County after August 25,1981,except in accordance with this
Division,including the issuance of any zoning permit which may be required by this Section. Each mobile home
located or relocated in the County after said date must have a building permit for a mobile home issued pursuant
to Chapter 29 of this Code...."
Section 23-4-130 "No MOBILE HOME may be located or relocated in the County after August 25,1981,except
in accordance with this Division,including the issuance of any zoning permit which may be required by this Section.
Each MOBILE HOME located or relocated in the County after said date must have a BUILDING permit fora MOBILE
HOME issued pursuant to Chapter 29 of this Code. An application for any zoning or building permit for a MOBILE
HOME required by this Division shall include the following:"
Section 23-0-140 "Mobile homes permitted in the A Zone District."
Section 23-4-210 "Temporary Accessory Structure."
Chapter 29,Article VII "Mobile,Manufactured or Factory-Built Home Permits"
Section 29-7-10 "Permit required."
-No mobile, manufactured or factory-built home, as defined in this Building Code,may be located or relocated
within the County without a building permit issued by the Building Official.
Section 29-7-130 "Certificate of occupancy."
-After final inspections,when it is found that the home complies with the provisions of this Building Code as can
be reasonably determined,the Building Official shall issue a certificate of occupancy. The certificate of occupancy
shall be obtained no later than one hundred eighty(180) days after the permit is issued. Failure to obtain the
certificate of occupancy within the one-hundred-eighty-day period will be sufficient reason to consider the mobile,
manufactured or factory-built home in violation of this Building Code. See Section 29-3-290 above.
To bring the property into compliance the following option(s)are available:
The"Noncommercial Junkyard"consisting of derelict vehicles,wood and miscellaneous debris shall be removed
or screened from adjacent properties and public-rights-of way. The mobile homes already located on the property
shall obtain final completion of all existing building permits(ZPMH-2106 = PR-9830382/ZPMH-2117 =
PR-9830383/ZPMH-2118=PR-9830384/ZPMH-2119=PR-9830385/ZPMH-2120= PR-9830386).Additionally,
the last mobile home(ZPMH-2259)shall complete the application process for the Zoning Permit for a Mobile Home.
Also the building permit(PR-0030305)shall be completed upon approval of such ZPMH. If the Zoning Permit for
a Mobile Home is not approved the sixth(6"")mobile home shall be removed.

This meeting will take place in the County Commissioners'Hearing Room, First Floor,Weld County Centennial
Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance
to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video from the road or adjacent properties the day before the Violation
Hearing (indicated above).
The Department of Building Inspections and Planning Services' staff will be recommending that the Board of
County Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary to correct
the violation, and that you were given sufficient time to remedy this violation. If you have any questions
concerning this matter, please call.

Dear Bethany,
I now have the inspector's cards with the information on what needs to be completed for the final
inspection. I do have one serious question about the final on the gas lines,it took three times,
with pressure tests to have everything correct and finally passed and everything was OK. The gas
and electrical were in the same trench at the time of the final and nothing was said about that.
Now you tell me that this is not acceptable.
This is going to cause somewhat of a problem. I talked to Bob Ross of Blue Ridge,who installed
the gas line, and he told me how busy he is and that changing the line is going to be a problem
due to the fact that he is booked most of the coming months.
I was informed by Bob Ross that in the Dacono—Firestone area all of the lines, gas and electrical
and even telephone lines are going in the same trench. I don't understand why my guys are the
only ones who have done it wrong.
Nevertheless,Mr Ross and I are meeting Tuesday morning,June 19,2001 to figure out how to
move the lines and get started. It is not going to be a small task,until new trenches are dug, lines
put in,hook ups complete and redo the pressure tests.
I need to address your statement about the"junkyard". There is one of the hired hands cars and a
dump truck where the engine went out. The wood or lumber pile is an accumulation from that
farm and three other farms used to fix corrals and fences, which will be taken care of.
I am not getting around as fast as I would like to due to a complete shoulder replacement on May
22,2001. By the first of the week I will have my workforce start on the things needed to be done
and work at it until done. I am not sure I will get everything accomplished in the two week time
frame allotted but will do my best.

Our records indicate that 5(five)out of the 6(six)mobile homes located on the property are currently justified;however,we can
not find any records justifying the 6i°(sixth)mobile home. In order to bring your property into compliance,a Zoning Permit for
a Mobile Home and a Building Permit shall be obtained or the 61h mobile home shall be removed from the property. Additionally,

It has come to my attention that you applied for a mobile home permit on September 18, 2000, under violation VI-
000187. You were sent an application for a Zoning Permit for a Mobile Home on October 16, 2000,for a Temporary
Accessory to the Farm. To date, we have received no information for this mobile home, and the additional mobile
home will need to be justified. Our record indicate that five of the six mobile homes have been justified. I am
enclosing another application for you to complete and return to our office.

The building official has determined that the property at 15370 WCR 10 is in violation of Section 30 of
the Weld County Building Ordinance. No building or structure regulated by this code shall be erected,
constructed, enlarged, altered,repaired,moved, improved,removed, converted, or demolished unless a
separate building permit for each building or structure has been first obtained from the Weld County
Building Inspection Department. In addition to the required permits, it is required that you also comply
with the Weld County Zoning Ordinance.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter. If you fail to correct this violation by June 25, 2000, it
will be scheduled for a hearing before the Board of County Commissioners to consider whether to refer
this violation to the County Attorney's office for legal action. You must come in and meet with one of
our planners to verify that you comply with all building and zoning issues and you must apply for the
appropriate permits and pay the total fee for the permit. At time of the inspection,it may be required for
you to open sections of the living quarters to allow the building inspectors access for inspection purposes.

Dear Mr.Binder:
I am writing this letter in reference to a mobile home on the property listed above. There appears to be a
6i°mobile home, in which we have no record of an issued permit, which is a violation of Section 30 of
the Weld County Building Ordinance. No building or structure regulated by this code shall be erected,
constructed, enlarged, altered,repaired,moved, improved,removed, converted, or demolished unless a
separate building permit for each building or structure has been first obtained from the Weld County
Building Inspection Department, to include electrical work. We have not issued a violation at this time,
but if you fail to correct this violation by July 2, 2000, a violation will be issued. Please come into our
office located at 1555 North 17th Avenue (located on O Street)to apply for all appropriate mobile home
permits. We also ask that you have all final inspections completed as soon as possible, once the permit
has been issued.
