HomeMy WebLinkAbout800628.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 461 - JOE GRAY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Commissioners of Weld County, Colorado, at a public meeting held on the 29th day of October, 1980 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 461, being the property of Joe Gray, described as the Northeast Quarter of the Southeast Quarter of Section 8 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended: The Northeast one-quarter of the South- east one-quarter, Section 8 , Township 1 North, Range 66 West of the 6th Princi- pal Meridian, EXCEPT the South 16 . 50 feet thereof, Weld County, Colorado, more particularly described as: BEGINNING at the Southeast corner of the Northeast one-quarter of the Southeast one-quarter; thence North 00°13 ' 10" West along the East line of said Northeast one-quarter, Southeast one-quarter, a distance of 16 . 50 feet to the TRUE POINT OF BEGINNING; thence continuing North 00°13 ' 10" West along said East line a distance of 1304 . 18 feet to the East one-quarter corner of said Section 8 ; thence North 89°43 ' 50" West along the North line of said North- east one-quarter, Southeast one-quarter; a distance of 1318 .73 feet to the North- west corner of said Northeast one-quarter, Southeast one-quarter; thence South 00°10 ' 22" West along the West line of said Northeast one-quarter, Southeast one-quarter a distance of 1304 . 12 feet to a point, said point being 16 .50 feet North of the Southwest corner of said Northeast one-quarter, Southeast one-quarter; thence South 89°43 ' 42" East parallel to the South line of said Northeast one-quarter South- east one-quarter a distance of 1319 . 79 feet to the TRUE POINT OF BEGINNING. CONTAINS 39 . 50 acres, more or less. 80052d WHEREAS , the Board of County Commissioners of Weld County, Colorado finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definitions of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and Section 2-1A(3) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land owned by Joe Gray be, and hereby is, exempt from the definitions of the terms "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended. The parcel of land on which this request has been made is described as the NE4 SEa Section 8, TIN, R66W of the 6th p.m. , Weld County, Colorado. This property is located 1 mile southeast of the City of Ft. Lupton. The property contains approximately 39.50 acres of Class II and IV irrigated soils. The request is to split the property into parcels of 6.0 acres and 33.5 acres. The applicant wishes to sell the entire property because of health and transportation considerations. Two purchasers are available for each proposed parcel. The 6.0 acre parcel has the existing improvements located on it. The 33.5 acre parcel is being used for agricultural purposes. Based upon the information suhnitted and the adopted policies in the County, the De- partment of Planning Services Staff recommends the request be approved for the following reasons: 1. The request is in compliance with the policies of the Weld County Comprehensive Plan in that to minimize conflicting land uses, residential development will be encouraged to located adjacent to existing towns and in accordance with the comprehensive plans and stated wishes of each community. This parcel of land is located within the comprehensive plan of the City of Ft. Lupton. The City of Ft. Lupton has no objection to this request. 2. The request is consistent with Section 9-2 of the Weld County Subdivision Regula- tions and Section 3.3.A. of the Weld County Zoning Resolution. The use will be compatible with surrounding agricultural uses. The request will allow agricultural and related uses to be the predominant land use. There will be no reduction in the demount of land currently being used for agricultural purposes. 3. This request complies with the provisions of Section 9-4 (A) of the Weld County Subdivision Regulations.
