WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a dairy operation on the above- described real estate, and WHEREAS, Section 3 .3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon approval by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the petitioners and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a dairy operation on the hereinabove described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Ray 800256 and Violet Peterson for a Special Use Permit for a dairy operation on the hereinabove described tract of land be, and hereby is, granted subject to the Development Standards contained in the Special Use Permit and subject to the conditions as recommended by the Weld County Planning Commission. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval contained in the Weld County Planning Commission recommendations dated April 16 , 1980 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. Tom Honn read the recommendations and Development Standards recommended by the Planning Services Department. Discussion was called for from the audience. There was none. MOTION: It was moved by Frank Suckla and seconded by Irma White this ap- plication,along with the Development Standards be forwarded to the Board of County Commissioners with recommendation for approval; and that ##4 in the Development Standards be stricken upon receipt of the engineering report. Motion carried with Chuck Carlson, Jerry Kiefer, Frank Suckla, Irma White, Don Billings and Bob Ehrlich voting for and none against. The Planning Commission was asked to consider and formulate a recommendation to the Board of County Commissioners concerning the proposed amendments to the Weld County Building Code. Don Billings, who is also a member of the Building Trades Advisory Committee reported these were reviewed a meeting of the Building Trades Advisory Committee. The amendments are primarily for clarification and corrections which will make the Weld County Building Code consistant. It also converts the various sections into a new numbering system. No building or electrical permits shall be issued on the Special Use Permit area until the attached Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the office of the Department of Planning Services. 3. The plat being amended to show 75 feet of right-of-way reservation for future expansion along the north side of the parcel bordering Highway 34 prior to recordation of the plat. rj g 4/16/80 Ray and Violet Peterson Development Standards - Dairy Operation 1 . The dairy operation on the hereon described parcel shall be limited to the facilities shown which are designed to handle a total of 100 milking cows and all other uses permitted by right under Section 3.3.B. of the Weld County Zoning Resolution. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds . 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, watery quality, noise emission, and sanitary disposal systems . 4. Lagoons for wastewater retention shall be installed as per Rules and Guide Lines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May 1968. The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health, Water Pollution Control Division. 5. All accesses shall have the approval of the Weld County Engineering De- Department and the State Higheay Department. All accesses shall be con- structed in accordance with the recommendtions and/or requirements of the Weld County Engineering Department and/or the State Highway Department. 6. All plans , specifications and data pertaining to the dairy operation shall be submitted to the Weld County Health Department for approval prior to obtaining a Building Permit for the dairy operation. 7. There shall be no discharge of wastes into any streams , other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 8. All plans, specifications and designs pertaining to the construction of dikes or berms on the subject and adjacent properties shall be reviewed by the Soil Conservation Service. , Weld County Health Department and Colorado State Highway Department prior to construction of the dikes or berms. 9. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations . Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 10. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Non- compliance with any of the above stated Deveopment Standards may be reason for revocation of the Special Use Permit by the Board of County Commissioners. Projected traffic on U.S. Highway 34 indicates the need for a total of 150 feet of right of way, 75 feet each side of the centerline. We ask that the additional width necessary to meet this need be protected by reservation or dedication. 2. The construction of a modular home on the north side of the highway will apparently involve vehicular access to U.S. 34. A Driveway Permit is required for any new access to a State highway. They milked approximately 35 head of cows at this time. They operated as a dairy farm building the herd up to 70 head. In 1971 or 1972, beacause of health, he elected to sell the dairy herd. The farm consist of 100 acres of farm ground and 30 acres of pasture ground. The buildings consist of a house, garage, dairy barn, calf sheds, pump house, and corrals. The future use of the farm will continue the same with the exception of the milk barn and corrals. The milk barn will be converted into a milk parlor with all new equipment . The corrals that is presently there will be extended to the west , with added water tanks and feeders to handle from 85 to 100 head of dairy cows, and Fred and JoAnne McCarger ( daughter and son-in-law) will be in charge of the dairy. With a Modular home being set across the highway to the east . for living quarters. At this location there is already a well for water, electricity, and a septic system. Not knowing of the Special Use Permit , or permits for the buildings, contractor has been contacted and will start building as soon as the plans are complete. With half of the money placed down the dairy herd is seiz for delivery April 15, 1980 to May 1, 1980. The health department has passes all inspections on it, except corral drainage, which is in the planning stage. We would very much immediate action, to save a finanical loss. There are three soil types present in the area as shown on the enclosed soil map. These soils are! Nunn loam, 1 to 3 pereent slopes (17A..B)i Olney fine sandy loam, 0 to 1 percent slopes (218AA); and Ustic Torriorthents, moderately steep (80..E»3). The enclosed soil descriptions will provide detailed informa` Lion. The Ustie Torriorthents soil is the one soil in the area being proposed for the carrel site. This soil is very poorly suited for use as an animal waste lagoon site as it is made up of gravelly sand material to depths greater, thin; 60 inches. A lagoon or holding pond constructed in the soil would most likely have a very high seepage loss and would esquire extensive sealing, The most feasible alternative would be to construct the new corral facilities directly to the south or east of the house to take advantage of better soil conditions and existing surface drainage tharsuete istics, A holding pond could then be constructed in the Nunn loam Broil, which has excellent cherac- teristics for this purpose due to clay loam subsoil material that will seal and keep seepage losses minimal. With the holding pond near field levels very little pumping lift would be required to pump out material to the existing irrigation system. This would eliminate the need for easements for drainage on the north side of the highway. The area presently being considered for the corral could be used for feed and equipment storage. ,X MCCargar . Page 2 Design of an animal waste system that will meet SCS and Colorado Statte Health Department requirements could be difficult as the area you are considering for the corral is very limiting due to soil conditions, topography and size. A holding pond large enough to contain storm runoff and dairy woeh water for 85 to 150 cows will require approximately 50'x150'x10' or 1.4 acre foot storage capacity.
