Dear Herbert:
On July 19, 1982 the State of Colorado Attorney General 's Office
rendered a decision on the taxable status of the National Railroad
Passenger Corporation (AMTRAK). Those conclusions are: Amtrak is exempt
from payment of property taxes on personal property taxes on personal
property effective October 1 , 1981.
This decision has brought about a problem: what to do about the
period of time from October 1, 1981 to December 31, 1981, since Amtrak
will not be paying taxes for that period of time?
The Property Tax Administrator recommends that the County Assessor
file a petition for abatement or refund of taxes for Amtrak covering
those three months to solve the problem.
