'J? ,:i \ ' 2 • RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN OIL FIELD FLUID DISPOSAL - MIKE CERVI WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 26th day of May, 1982, at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board for the purpose of hearing the application of Mike Cervi, P. O. Box 169 , Sterling, Colorado 80751 , for a Use by Special Review for an oil field fluid disposal site, on the following described real estate, to-wit: Part of Section 33 , Township 3 North, and Section 4 , Township 2 North, Range 62 West of the 6th P. M. , Weld County, Colorado. WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Plan- ning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board' of County Comn}issioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan in that policies of the plan promote Use by Special Review proposals in an Agricultural Zone District, so long as they do not create negative impacts on the environment or the County. The attached Development Standards will minimize impacts on surrounding uses and the area to the greatest extent possible and provide adequate protection of the health, safety and welfare of the inhabitants of the area and the County. b. The use is both compatible with existing agricultural activity and with land use which is contemplated to be agricultural in the Comprehensive Plan. These determinations are based, in part, upon a review of the information submitted by the applicant, other relevant information regarding the request and responses of the referral entities which have reviewed this request. The Weld County Planning Commission recommendation for approval is conditional upon: 1. The attached Standards for Use by Special Review be adopted; 2. The plat for the Use by Special Review be placed on record by the Department of Planning Services staff prior to any building permits being issued on the site. The plat shall be amended to show a second concrete dumping pit and future clay lined ponds. 3. Disposal at the old site shall be terminated within forty-five (45) days of the final decision made by the County Commissioners. 4. At the end of operation at this facility the site must be closed in accordance with the Solid Waste Act and all pertinent Department rules and regulations. RUSSELL ANSON PLANNING DEPARTMENT REPRESENTATIVE, ROD ALLISON The following business was transacted: I hereby certify that pursuant to a notice dated May 10, 1982 , duly published May 13 , 1982 in the LaSalle Leader, a public hearing was held on the request of Mike Cervi for a Use By Special Review for an oil field fluid disposal site. The Planning Commission recommended that this request be granted with conditions and development standards. Mr. Mike Cervi, the applicant was present, and commented on the need for this facility in this area. He added that there are several oil and gas wells in the area and as a result, there is a real need for an oil field fluid disposal site. Mr. Cervi agreed with the development standards. The Colorado State Health Department has approved the plan and the development standards. Mr. Cervi ' s plan is that no fluids will escape from the designated dump site. Donald F. McCleary, legal counsel representing Morgan County Water Quality District, elaborated on their seven million dollar system which serves Weld, Morgan and Washington Counties. Mr. McCleary stated that he does not object to this request so long as a representative from the water district is granted access to the site to make inspections and further, that item #3 of the develop- ment standards be amended to delete, "A substitute liner may be used as an alternative if such liner is approved and certified by the Colorado State Health Department prior to construction or to allow a substitute liner to be determined after the grading has been completed by the Colorado State Health Department. " Mr. McCleary stated that the District does agree with the three foot clay liner or a six inch bentonite liner with a membrane cover in each pond. Tape change 82-37 George Underwood, representing Norton, Underwood and Lamm Consulting Engineers, commented on the size of the Morgan County Water Quality district and the 3 , 000 people that it serves. He used a map to illustrate the size of the district and the underground water flow of the Lost Creek Underground Water supply. The quality and quantity of the water was discussed. He stressed that the plan in the existing file is a preliminary plan designed by Chen and Associates and he believes that it should be the final plan, not just a preliminary plan. He also stressed that there should not be any seepage allowed from any of the ponds. He recommended if approved, that the Board insist that the ponds have a t'firee foot clay liner or six inches bentonite with a liner. Mr. Chet Smith, representing Empire Laboratory a Consulting Engineer, after reviewing the site recommended the three foot clay or six inches of bentonite, a membrane, and six inches of soil cover. Tom Norton, representing Norton, Underwood and Lamm , Consulting Engineers , commented on a similar case in his opinion. The case was the water system for the Town of Pierce where the bentonite sealer failed and how costly that instance was. He added that the soils at Pierce and at this site being considered today are very similar. The attorney, Mr. McCleary, pleaded with the Commissioners to take their recommendations seriously for the protection of the Morgan County Water Quality District. Mr. Smith stated that the membrane protects the clay from the sun and the pond should last approximately twenty years. Mr. Cervi said that he is very familar with the area and that there are a lot of gophers in the area. He predicted that the gophers will eat the liners. Mr. Cervi stated that there currently are illegal dumping sites in this area. Mr. Cervi contended that the Pierce water system is not a good comparison and contended that if the site is- not constructed properly there may be problems. He believes that the Pierce site was not constructed properly in the beginning. Mr. Cervi, when asked, stated that no dumping is occurring at this site, that he does have another site that is currently being used for a dump site, and there is no permit for said site. Mr. Suedkamp, representing Chen and Associates, commented on his finds reputation and their report contained in said application. Mr. Suedkamp added that the membrane cover can be treated to keep the gophers from destroying it. He added that his firm did design the plan for Weld County Disposal, Inc. and since it has been installed they have not been in violation. Jim Klein, representing Victor Klein, read his father' s letter of objection into the record. Mr. Klein owns property one mile south of the site. Jim Klein stated that he lived on the property for one year and was flooded twice during the same year. Commissioner N. Carlson stated that the county publishes legal notices in the LaSalle Leader because it was the low bidder and the bid met the specifications. Commissioner N. Carlson was offended by the remark that the Commissioners were too busy to discuss this matter with Mr. Vic Klein. Commissioner N. Carlson stated that he discussed this application at length with Mr. Vic Klein. Mr. Rod Allison, representing the Planning Staff, stated that this site is not in the flood plain. Bud Clemons, representing the Colorado State Board of Land Commissioners, presented maps to the Board which displayed the amount of property in this area that is owned by the State of Colorado. He stated that they are not objecting to this request they just want the Board to know how much land they own in the area. George Underwood stated that this site is in the East Lost Creek flood plain. Mr. Cervi stated that he has lived on this property continually since 1979 and in order for this site to flood the flood waters would have to back up by several feet. Mr. Jim Klein questioned who will be monitoring the dumping sites. The Colorado Health Department and the Weld County Health Departments will monitor said site. After deliberation, Commissioner C. Carlson made a motion to grant this request provided that the applicant sticks with the development standards as listed and further that the Morgan County Water Quality Division have the same rights as the Health Departments to check the site. Commissioner N. Carlson seconded the motion. Commissioner Kirby, after discussion, made a motion to amend the motion by adding that development standard #3 include that if there is any substitution in the liner that this Board during a regular Board meeting consider said substitution. Commissioner Stein- mark seconded the amendment to the motion. The amendment to the motion carried unanimously. Commissioner C. Carlson stated that he is concerned about the dumping all over the county, that there is a real need for this site, that this Board needs control, and he feels that this amended motion should protect all concerned. These determinations are based, in part, upon a review of the information submitted by the applicant, other relevant information regarding the request and responses of the referral entities which have reviewed this request. The Weld County Planning Commission recommendation for approval is conditional upon: 1. The attached Standards for Use by Special Review be adopted; 2. The plat for the Use by Special Review be placed on record by the Department of Planning Services staff prior to any building permits being issued on the site. The plat shall be amended to show a second concrete dumping pit and future clay lined ponds. 3. Disposal at the old site shall be terminated within forty-five (45) days of the final decision made by the County Commissioners. 4. At the end of operation at this facility the site must be closed in accordance with the Solid Waste Act and all pertinent Department rules and regulations. RA:rg MIKE CERVI USR-481:81:27 DEVELOPMENT STANDARDS 1. The use shall be an oil field fluid disposal site for the sole purpose of disposal of oil field brine wastes and the recovery of any oil associated with the waste received at this site. One employee shall be on the facility during dumping hours. The site shall be secured to prohibit dumping when an employee is not on the subject site. No toxic or hazardous wastes shall be accepted at this facility. The proposal shall include the facilities shown hereon. Said facilities shall be: A. One (1) structure built in accordance with the requirements of the Weld County Building Code and utilized as an office for the control, operation and security of the facility. B. The applicant shall be limited to four (4) State Health Department certified ponds at this facility. C. The barrel tanks on the facility shall have a total minimum capacity of 500 barrels and not exceed 2,500 barrels. D. Two enclosed concrete dumping pits. 2. Access to the Special Use Permit area is limited to one access point shown hereon. The access shall have the approval of the State Highway Department. The access shall be constructed in accordance with the recommendations and/or requirements of the State Highway Department. All private interior roads shall be graveled. 3. A three (3) foot clay liner shall be constructed for containment purposes in all ponds associated with this site. A substitute liner may be used as an alternative if such liner is approved and certified by the Colorado State Health Department prior to construction or to allow a substitute liner to be determined after the grading has been completed by the Colorado State Health Department. 4. The liner shall be placed in an approved manner to achieve a retention of all fluids for the maximum life expectancy of this facility. The methods of placement used and values obtained for acceptance of the liner shall receive prior written approval from a qualified and registered soils engineer (and the Colorado Department of Health Waste Management Division) . A copy of such document shall be filed in the office of the Department of Planning Services prior to conditional approval. 5. A minimum six (6) inches of protective soil cover be placed on the prepared clay surface of each pond. 6. The bottom of the pond liner shall be located no closer than fifteen (15) feet from the top of the existing water table. Mike Cervi USR-481:81:27 Development Standards Page 2 7. A qualified soils engineer shall monitor the construction of ponds and provide written certification to the Colorado Department of Health-Waste Management Division and the Department of Planning Services prior to conditional approval. 8. The applicant shall discuss with the Colorado Department of Health Waste Management Division and agree to a minimum free board determination for this operation. A copy of this agreement shall be filed in the office of the Department of Planning Services prior to conditional approval. Waste shall not be allowed to accumulate above the minimum free board level. 9. The operator shall provide measuring devices in all ponds which will not damage the lining. Said devices shall be easily accessible and easily visible to the Colorado Department of Health and Weld County Health Department. 10. The applicant shall discuss with the Colorado Department of Health Waste Management Division and agreed to a plan for periodic monitoring of the facility. This plan should include the frequency intervals and parameters to be sampled for both ground water and effluent contained within the ponds. A copy of this agreement shall be filed in the office of the Department of Planning Services prior to conditional approval. 11. Prior to start-up of the new facility, the site shall be inspected by a representative of either the Colorado Department of Health or the Weld County Health Department. 12. At the end of five years (from the date of final project approval) the owner and/or operator shall sample test the liner material to determine integrity and life expectancy performance. A copy of these results shall be submitted to the Colorado Department of Health and the Department of Planning Services. 13. The settling ponds shall be screened with a one inch wire mesh to prevent wildlife gaining access to the pit. All settling ponds shall have flagging devices placed no more than ten (10) feet apart to discourage birds from landing on the water surface. These flagging devices shall be maintained in good repair throughout the life of the operation. 14. The applicant shall install adequate fencing for control of access to all ponds located at this facility. 15. An access road shall be constructed and maintained around the perimeter of each pond such that there is adequate access for a vacuum truct to skim oil from all areas of the holding ponds. 16. Four test wells have been located and constructed for determining local direction of groundwater flow at this site. The wells were Mike Cervi USR-481:81:27 Development Standards Page 3 placed in such a manner that one (1) well is upgradient of the site and the remaining wells are located downgradient. The wells shall be maintained during the life of the facility. 17. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. Representatives or members of the Weld County Health Department, Weld County Department of Planning Services Staff and/or Colorado Department of Health shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with all applicable Weld County and State Health Regulations. 18. Upon cessation of operations at the site all structures shall be removed to thirty (30) inches below grade and all ponds or pits shall be filled and graded so as to conform with the surrounding terrain. The special use permit area shall be reclaimed to the condition prior to this operation. 19. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 20. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Noncompliance with any of the above stated Development Standards may be reason for revocation of the Special Use Permit by the Board of County Commissioners. 21. Any waste removed from the ponds shall be disposed of at a dump site approved to handle such wastes. In particular, this data includes a hydraulic evaluation of the site conducted by Muller Engineering Company, Inc. and a geotechnical investigation of the site conducted by Chen and Associates, Inc. Muller Engineering, Inc. concluded that no negative impact from a hydraulic or hydrologic standpoint can be expected to occur at the site. Chen and Associates, Inc. conducted an evaluation of subsurface conditions at the site and concluded that the site can be developed for the proposed usage. In general, the site is predominantly silty to clayey sand. The free water table is located approximately 15 feet below the ground surface. Based on the site conditions encountered, Chen and Associates recommends that the evaporation ponds consist of cut and fill embankments constructed with the on-site soils. In addition, they recommend that the ponds be lined with an engineered bentonite liner or soil liner approved by a soils engineer. As you know, my review is made at the request of, and in behalf of the Morgan County Quality Water District . It is the opinion of the Morgan County Quality Water District that the site proposed in Section 33 , T3N, R62W, is one of the poorest locations in the region that could be selected. The Lost Creek groundwater basin and the Hay Gulch Basin contain high quality underground water, some of the little that exists in the area. Both basins are extensively developed with domestic wells. In the case of Hay Gulch, the water is exported by the Morgan County Quality Water District to serve 3, 500 rural users . The applicant contends that the waste dump is located in Lost Creek and waste, if lost, could not reach Hay Gulch. He submits copies of Plate 3, "Groundwater Resources of the Lost Creek Drainage Basin" to support his contention. The applicant ' s own exhibit indicates that a connection exists between the basins beginning 2 miles south of the north line of Township 3N. We have remade the applicants Xerox exhibit to make it more legible. Also, we have shown the dump site in red, the district ' s wells also in red, and the alleged barrier in yellow. Mr. Rod Allison Page 2 March 18 , 1982 The dashed lines on the exhibit represent saturated aquifier thickness. It may be seen that the barrier extends only to the south edge of the district ' s well field. Below that point , pumping could draw water from the Lost Creek Basin. It is our contention that any waste facility would more properly be located outside of both the Lost Creek and Hay Gulch Basins . Assuming that both the County and the State Health Department persist in the thought that the proposed location be approved, it is our desire to have a foolproof facility installed. It is with that objective in mind that we have reviewed the applicant ' s submittal. It is our opinion that the submittals which I reviewed, dated October 21, 1981, and February 8, 1982 , are totally inadequate and do not justify issuance of a permit. We offer the following comments , not necessarily in our order of concern: 1. The applicanc makes no projection of the amount of waste they propose to handle. 2. There is no data showing the calculation for the size of ponds, to assure a balance between wasting and evaporation. 3. There are no design drawings illustrating the nature of gathering ponds, the means of achieving skiuuuing of oil or means of preventing dumping direct into lagoons . 4. There are no designs to illustrate how skimmings will be disposed of in an environmentally safe manner. 5. The October 21 , 1981 submittal describes the proposed v liner as bentonite applied at the rate of 60 pounds per square foot . The February, 1982 submittal describes the liner as 6" bentonite, and no application rates or methods are described. The application procedures described in the original appli- cation may be acceptable for a very thick liner. However, • 101 106 Mr. Rod Allison Page 3 March 18 , 1982 there is inadequate control if the liner is not very thick. We would not consider the construction techniques originally described to be adequate for a 6 inch liner. Some method of metering uniformity of bentonite applica- tion should be included. An excerpt from specifications recommended by Wyo-Ben Supply is attached. Please don't misunderstand. We do not agree with the use of a 6 inch liner. We believe a much thicker liner with rigidly specified bentonite content and uniformity is required. 5. No construction monitoring procedures are described. It V is our opinion that the dikes and liner should be tested by a professional test lab and a certification of com- pliance required. 6. Site drainage has not been adequately addressed. The applicant illustrates a drainage area of 3 , 000 acres and dismisses the possibility of runoff, with the comment that, "There has been no runoff that can be traced as definite floodways" . Plate No. 1 of the previously referenced Lost Creek Drain- age Basin Study, shows two draws in the vicinity of the site. Applicant shows a 10 ' x 10' box culvert immediately adjoin- ing the site and twin 10 ' x 9 ' culverts about one-quarter mile west. We seriously doubt that the drainage question has been adequately addressed. 7. Applicants total comments concerning the 100 year flood plain is as follows : "2 . Sitelocation in regards to 100 year flood plain : Very remote, if the unusual did happen, ample protection will be afforded by containing dikes with flow passing to the west side of the site. " No supporting data was included to support applicants position. We don' t consider the 100 year flood plain to be Mr. Rod Allison Page 4 March 18 , 1982 "very remote" with three, 10 ' box culverts immediately adjoining the site and two existing draws traversing Section 33. We assume the dikes would be constructed of very sandy material. If so , the applicants contention that ample protection from the 100 year flood would be afforded by tae dikes does not seem valid. Sandy dikes would wash very easily. It is recommended that the applicant be required to furnish a reasonable analysis of the 100 year flood limits . 8. In Item B. , l, of the engineers February 8 letter, it states as follows : "I am inclined to believe that this area is not in a traveling underground stream but is a pocket that is being drained as the water table is lowered by irrigation wells" . We are somewhat amazed by this statement, since the applicants submittal (the one to which we have added color- ing) clearly indicates the site to be nearly in the Lost Creek main channel and discharging to a point with a saturated aquifier thickness of 60 feet. In summary, we believe the submittals to date are excessively general in nature, lacking in designs , calculations , supporting exhibits and data. We believe the submittal should include the following: 1. A detailed large scale layout of the entire proposed facility with staging , if appropriate. 2 . An adequate analysis of drainage with 100 year flood limits plotted on a map with 2 foot contours . 3. Detailed designs and specifications of ponds , holding tanks, oil separating facilities, pond liner, and other pertin- ent features . 10 0 Mr. Rod Allison Page 5 March 18, 1982 4. Design calculations showing basis of design, anticipated volume of wasting, pond size calculations , separating and holding tank size calculations . 5. Operational plan which adequately describes the function- ing of the facility, safeguards against improper wasting, use of separating facilities, disposal of accummulated oils and other separated matter. 6 . Construction monitoring plan describing procedures to be used to verify construction is in accordance with approved documents . We don't believe any of the preceeding points have been adequately addressed in the present submittals . Certainly if the present application is approved by the planning commission it should be done subject to submittal and approval of all the aforementioned data by the County Engineer. As presented, this is actually a very preliminary plan involving a number of alternatives for disposal of the fluids. One plan would require evaporating the fluids. Alternate proposals involve the reinjection of the fluids. All proposals will require at least one pond or cell for storage of fluid. The evaporation plan would require additional ponds for evaporating water. The primary concern of this office is that of possible contamination of ground or surface water supplies. In order to prevent contamination, a liner or mem- brane would be required in each pond. The proposal is rather vague in this instance. Considerable discussion of bentonite lining is included; however, the plan maps show six (6) mil plastic liners to be installed. While both methods are acceptable, considerably more detail is needed to insure that the pits are impermeable. If bentonite is used, the effective- ness of the material to provide a seepage barrier is dependent on the bentonite remaining in a saturated state and that fluids in the petroleum waste will not cause the bentonite to floculate and become suspended in the fluid. Chemical analyses will be necessary to determine this property. Als f an impermeable membrane liner is a difficult procedure and covering of the mat- erial with low permeability soils is critical. Details of this would be necessary to determine if adequate safeguards are incorporated in the design. Since no water will be required, this office has no objection based on water supply. However, we cannot recommend approval without considerably more information concerning protection of surface and ground water supplies. Allison: The staff of the Colorado Water Conservation Board has completed a flood hazard evaluation for the Cervi oil field fluids disposal site (case number USR-481) to be located 2. 5 miles east of Raggen in parts of Section 33 , Township 3 North, Range 62 West and Section 4 , Township 2 North, Range 62 West of the 6th principal meridian. We offer the following findings for your consideration. No designated or otherwise identified floodplain information exists at or near the proposed disposal site. However , the topo- graphy on U. S.G. S. 7 .5-minute quadrangle maps of the area show that flows from "Hay Gulch" could possibly flood the site during a large storm event. This is contrary to statements made in item 5 of the application. We realize that considerable runoff from this gulch is probably lost in the sand hills area just upstream from the site, but we still feel further investigation is warranted. Also, potential pending effects south of highway 76 should be further investigated with culvert or bridge capacities docu- mented. In short, we feel the application lacks sufficient surface drainage information from which to make any recommendation for approval. Thus , we would recommend that the drainage basin affecting the site be outlined, the flow paths and 100-year flood limits defined and the ponds floodproofed as may be necessary. While this Division understands that you are proposing to upgrade the present facility so as to meet the requirements referenced above, the con- tinued use of the existing ponds and tanks is unacceptable given the high potential for surface and groundwater contamination. The use of the existing facility for disposal of oil and brine sludges must therefore be halted effective immediately. This suggestion may be used as a rough guideline by applicants in the siting of solid waste disposal facilities when considering their proximity to the groundwater level. The groundwater level encountered during the actual field construction of a solid waste disposal facility often varies considerably from the level indicated in the exploratory borings. This Division realizes that such anomalous field conditions are common and is generally not overly concerned unless the anomalies are gross. In our review of the proposed Roggen disposal facility, groundwater levels ranging from 13 to 50 feet were encountered. It is our opinion that the groundwater level at this facility approximates or exceeds the fifteen foot distance between the liner and the groundwater level suggested. Should the County Commissioners recommend approval to this facility, the applicant should identify and record those areas which may have a closer proximity to groundwater than suggested, and bring them to the attention of this Division. As long as the variations deterimed are within two or three feet of those evidenced by the borings, the intent of this Division's suggestion of a fifteen foot minimum distance relationship is being met. The proposed facility is to be located in part of Section 33, Township 3 north and Section 4, Township 2 north all in Range 62 west of the 6th P.M. Contained within the reports received and conversation with the applicant are the following commitments: 1. The facility will be operated for the sole purpose of disposal of oil field brine wastes (production waters) and the recovery of any oil associated with the wastes received at this site. Further, no toxic or hazardous wastes will be accepted at this facility. 2. A three (3) foot clay liner will be constructed for containment purposes in all ponds associated with this site. 3. Four test wells have been located and constructed for determining local direction of groundwater flow at this site. The wells were placed in such a manner that 1 well is upgradient of the site and the remaining wells are located downgradient. Pursuant to the Solid Waste Disposal Sites and Facilities Act 30-20 Part 1, C.R.S. 1973 as amended, our review indicates that this site can comply with the minimum standards and Departmental regulations if constructed and operated in accordance with the plans submitted to this office. The proposed clay liner is to be placed in an approved manner to achieve a retention of all fluids for the maximum life expectancy of this facility. The methods of placement used and values obtained for acceptance of the liner must receive prior approval from a qualified and registered soils engineer. 2. The fluids existing at the present site must be evacuated and these fluids be placed in one of the newly constructed ponds. 3. The energy disipation units (splash blocks) and a soil blanket be placed in such a manner that the liner integrity is insured against erosion and cracking due to excessive drying of the liner material. 4. The applicant must provide a plan for periodic monitoring of the site. This plan should include the frequency interval and parameters to be sampled for both groundwater and effluent contained within the ponds. 5. A minimum free board determination is needed prior to the start up of this operation. After this determination is made, the applicant should be required to adhere to this value. 6. The applicant should be limited to a maximum of 4 ponds at this time. Any expansion of this facility must receive recommended approval of this Department prior to further construction. . 7. The applicant must sample the liner material at the end of 5 years, run tests, and report the finding of these tests to determine if the liner is performing as expected and that its integrity and life expectancy is comparable to its initial design requirements. 8. The bottom of the ponds must be located no closer than fifteen (15) feet from the top of the existing water table. 9. Prior to start up of the new facility, the site must be inspected by a representative of either the Colorado Department of Health or the Weld County Health Department. 10. The applicant must install adequate fencing for control of access to all ponds located at this facility. 3 March 19, 1982 Page 3 • The Department recommends that continued disposal at the old site should be terminated within forty-five (45) days of the final decision made by the County Commissioners. At the end of operation at this facility the site must be closed in accordance with the Solid Waste Act and all pertinent Departmental rules and regulations. The observations were made on November 11 , 12 , 14 , 16, 17 , 18 and 20 , 1982 . The density tests were performed in conjunction with the observations of November 18 , 1982 . During the initial phases of liner constru:tion, a minimum of 10 percent Envirogel (bentonite) minus 10 material was mixed with the on-site clayey, silty sands . In the later phases , a minimum of 5 percent Envirogel (bentonite) minus 200 material was mixed with the on-site sands . The bentonite application rates were as recommended in Chen and Associates Job No . 23 ,953A letter dated October 25 , 1982 . The soil and bentonite materials were thoroughly mixed outside the pond area and then placed on the properly prepared surface in two lifts . A minimum compacted liner thickness of 6 inches was used. As shown by the attached results of the field density tests (see Daily Report No. 1) , the liner was adequately compacted at approximately the optimum moisture content . The results of a laboratory standard proctor compaction test performed on the soil (sand) - bentonite mixture are also attached. A preliminary soil and foundation investigation was conducted for the subject project in April 1982 reported under our Job No. 23,935. The laboratory samples consisted of on-site silty to clayey sand and various percentages of Wyo-Ben bentonite. Two different types of commercially produced bentonite were used. One consisted of -200 mesh material known commercially as Envirogel -200. The other product consisted of coarser bentonite materal with 100% passing the 10 mesh and a minimum of 20% passing the 200 mesh and known as Envirogel -10. Results of the laboratory investigations are shown on Figs. 1 and 2 and summarized on Table I. In general, it appears the finer the material grind the better the seal characteristic. The tests were run using distilled water and pond water obtained from existing evaporation ponds. The pond water appears to slightly increase the permeability of the bentonite-soil mixture. Based on the laboratory test results, a minimum application rate of 5% of Envirogel -200 material or 10% of Envirogel -10 material is required to obtain a mixed membrane liner with a coefficient of permeability of 1 x 10-7 cm/sec. The bentonite should be resistant to deterioration by dissolved salt contents and the application procedure and construction requirements should be in accordance with the suppliers recommendations. This recommendation would require a minimum application rate of approximately 3 lbs/ft2 of Envirogel -200 or 6 lbs/ft2 of Envirogel -10 material. Prior to placing the bentonite material, the area should be cleaned by removing all roots and debris and shaped to the desired contours. The soils then should be thoroughly tilled to the depth of the proposed liner. Water should then be applied to the soil to obtain optimum moisture content before spreading the bentonite. To insure complete coverage, two coats should be applied across the area to be treated. The applications should be applied cross- directional to one another. After the area has been completely covered, the bentonite should be thoroughly rototilled into the soil to form a homogeneous soil-bentonite mixture. The soil-bentonite mixture should be compacted at optimum moisture to at least 95% of the standard Proctor density. The mixing and compaction procedures should be observed by a registered professional engineer. Following the compaction of the liner, we recommend a minimum 6 inch compacted soil layer to cover the liner to help protect against degradation. The reason that I cannot appear in person as I would like is because I am scheduled to h?ve a surgery the same day at 7 :00 a.m. I would add that due to lack of notification, I was unaware of previous hearing dates until I read the results in the Greeley Tribune ; however, I do appreciate the certified letter informing me of this upcoming hearing. My objection to the Cervi proposal stems from my owner- ship of land located in the SW 1/2 of Section 4, Townshir 2N, Range 62 West which is the same section upon which the disposal site is pronosed. In the SW1/4 of Section 2, T2N, R62t! I own and operate a sprinkler to irrigate lands that lie within 1500 - 2000 feet of the property that is described to be the approximate location of the disposal site . The water supply for my well is derived from the same waters underlying the disposal site, and the short distance from the well to the disposal site would likely cause a downgradient condition flowing toward my well during the irrigation season. Because of the proximity of my property to the disposal site, I have looked closely at the proposal and must object for several reasons . First of all, the fact that my land and sprinkler lie so close to the rroposed site clearly shows that I have a significant possibility of being injured in the event that the site leaked into the groundwater or if the ponds failed for any reason. My inspection of the supporting engineering analysis furthers my doubts that the problem has been adequately studied. The drainage study done for Mr. Cervi indicated the remoteness of the possibility that flooding could affect the site . In the spring of 1973 we had a snow/rain flood on the area in question. Wet snow which was followed by rains was piled up in front of the culverts under I 76 near the disposal site and in front of the culvert passing under the railroad. The raters piled ur 6' to 8' deep and even covered the railroad trestles at points . About 1/2 mile of Weld County 2 Road 75 1/2 was washed a;ey by the flood waters ; in fact, the county used soil from one of our sprinklers to fill in the road. We still have a 3-4 acre area up to 12' deep remaining from the removal of the soil for the road. Another extenuating result of the flood was that static water levels in wells in the area were raised up to 12' from previous levels . In fact, a well (No. S-1 ) monitored by the State Engineer locatol in the SE 1/4 of Section 33, T3N, R62W had recorded water levels within 9 feet of the ground surface . This more than infringes upon the 15 foot minimum distance that has been assured by the proposal to be kept between the bottom of the pond and the ground water table . The related soil report states that the recommendations are based upon preliminary investigations and that final design should be approved by a soils engineer. The proposal states that possibly a substitute liner is to be installed if okayed by the Colo. State Health Department. Already conditions and requirements ar^ being altered and will certainly add to the confusion assoclatel with this type of proposal . I must say that I am familiar with this type of subtle change that occurs during the construction of similar facilities as my experience with w-ter districts, sewer districts and disposal sites has consistently shown that all such endeavors look good on paper but encounter many problems and changes prior to completion. This brings up my second reason for objecting to the proposal . Who is going to monitor the construction of the project and who is going to guarantee me that I won't be injured? Already my findings have shown problems with the initial studies, and my post experience related to such sites has indicated unsatisfactory surveilance practices by the State and County agencies . For example, when I first called your office and asked to talk to a commissioner about the disposal site, everyone was too busy to talk. I asked to talk to the engineering department and when I told them that the site was 35 miles south of Greeley, they indicated that they were unfamiliar with the site but if I went 'ast of Ft . Lupton, someone there would know where it was . I then called the planning commissioners who said they knew of the site, but that it was handled by the County Health Department. hen I called the Health Department, they said they knew of it but the only person who might help me was not there . In short, who will take responsibility for any violations, if any occur, and how often will the site be monitored? I have very little faith in your surveilance of this type of site . T ' I could be given a written guarantee that I would never le damaged by the site, then one of my complaints would be salved. 3 The third coir'la.int I have is the devaluation of my land. My past experience with oil companies' presence on that land is that their presence detracts from the value of my land. A nearby disposal site won't be any different. If you reduced my taxes accordingly instead of raising them, I would say you are doing your job. However I will end up as a partner ii the damages and have nothing to gain. I would also have this complaint remedied if you would have Mr. Cervi locate the site on some of the thousands of acres of land he owns that do not affect adjoining landowners . In summary, I feel that this situation is similar to the problem that the county had with the proposed Denver sewer in southern Weld County and I hope you take this into consideration from my point of view. I feel that I am in a position to incur damages from such a site and that inadequate studies have been performed to date . In addition I feel that the county or the state will not satisfactorily monitor such a site . Overall , the site represents a liability to me with no expectation of benefit . Conclusions reached after investigating the various drainage patterns in the area are as follows: The proposed waste disposal site is approximately 1500 feet east of the crossing of East Lost Creek (double 10-foot by 6-foot reinforced concrete box (DBL 10x6 RCB) culvert along I-76 in Weld County. Just west of the proposed site is a cattle crossing (Single 10x10 RCB culvert) under I-76. The proposed site is relatively flat with an overland flow direction to the northwest. The area immediately south of the proposed site drains onto the site, but is a relatively small contributing area. A railroad is located about 1400 feet to the south of the proposed site and almost completely stops runoff from the south of the railroad. One single 8x8 RCB culvert allows some water to pass the railroad. However, the elevation of the dirt road and surrounding ground just north of the railroad is high enough that it will sharply reduce the flow capacity of the railroad culvert. The ground is sandy with sparse vegetation, a high infiltration rate and low runoff rates. The runoff from the East Lost Creek basin will be confined within the basin and will pond at the railroad crossing. See No. 1 on the attached map. Sufficient volume is available upstream of the railroad to store much of the runoff collecting at this location. The flow that does pass the railroad culvert will flow toward the DBL 10x6 RCB culvert under I-76. See No. 2 on map. There is a distinct higher ground (basin divide) about 1000 feet to the east of the rail- road culvert that prevents runoff from East Lost Creek flowing toward the proposed disposal site. See No. 3 on map. The access road just south of I-76 has a low water crossing that directs flow to the DBL 10x6 RCB culvert at I-76. See No. 4 on map. WATER RESOURCES • CIVIL ENGINEERING M. Cervi April 29, 1982 Page 2 The drainages east of East Lost Creek south of the railroad are blocked by the railroad. See No. 's 5 and 6 on map. No culverts were evident within the railroad embankment. The volume availability is sufficient south of the railroad embankment to store the runoff generated south of the railroad. The proposed site will drain toward the cattle crossing. Minor ponding may occur at the access road as it does not have a low water crossing. This should not affect the proposed pond as it is to be constructed with a levee of five- to eight-feet above the existing ground. From our investigation, we conclude that the site will not be affected by runoff from East Lost Creek drainage or the drainages east of East Lost Creek. (4) A bentonite liner combined with the on-site soils can be utilized to seal the proposed ponds. ) ) ti Aft -2- PURPOSE AND SCOPE OF INVESTIGATION This report presents the results of a subsurface investigation for the proposed Cervi Oil Field Fluid Disposal site, to be located in Sec. 4, T.2N., R.62W. , and Sec. 33, T.3N., R.62W. , 6PM, Weld County, Colorado. The project site is shown on Fig. 1. A field exploration program was conducted to obtain information on ) the subsurface conditions. Samples of the material encountered during the subsurface investigation were tested in the laboratory to provide data on the classification and engineering characteristics of the on-site soil and rock. The results of the field and laboratory investigation are presented herein. This report has been prepared to summarize the data obtained and to present our conclusions and recommendations based on the conditions encountered. Design parameters and a discussion of geotechnical engineering considerations related to construction of the proposed facility are included. PROPOSED CONSTRUCTION The proposed oil field disposal site will consist of a mobile office facility, evaporation ponds, two dumping pits and storage tank facilities. The ponds will utilize both cut and fill sections to obtain a bottom pond elevation which will be approximately 13 feet above the existing ground water. Water impoundment depths will be on the order ) of 3 to 5 feet. Tentative interior and exterior slopes of 5:1 and 3:1 (horizontal to vertical), respectively, are proposed. A bentonite -3- liner is proposed to seal the evaporation ponds. The perimeter slopes will be revegetated and embankment crest will have adequate width to pass light vehicular traffic. The ponds will be constructed in phases with the first pond providing approximately 3 months storage. Rased on the estimated waste water generated (8,000 barrels/mo) and the calculated evaporation loss (22.5 gal/ft2/yr) , the first phase will require a pond approximately 200X200 feet in dimension. A typical pond section is shown on Fig. 3. SITE CONDITIONS At the time of our investigation, the site was vacant with the exception of an occasional gas and oil well. Vegetation consists predominantly of weeds and grasses. The topography is gently rolling, with occasional depressions and wind-blown sand dunes. The overall ground surface slopes downward from the southeast to the northwest. SUBSOIL CONDITIONS The subsoil conditions were investigated by drilling 10 exploratory holes at the approximate locations shown on Fig. 1. Graphic logs of subsoils encountered at the test hole locations are shown on Fig. 2. The subsoils consist predominantly of clean to clayey sands overlying stiff clays and bedrock below approximate depths of 15 to 20 feet or deeper. Gradation analysis presented on Figs. 4 and 5 indicate the sands are clean to clayey. The underlying clays are medium stiff to stiff and sandy to very sandy. The claystone bedrock is medium hard. -4- Ground water depths were encountered at 15 to 16 feet below the ground surface at the time of drilling and 14 to 17 feet below the ground surface at 9 days after the completion of drilling. At the southeast corner of the site, the ground surface rises approximately 10 feet and no water was encountered in the test holes in this area. The clay soils and claystone bedrock encountered at the site were ) evaluated for sealing purposes; The clay contains large quantities of sand and free swell tests indicate that it is not suitable as a liner material. The claystone exhibited high free swell charactersitics; therefore, it would be an acceptable liner material. A borrow source, located approximately 3 miles east of the subject site was sampled and tested for use as a liner material. Results of laboratory tests indicate that this source may be used for the production of clay liner material. Results of the laboratory tests are summarized on Table I. D POND CONSTRUCTION RECOMMENDATIONS The natural soils at the site are suitable for the construction of } embankment fill/cut sections, having a maximum slope of 3:1 (horizontal to vertical). The following design and construction details should be observed: (1) Fill placed within the embankment sections or beneath the pond bottom should be compacted to at least 95% of the standard Proctor density (AS'IM D-698) , at a moisture content near optimum. On-site sands obtained during the excavation or similar soils from adjacent site locations are suitable for use as fill material. -5- (2) Interior slopes should be overbuilt and trimmed back immediately prior to liner placement to ensure proper compaction and minimize moisture loss to the slope face. (3) Cut and fill slopes subjected to proposed impoundment depths should be stable at a maximum 3:1 design grade. However, to facilitate the proposed liner construction, we recommend 5:1 interior slopes. (4) Embankment sections subjected to occasional vehicular traffic should have a minimum crest width of 12 feet. This type of J traffic should not significantly affect the stability of the embankment for the design configuration. A gravel surfacing can be utilized to minimize wind erosion or rutting of the surface. (5) We recommend that the embankments be constructed to provide a minimum free borad of two feet to reduce potential water spillage as a result of wind action. (6) The bentonite liner material, consisting of a high swelling commercially produced grade, should be used to line the evaporation ponds. The bentonite should be resistant to deterioration by dissolved salt contents and the application rate and construction required should be in accordance with the suppliers recommendations. Rased on preliminary evaluation of the on-site sandy soil, a minimum application rate of 5 lbs/ft2, thoroughly mixed in the upper 3 inches of soil is required to obtain an impervious liner (less than 1 foot per year) . D Compaction of the liner should be to at least 95% of the standard Proctor density. The contractor should be aware of possible -6- problems with mixing and compacting of the slopes. We recommend a minimum 6-inch compacted soil layer to cover the lining to help protect it against degredation. (7) As an alternate to the recommended bentonite liner, an im pervious soil liner may be used. This liner should be a minimum of 12 inches in depth and should consist of a clay soil which exhibits a liquid limit of at least 40, a plasticity index of at least 15 and a free swell of at least 40%. In lieu of the clay soils, the on-site sand soil would be suitable if mixed with approximately ) 10% (by weight) fly-ash. The soil liner should be placed in uniform lifts of approximately 6 inches and compacted to at least 95% of the standard Proctor density, at 2% over optimum moisture content, in accordance with ASTM D-698. (8) The site should be graded to provide drainage of on-site surface water surrounding the embankment to prevent excessive ponding depths and possible hydrostatic uplift. It should be noted that the above recommendations are based on preliminary information obtained from the field and laboratory investigation. We recommend that the final design and construction of the proposed evaporation ponds be approved by a soils engineer. LIMITATIONS This report has been prepared in accordance with generally ?) accepted soil and foundation engineering practices in this area for use by the client for design purposes. The conclusions and ) -7- recommendations submitted in this report are based upon the data obtained from the exploratory holes drilled at the locations indicated on the exploratory hole plan. The nature and extent of variations between the exploratory holes may not become evident until excavation is performed. If, during construction, soil, rock and ground water conditions appear to be different from those described herein, this ) office should be advised at once so that re-evaluation of the recommendations may be made.
