WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld. County, Colorado, and WHEREAS, the Weld County Engineer has submitted the estimate for reimbursement to Great Western Railway for the cost of re-building the crossing on Weld County Road 66, at Windsor, Colorado and WHEREAS, the estimated reimbursement cost determined by Great Western Railway for the complete replacement is $11, 318. 00, and WHEREAS, the Board deems it advisable and in the best interest of Weld County to approve said reimbursement. NOW, THEREFORE., BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reimbursement in the amount of $11, 318. 00 to Great Western Railway for the cost of re-building the crossing on Weld County 66 at Windsor, Colorado, be and hereby is, approved. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 6th day of July, A.D. , 1981. I have discussed the estimate with Mr. Andrews of the Railway Company, who told me that it is their policy to completely re-build the crossing, including providing the 115 lb. rails (in lieu of the 90 lb. size) , as well as all the cross-ties under the intersection. Their reasoning for this is that since they are responsible for the crossing itself, they do not want to have to come back in and replace ties and rails at a later date, should the crossing become rough or fail . The estimate they have submitted of $11,318.00 is for complete replacement of the rails, ties and associated hardware under the new crossing. They will do all the work with their own crews and should the cost be less than anticipated, they would bill us only for the actual cost. If the cost is greater than anticipated, they, of course, would bill us for the actual cost, also. I have discussed this matter both with the State Highway Department and our County Attorney and they have both advised that in the case of putting a new road over an existing railway crossing, we do not have a realistic alternative to allowing the railroad to do their reconstruction prior to building the road over the tracks. In view of this, I can only recommend that the Board authorize reimbursement of the railroad for the reconstruction described in their letter of June 10, 1981. • ayne S.
