RE: APPROVAL OF PRELIMINARY PLAN FOR MOUNTAIN SHORES SUBDIVISION -
CALKINS LAKE II , LTD.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 22nd day of April, 1981, the Preliminary
Plan of Mountain Shores Subdivision was submitted to the Board
of County Commissioners by Calkins Lake II . , Ltd. in accordance
with the Subdivision Regulations of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners had evidence pre-
sented in support of the approval of the Preliminary Plan and
evidence presented in opposition to the approval of the Preliminary
Plan for the following described real estate, to-wit:
Part of the Southeast Quarter of Section 30,
Township 3 North, Range 68 West of the 6th
P.M. , Weld County, Colorado
WHEREAS , the petitioner was present, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, and
WHEREAS, the Board has studied the request as submitted and
having been fully informed, finds that said preliminary plan
should be approved. However, the following should be noted:
1. The Board of County Commissioners feels that
the impact on County Road 28 will be increased
by the subdivision and that a manner in which
to pave the road by the subdivision up to
County Road 1 be determined by the time the
final plat is submitted to the Board.
2. The Board of County Commissioners has concerns
about the presently contemplated sewage drainage,
and by the final plat stage, the applicant shall
submit information and designs which insure that
the sewage drainage will not go into the Union
Reservoir.
3. That there be perpetual maintenance by the
applicant for the sewage drainage design.
4 . That there be only one access on to County Road
28 , and

5. That new design plans be submitted to the
Board of County Commissioners.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Preliminary Plan
submitted by Calkins Lake II , Ltd. for Mountain Shores Subdivi-
sion be, and hereby is, approved with the above stated concerns
being addressed by the applicant.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 22nd day of
April, A.D. , 1981.

passage by the Weld County Planning Commission:
Be it Resolved by the Weld County Planning Commission that the Subdivision
Plat Mountain Shores Subdivision located on the following described pro-
perty in Weld County, Colorado, to-wit:
Pt. SRI Section 30, T3N, R68W
be recommended (favorably) (xq(Kfwnej).y0 to the Board of County Commissioners
for the following reasons:

1. The preliminary plan conforms with the requirements of Section 5"-A. of the
Weld County Subdivision Regulations with the exception of nonconformance
with Section 5-4 A. (1) (e. ) which will be dealt with as a condition of
approval .
This determination is based , in part, upon a review of the information sub-
mitted by the applicant, other relevant information regarding the request and
the responses of the referral entities which have reviewed this request. The
I specific recommendations and/or conditions of approval or disapproval of the
various referral entities are addressed as conditions for approval or are in
the Staff' s Comments .
2. The Weld County Utilities Advisory Board recommended approval of the
Utility Plann on January 8, 1981 .

1. The applicant shall sufficiently demonstrate to the satisfaction of the
Planning Commission and the Board of County Commissioners that, they
and Union Reservoir Company have reached an agreement regarding sewage
effluent and there will be no further objections to this project.
In regard to the roads there should be a consensus that the request
will not cause unreasonable highway congestion or unsafe conditions
with respect to the use of the existing or proposed highways .
2. The following note shall be placed on the final plat: All recommendations
and design criteria for site grading, foundations, fill and pavement
shall be in accordande with the REPORT OF A SOILS AND FOUNDATION
INVESTIGATION PROJECT NO. 293-L-80 prepared by Empire Laboratories, Inc.

Mr. Otis stated that he would like to explain his 'no' vote and the reasons for
it. "I think this Subdivision will place unreasonable demands on the police
protection. I don't think the applicant has met his burden of proof with regard
to the runoff and I 'm not satisfied to put that off to another day because
we don't know if there will be a consensus reached on it. We don't know that
there will be a consensus reached on the highways , in other words I 'm not
satisified with that. I 'm also not satisfied with the unreasonable demand
of an island in the county with regard to the impact on the schools , and
again the police protection."

Calkins Lake II, Ltd
1. The Weld County Engineering Department in a memorandum dated January 15,
1981 and two surrounding property owners have raised concerns regarding the
present and future condition of Weld County Road 28. This concern is addressed
in condition #1 for approval.
2. The Union Reservoir Company has in a letter dated January 5, 1981 raised
concerns or made recommendations which in the opinion of the Staff have
been addressed by the applicant to the satisfaction of the Staff. The
request for a six foot chain link fence along the south boundary of the
subdivision is, in the Staff's opinion, an unreasonable burden for the
developer.
3. The Planning Division of the City of Longmont has opposed the request as
indicated in a letter dated December 23, 1980. It is the opinion of the
Department of Planning Services that the Longmont Planning Department's
reason for oppostion are more relevant to comprehensive plan issues normally
addressed during a rezoning process rather than appropriate considerations
for a subdivision.
4. To date our office has received letters from two surrounding property
owners. Copies of those letters are in the attached materials.
5. The Longmont Soil Conservation Service did not respond to the referral
sent to it.

COMMISSIONER STEINMARK: Mr . Chairman I would move that we approve
the Preliminary Plan , giving notice thatthe County presently feels that
the impact on County Road number twenty-eight will be increased by the
subdivision and that ah amanner to ah pave the road from by the subdivision

would go straight through to this point and that leaves this access alone
for this division on to this road and have an access on to this street here .

TOM HONN: There is not a street there' now , this subdivision ,
this subdivision, would provide a design which would stud into what we're
hoping , would be a collector street that would go from this road up to
the state highway .
COMMISSIONER CARLSON: From twenty -tight to sixty-six
TOM HONN: Sixty-six which would provide a mechanism for
priminary access to any of the entire subdivided land
COMMISSIONER (male voice) Looks like it could be left undone .
CHAIRMAN: No, no , it won' t be left undone because this will
be an access here too on to road twenty- eight .
COMMISSIONER KIRBY: We can hassle that out with the final plat .
CHAIRMAN: Yea, any further discussion . I think one thing needs
to be said ah Wallace with your group I think you need to do a little more
investigation on who and their intentions on subdividing the land above you
and if that is a possibility that's gonna come about maybe you people all
ought to get your heads together on this sewage thing because I 'm really
concerned about that , that's a bog hole and there is no way that water is
going to get away unless you tarry it away in a line somewhere and I think
that that needs to be your concern and I think you people really need to
strive to see what else you can do .
COMMISSIONER C '_RLSDN: I think they can probably do it more
economically too by going together.
CHAIRMAN: Well that's what I mean.
COMMISSIONER CARLSDN: I 've been assured by a member of the
Longs Peak Water board that there has been a request for two hundred fifty
taps whether it includes Calkins lake II or whether it ' s another one coming
in or what if there is two hundred_ fifty plus the fifty that ' s three hundred .
CHAIRMAN: I can see a collection of people in that whole
section thirty and the entire section could grow into a line down here on
the very northwest corner of the lake and come on around the lake with a
line and put your collections in here and then you could take pick up the
people on the west side of the lake also . You can make yourself a pretty
fine sanitation district there an'_ it would be a great help to all of us
and I think it would be wise for ?o_ =o institute that if you could .

Re: Mountain Shores Subdivision

Dear Ms. Traxler:
With reference to your letter on the Mountain Shore Subdivision, please be
advised I would like to protest the development of this subdivision. I feel that
this high density subdivision surrounded by a rural area is not needed.
Weld County Road 28 does not have a stable base due to the lake conditions
and will not take the construction traffic or extra automobile traffic caused by
the subdivision. Every spring the road becomes impassable with only local auto-
mobile traffic and no truck traffic.
It is my understanding that the developer furnishes water, sewer, curbing
and paved streets. If this subdivision is approved I would like some type of
insurance that all utilities will be in and operating before any building per-
mits are issued. So many times in the past Weld County has issued building per-
mits on approved plans by the developer or as soon as money is deposited in es-
crow with the county.
The east side of the property in a natural drainage area for excessive waste
water from irrigation from fields to the north. Some of this ground is underwater
three months every year. This will not show up in soil reports this time of the
year. The planning commission should visually inspect this area.
For the above reasons I believe a subdivision should not be built in this area.

subject: Mountain Shores Subdivision Preliminary
Mountain Shores is the most southerly parcel of three contiguous proposed
developments in the east half of Section 30. According to proposals on
hand, the western part of Spinnaker Drive would be paralleled by another
road leading to a development north of Mountain Shores. Section 8-1D of
the Subdivision Regulations requires coordination with adjoining subdivsion
streets, utilities and drainage. I suggest a road be planned from Weld
County Road 28 north to State Highway 66 through all three developments.
This road would be a collector and should be designed and built to collector
standards.
Weld County Road 28 is a winding gravel road that will not adequately
provide service to the proposed development in the area. Section 5-4A(1)(e)
indicates preliminary plans should not be approved if the development causes
unsafe conditions with respect to highways, existing or proposed. Extra
traffic and dust will certainly be a major problem.
The soils report by Empire Laboratories, Inc. , dated December 1, 1980, indicates
ground water problems exist. No further information is required at this time,
but the applicant should be aware u4—ihe basement restrictions, perimeter drain
sytems or some method to midigate the problem will be required at final plat.

Gentl men:
The Board of Directors of the Union Reservoir Company met with
representatives of the proposed Mountain Shores Subdivision - Calkins
Lake II , Ltd . Partnership last night , February 12 , 1981. At the
close of that meeting , it was requested by Union Reservoir Company
that the subdivider explore putting a pipe around the reservoir in
order to discharge sewer effluent into Spring Gulch , a tributary
into the St. Vrain River. It is apparent that within the next few
years the area will be subject to other developments ( small and large)
and that the sanitary sewer system serving the area should have a free
outflow of the effluent which , if treated, could be discharged without
problems into Spring Gulch. It was felt this pipe would eliminate
many of the problems about which the Company is concerned. The sub-
divider is to look into this and get back in touch with the Company.
Sportsman' s Management , Inc. , recreational Lessee of Union Reservoir.
intensely uses the reservoir and the direct discharge of effluent into
the lake would cause not only psychological , but real problems as well.
Under its lease , Sportsman' s Management , Inc. is required to main-
tain liability insurance. It is considered that the new subdivision
will probably increase substantially the premium on this insurance due
to the greater number of people who will be living adjacent to the
reservoir, with the impossible task of keeping children away. There
was full discussion of the problems of locating an urban development
next to the reservoir as far as safety features are concerned. All
parties are aware that the body of water is an attractive nuisance , but
that only reasonable steps should be taken to require that houses be
located at a distance from the body of water so as to discourage children
from frequenting the lake. All of this only increases the risk and the
liability insurance cost of Sportsman' s Management , Inc.
There is also a problem with having a homeowners association take
care of the sewer operation as compared to a statutory district. This
leaves much to be desired , as that type of entity would have questionable
responsibility and liability for proper operation of the sewer plant .

The developers have stated that there will be a detention facility
for storm water which is probably within the capacity of Union Reservoir
to accommodate.
This letter is intended to inform the County Planning Commission,
its staff, and the County Commissioners of the status of the efforts
of the Union Reservoir and its recreation lessee to explore and consider
appropriate ways the area around Union Reservoir can be developed.

Dear Chuck:
The plans for the Mountain Shores subdivision have been reviewed, and the
following comments are submitted.
The subdivision proper will have some slight impacts on wildlife habitat, however,
not of a very serious nature, as it is rather limited.
The real concerns are with the effects of sewage effluent being dumped into
Union Reservoir. This lake is used for body contact sports and also supports
a good warmwater fishery, which in itself is a testimony to the quality of the
water. The discussion of sewage indicates that it will be clean effluent, but
in no instance can I find what the exact standards will be. If the standards
are not very rigid and controlled, the fishery will be destroyed, not to mention
the body contact sports.
One other concern is the problem of dogs molesting and destroying nests of •
waterfowl that use the lake for nesting. This could be a major problem if
dogs in the subdivision are not strictly controlled or the lake fenced off to
prohibit entrance by the dogs.

Re: Mountain Shores Subdivision
Dear Sirs:
We have reviewed the proposed Mountain Shores Subdivision and have
determined the student impact upon the St. Vrain Valley Schools.
Because of the long term need to provide educational space for students
generated by subdivision developments, the district has a policy request-
ing developers to contribute their fair share to the future acquisition
of school sites.
According to the district formula for this purpose, the developers of
Mountain Shores Subdivision should donate to the district a total of
1.0029 acres. Since this is not an adequate size for a school site, the
district would prefer to accept a cash-in-lieu contribution to be added
to other cash-in-lieu contributions from other developers for the purchase
of options or sites. We would appreciate the opportunity to meet with the
developer to negotiate the amount due the district.

Gentlemen:
I am writing to express concern over plans I have heard to
rezone the area around Union Reservoir. That area is one of the
best areas in Colorado for wild waterbirds of great interest to
our students in wildlife biology here at CSU as well as amateur •
birdwatchers from throughout the state. It is hopgfa buffer zone
of low density housing, or better yet, agriculture, be maintained
within a half-mile or more of the reservoir to lessen the disturbance
to the rich heritage of wildlife found on the reservoir.

This determination is based, in part, upon a review of the information submitted by
the applicant, other relevant information regarding the request and the responses
of the referral entities which have reviewed this request. The specific recommendation
and/or conditions of approval or disapproval of the various referral entities are
addressed as conditions for approval or in the Staff's Comments.
2. The Weld County Utilities Advisory Board recommended approval of the Utility Plan
for the Preliminary Plan on January 8, 1981.
The Department of Planning Services Staff recommendation for approval is subject
to the following be accomplished:
1. The applicant shall sufficiently demonstrate to the satisfaction of the Planning
Commission and Board of County Commissioners that the request will not cause
unreasonable highway congestion or unsafe conditions with respect to use of
the existing or proposed highways. The Planning Commission and/or Board of
County Commissioners may wish to impose reasonable conditions to mitigate any
highway congestion or unsafe conditions effecting the use of the highways.
The Department of Planning Services Staff recommends that the Planning Commission
and the Board of County Commissioners consider the following alternatives:
1. Paving of one-half of Weld County Road 28 adjacent to the subdivision by the
Developer.
2. Paving of Weld County Road 28 adjacent to the subdivision by the Developer.
3. Paving of Weld County Road 28 west to County Line Road (Weld County Road 1) by
the Developer.
4. Escrowing the appropriate amount of money for any of the above stated proposals.

1. The Weld County Engineering Department in a memorandum dated January 15,
1981 and two surrounding property owners have raised concerns regarding the
present and future condition of Weld County Road 28. This concern is addressed
in condition #1 for approval.
2. The Union Reservoir Company has in a letter dated January 5, 1981 raised
concerns or made recommendations which in the opinion of the Staff have
been addressed by the applicant to the satisfaction of the Staff. The
request for a six foot chain link fence along the south boundary of the
subdivision is, in the Staff's opinion, an unreasonable burden for the
developer.
3. The Planning Division of the City of Longmont has opposed the request as
indicated in a letter dated December 23, 1980. It is the opinion of the
Department of Planning Services that the Longmont Planning Department's
reason for oppostion are more relevant to comprehensive plan issues normally
addressed during a rezoning process rather than appropriate considerations
for a subdivision.
4. To date our office has received letters from two surrounding property
owners. Copies of those letters are in the attached materials.
5. The Longmont Soil Conservation Service did not respond to the referral
sent to it.

Dear Ms. Traxler:
With reference to your letter on the Mountain Shore Subdivision, please be
advised I would like to protest the development of this subdivision. I feel that
this high density subdivision surrounded by a rural area is not needed.
Weld County Road 28 does not have a stable base due to the lake conditions
and will not take the construction traffic or extra automobile traffic caused by
the subdivision. Every spring the road becomes impassable with only local auto-
mobile traffic and no truck traffic.
It is my understanding that the developer furnishes water, sewer, curbing
and paved streets. If this subdivision is approved I would like some type of
insurance that all utilities will be in and operating before any building per-
mits are issued. So many times in the past Weld County has issued building per-
mits on approved plans by the developer or as soon as money is deposited in es-
crow with the county.
The east side of the property in a natural drainage area for excessive waste
water from irrigation from fields to the north. Some of this ground is underwater
three months every year. This will not show up in soil reports this time of the
year. The planning commission should visually inspect this area.
For the above reasons I believe a subdivision should not be built in this area.

• VII. Sewage Collection & Treatment System
The proposed sewage collection system for Mountain Shores
Subdivision will consist of eight(8 )—inch diameter gravity—
flow sewer lines connecting manholes of moderate spacing.
This network will deliver the effluent to the treatment
facility, located at the west end of the open space.
This facility will occupy approximately 1250 square feet.
The placement of the aeration chambers underground will
accomodate the gravity—flow collection lines. It will also
minimize the visual pollution commonly associated with small
community treatment facilities. The insulation provided by
the earth cover will help eliminate problems from freezing
that often occur in small-flow systems.
We have had several discussions with the Colorado Health
Department regarding discharge from this treatment plant.
The obvious discharge location for this subdivision is into
Union Reservoir. Following acknowledgment of the use of
this reservoir for water sports, the state provided us with
the probable parameters necessary for a discharge permit.
The ' Sanilogical ' system can meet these with no difficulty.
The stricter parameters that may come from the reclassifica-
tion of the South Platte River Basin can be met with minimal
modification to the proposed facility, when necessary .
The owners of Mountain Shores Subdivision have studied
alternate treatment facilities for their proposed subdivi-
sion. The "SANILOGICAL" Subterranean Extended Aeration
Plant, provided by Santec Corporation, 8000 E. Girard
Avenue, Denver, Colorado, presents an interesting facility.
The proposed treatment system is an extended aeration plant,
consisting of a group of fiberglass tanks connected in
series. Each consecutive tank provides an environment
unique to the specific decomposed stage of the organic
matter in the effluent. This provides the high quality of
effluent proven to result from this system. The end product
is dischargeable effluent with no sludge removal necessary.
As mentioned previously, the placement of these tanks in the
ground virtually eliminates the odor and negative aesthetics
encountered with most other types of treatment facilities.
The operation and maintenance of this 'Sanilogical' system
is one of its greatest assets. This facility is essentially
self-operational. A warning system will be placed in a
position that will allow one or more of the residents in the
area to be made aware of any mechanical malfunction. They
can then alert the necessary personnel to rectify the
situation. A weekly inspection is recommended by the -

manufacturer to ensure the proper operation of the blowers
and to visually inspect the effluent. Complete effluent
analysis, according to the State Discharge Permit
requirements, will be performed. The homeowners' asso-
ciation association for this subdivision will be directly
responsible for its operation and maintenance. They will
contract with an individual having the appropriate
operator' s license, as designated by the Discharge Permit,
to provide the weekly inspections and periodic testing
necessary. This association will also be responsible for
any and all monthly operating expenses, including
maintenance, electricity, minor and major repairs.
VIII. Surface Drainage
The close proximity to Union Reservoir provides the
immediate solution to surface drainage in Mountain Shores
Subdivision. With proper overlot grading and street design,
storm runoff can be collected and then carried to the
appropriate location for a culvert under County Road No. 28.
This culvert will discharge to Union Reservoir directly.

Gentlemen:
Your December 18 , 1980 referral requesting comment and recommendatior
has been received by the Union Reservoir Company, whose reservoir is
adjacent and directly to the south and lower in elevation than the pro-
posed Mountain Shores Subdivision.
Although County Road 28 separates the subdivision area from the
Union Reservoir, it is so close to the reservoir that Union Reservoir
Company is substantially concerned with urbanization right next to its
reservoir for a number of reasons . Among the reasons would be the fact
that this body of water can be considered an attractive nuisance under
the Windsor Reservoir doctrine , with added and increased liability of
Union Reservoir Company for children and others playing on the reservoir ,
even as trespassers , and in the event of mishaps. Union Reservoir is
presently leased for recreational purposes to Sportsman' s Management ,
Inc. , which is a private, organized lessee , and the question as to the
liabilities assumed under the lease as to its members arises as to whether
or not such liability would be imputed to the lessee or to Union Reservoir
Company in event trespassing residents of the proposed Mountain Shores
Subdivision should meet with a mishap on the Union Reservoir when they
are on the reservoir as trespassers and not by way of any regulated and
safety-supervised right through the recreation lease. For safety pur-
poses , the Union Reservoir Company would want the County to require not
less than a six-foot chain-link fence along the south boundary of the
subdivision so as to discourage children in particular from trespassing
onto the reservoir property.
Although some major steps have been taken by the Union Reservoir
Company to comply with the Federal Dam Safety Act and the requirements
of the Colorado State Engineer with regard to a spillway on the Union
Reservoir, it is known that the run-off from storms and the accelerated

outflow of floodwaters will be increased into Union Reservoir with any
urbanization above it. Obviously, this subdivision has its outflow and
storm run-off drop into a proposed drainage culvert under County Road
28 and would then be discharged into Union Reservoir. The County may
want to require the subdivision to put in a retaining pond so as to slow
down the acceleration of the storm waters which would flow into Union
Reservoir into a more manageable head of water. When streets are paved
and roofs on houses are constructed in a subdivision, none of the water
falling on those areas soaks into the ground and thus the outflow from
such storm waters is rapidly carried away into the drainage and into
the reservoir. The hydrology study of Union Reservoir indicated there
is an area of six to eight square miles that drains into the reservoir
and on a thousand year storm any added or accelerated outflow can be a
problem taxing the reservoir.
Union Reservoir Company is totally opposed to receiving any sewage
outflow as proposed for the Mountain Shores Subdivision. The irrigation
users of the water would , of course, be confronted with the sewage pro-
blem as a psychological situation, and more importantly the recreational
use of Union Reservoir would be seriously curtailed by any accidental
discharges of sewage into Union Reservoir. Union Reservoir would then
pose a severe health hazard , even though the quantity of water would
materially dilute the raw sewage. Any allowance of a sewage system into
the area must require that the discharge be piped and conveyed in some
form of closed conduit and discharged below the Union Reservoir as the
Union Reservoir Company strongly objects to having any raw sewage even
temporarily exposed to be placed in the reservoir. Union Reservoir is
not now a sewage lagoon and it should never be considered as a sewage
lagoon.
The Union Reservoir Company raises the question as to the suitabilit
of the area for residence buildings. Any buildings placed there should
not have a basement because of the presence of ground water and undoubted
it would be very expensive pillar or pier construction to go down to
bedrock for a base and then pier it up for the support of the building.
On any basement there is always the problem of claims against the Reser-
voir Company for filling the reservoir to its high water line and causing
some seepage to occur in the basements , with claims made by those resi-
dents against the Reservoir Company. This is a problem which should be
addressed and protection should be afforded to the Union Reservoir Compan,
If the subdivision is eventually granted, care should be taken that
the subdividers do not advertise that the residents of the subdivision
will have access onto Union Reservoir for recreational or any other

purposes . Occasionally overly-eager promotors have overrepresented
the virtues of their areas to the detriment of a neighbor.

We have reviewed the preliminary plat, drainage plan, sewage disposal plan
and soils report by Empire Laboratories, Inc. The Empire Labs. report gives
an excellent discussion of soil types and foundation design criteria. Their
recommendations for site grading, foundations, fill , and pavement should
be closely observed. We especially concur with the recommendation that a
qualified person perform continuous reviews of excavation and foundation
phases of work. We recommend that the installation of utility lines and
facilities also be supervised by a qualified soils engineer.
If these recommendations are followed, we have no objection to approval of
this application.

The Planning Division of the City of Longmont strongly opposes the three
proposals as they are inconsistent with the goals , policies and land use
map of the Weld County Comprehensive Plan. Because these are uses by
right, the underlying problem lies with the zoning which allows uses
that are in conflict with the Comprehensive Plan.
Additionally, the Weld County Comprehensive Plan explicitly states
that new urban development not served by existing municipal utilities
will be discouraged. Such developments inefficiently utilize public
services and place burdens upon surrounding municipalities. The 279
additional dwelling units (about 800 more residents) will have a
significant cumulative impact upon the provision of rural services.

Gentlemen:
In regard to your correspondence of December 29, 1980
concerning a subdivision called Mountain Shores Subdivision on
Part of SE*, Section 30, TaN, B68W.
We understand that a large number of homes are to be
built on this small acreage adjacent to our farm. We are
primarily concerned with the sewage treatment for such a project.
Because all the discharge will necessarily go into Calkins Lake
it is imperative that the sewage discharge be potable, otherwise
you will create a cesspool of this beautiful body of water. The
land can in no way accommodate leaching fields too close together.
An Environmental Impact study should be made before
such a project can be attempted.
Secondly, there should be assurance that Road X28 be
paved, because the dust created by such an influx of traffic
would be extremely objectionable to everyone in this area.
We think mach consideration should be given by your
commission before such a subdivision be granted. One house
on two or three acres would seem to be the maximum for this
area.

subject: Mountain Shores Subdivision Preliminary
Mountain Shores is the most southerly parcel of three contiguous proposed
developments in the east half of Section 30. According to proposals on
hand, the western part of Spinnaker Drive would be paralleled by another
road leading to a development north of Mountain Shores. Section 8-1D of
the Subdivision Regulations requires coordination with adjoining subdivsion
streets, utilities and drainage. I suggest a road be planned from Weld
County Road 28 north to State Highway 66 through all three developments.
This road would be a collector and should be designed and built to collector
standards.
Weld County Road 28 is a winding gravel road that will not adequately
provide service to the proposed development in the area. Section 5-4A(1)(e)
indicates preliminary plans should not be approved if the development causes
unsafe conditions with respect to highways, existing or proposed. Extra
traffic and dust will certainly be a major problem.
The soils report by Empire Laboratories, Inc. , dated December 1, 1980, indicates
ground water problems exist. No further information is required at this time,
but the applicant should be aware algtffe basement restrictions, perimeter drain
sytems or some method to midigate the problem will be required at final plat.

Gentlemen:
The Board of Directors of Longs Peak Water Association has reviewed the
request for domestic water taps for the above-referenced project. Based
upon our understanding of the phased time table for development, the
Association will have adequate treatment capacity for this project.
The Association's engineer, Mr. Ken Rollin of Rocky Mountain Consultants ,
Inc. , has completed a preliminary analysis of what expansion of the
Association's lines and facilities will be necessary to provide domestic
water service to this project. On the basis of that analysis, it appears
that the Association will be able to provide such service. Final
approval will be contingent upon completion of detailed engineering
studies and negotiation of a Subdivision Service Agreement between
the Association and the developer.
In conclusion, the Association will have adequate raw water, treatment
capacity, and distribution facilities to serve this project if the
developer meets the Association's rules, regulations and requirements
and develops according to the proposed schedule. If you have any
questions concerning this matter, please feel free to contact the

Land Application
Our preliminary calculations indicate that the quantity
of treated effluent applied to the Kelley-Tiao and
Allen properties would be approximately two ( 2 ) inches
per year on 104 acres. This can be related to an
annual precipitation range of 12 to 18 inches, and a
normal annual irrigation rate of 24 to 96 inches.
We briefly discussed this proposal with Stanley May at
the Water Quality Control Division of the State Health
Department. He informed us that a Site Application and
a Land Application Permit would be required for this
operation. The State may also request the drilling of
several wells for monitoring the groundwater quality in
the area.
We anticipate that this information should be helpful
in our presentation to the County Commissioners. If
you have any questions, please contact our office.

Mountain Shores Subdivision
The developers of the above referenced subdivision have
approached us as adjacent property owners for our
consideration in using our ground for land application of
the sewage effluent from a package treatment plant.
After discussing this proposal with the developer and his
engineer, we are comfortable that our land can accept the
effluent from this package treatment plant without undue
burden upon our property. We are convinced that there will
be no health hazards from this project, and that our
marginal agricultural ground can benefit from the additional
irrigation water which will be available to us.
It is our understanding that the developer would be required
to pump the effluent to our property where we could store it
and mix it with conventional irrigation water prior to
application on our crop land.
