RE: APPROVAL OF RECORDED EXEMPTION NO. 468 - FRANK AND CLARA
VETTER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado at a public meeting held on
the 31st day of December, 1980 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 468, being the property of Frank and Clara Vetter,
decribed as part of the East Half of the Northeast Quarter of
Section 35, Township 5 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as
follows:
That portion of the East Half of the North-
east Quarter of Section 35, Township 5 North,
Range 67 West of the 6th P.M. , County of Weld,
State of Colorado, more particularly described
as follows:
Beginning at the Northeast corner of said
Northeast Quarter; thence along the East
line of the Northeast Quarter South 0°20 ' 30"
West, 2502. 65 feet to the Southeast corner
of said Northeast Quarter; thence along the
East-West centerline of said Section North
89°52 ' 18" West, 1316 . 49 feet to the West
line of said East Half; thence along said
West line North 0°15 ' 22" East, 2489.90 feet
more or less to the North line of said North-
east Quarter; thence along said North line
East 430 . 23 feet; thence South 0°31 ' 29" East,

The above described parcel is subject to a
30. 00 foot wide reservation for County Road
52 along the Northerly side thereof.
The above described parcel contains a gross
acreage of 72 . 72 acres more or less.

does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Frank and Clara Vetter be, and hereby
is , exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 31st day of
December, A.D. , 1980.

Re: Recorded Exemption 468
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Frank and Clara Vetter for a recorded exemption. The parcel
of land on which this request has been made is described as part of the
Ei NE= Section 35, T5N, R67W of the 6th P.M. , Weld County, Colorado.
This property is located 2 miles north of Milliken, Colorado. The property
contains approximately 72.89 acres of Class 11 and IV irrigated soils. The
request is to split the property into parcels of 1 . 12 and 71 .72 acres.
The Vetters wish to transfer the 1 . 12 acre parcel with an existing residence
to their son. Their son is taking over the farming on the property as a
full time operation. The Vetters will continue to live on the larger parcel .
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services Staff recommends the request be approved
for the following reasons:
I . The proposed split conforms with Section 9-2 of the Weld County
Subdivision Regulations ( intent clause of the recorded exemp-
tion procedure), Section 3-3 A. of the Weld County Zoning Resolu-
tion ( intent clause of the Agricultural Zoned District) and the
Weld County Comprehensive Plan in that each parcel does have an
existing set of improvements. The use will be compatible with
surrounding agricultural uses. The request will allow agricultural
and related uses to be the predpminant land use. There will be no
reduction in the amount of land currently being used for agricultural
production. Furthermore, this action will not cause increased im-
pacts from residential development on the parcel in question or
the surrounding area as residential improvements exist on proposed
Lots A and B.
2. The Town of Milliken has set forth no objections to this request.
