BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, o COLORADO: WHEREAS, Ordinance No. 1, providing for the licensing and regulation of security patrol agencies and their agents and employees, was previously passed and adopted on the 23rd day of June, 1976 , and WHEREAS, said Ordinance No. 1 was amended on the 23rd day of January 1978 by Ordinance No. 19 , and WHEREAS, it is the desire of the Board of County Commissioners to place the regulation of this Ordinance under the Weld County Sheriff instead of the County Finance Officer, and WHEREAS, expenses incurred by the County for the regulation of said Ordinance have increased. NOW, THEREFORE, BE IT ORDAINED by the Board of County Com- missioners of Weld County, Colorado that Ordinance No. 1 and Ordinance No. 19 be, and hereby are, repealed and re-enacted with amendments as follows: SECTION I . SECURITY PATROL AGENCY DEFINED Security patrol agency shall be defined as any natural per- son, firm, or corporation, association, partnership, receiver, trustee, executor, administrator, guardian, fiduciary, or other representative of any kind engaged in the business of providing protection to persons and property for preserving the peace and conduct of any business in the County of Weld. SECTION II . LICENSE REQUIRED It shall be unlawful for any security patrol agency, or employee or agent of said security patrol agency to engage in the business of a security patrol agency or to represent himself 80045U 182/1106 °ct 902 f-a- to any person or the public as a security patrol agent within the County of Weld, excluding those areas within the incorporated limits of any incorporated city or town, without having first procured a license therefor, as hereinafter provided from the Weld County Sheriff. Every agency must have an agency license and every employee must have an employee license even if there be only one employee for an agency. SECTION III. LICENSE APPLICATION; CONTENTS Applicants for license as a security patrol agency, employee or agent of a security patrol agency, shall file an application with the Weld County Sheriff on a form to be provided for that purpose and shall contain the following: (a) A description of the nature and type of business to be conducted or services to be offered, and the area expected to be covered in the conduct of business. (b) A statement as to the number of persons to be employed as agents or employees. (c) A statement as to the number and type of vehicles to be used in the conduct of business, and description thereof. (d) A description of any other equipment to be used in conducting the business. (e) If the applicant is to be employed by any other firm, corporation or person, it shall be stated who the employer is, the nature of services to be rendered to the employer, and other pertinent facts required by the Weld County Sheriff. (f) A statement as to whether the applicant has ever been convicted of any felony, misdeameanor or ordinance violation involving moral turpitude, a breach of peace, the nature of the offense, penalty or punishment imposed, and the date and place where such offense occurred. Fingerprints shall be submitted with applications for -2- 0°4 902 verification and filed with the County Sheriff. A separate fee for required fingerprints may be required by the Sheriff in accordance with fees established under C.R.S. 24-72-306. If required by the Sheriff, such fees shall be as follows : File Search for Report/Criminal $2. 50 (plus 25¢ History postage, if mailed) 10. 00 (plus 25¢ a File Search for Records Stored postage, if mailed) at Archives Plus current photocopy of 50¢ per page (g) A statement as to whether or not the applicant has ever had a judgment or conviction for fraud, deceit or mis- representation entered against him and if so, the details thereon. (h) A statement as to the business or employment record of the applicant for the five (5) years immediately preceding the date of application of the applicant. (i) An applicant shall have a maximum of 90 days to com- plete all of the requirements for a license. If the time from the date of application exceeds 90 days , then application procedures must be started anew (including an additional fee) unless delay is due to circumstances beyond the applicant' s control. SECTION IV. PERSONS PROHIBITED FROM OBTAINING LICENSE No license shall be issued to the following persons: (a) Any person under eighteen (18) years of age or one who is not a citizen of the United States of America. (b) Any person who has been convicted of a misdemeanor involving fraud, theft or violent act, or violation of municipal ordinance involving fraud, theft or violent act in the three (3) years immediately pre- ceding the date of application. (c) Any person who has been convicted of a felony in the five (5) years immediately preceding the date of appli- cation. -3- cP 902 (d) Any person against whom judgment for fraud, deceit or misrepresentation has been entered five (5) years imme- diately preceding the application. SECTION V. LICENSE; DURATION AND FEES (a) The Weld County Sheriff shall issue licenses to appli- cants who are eligible to be licensed under the terms and provisions of this ordinance. Such licenses shall be issued on a calendar year basis. Licensees deserving the renewal of their licenses must apply for renewal within thirty (30) days immediately preceding the year for which renewal is desired. (b) All applications for the annual licenses shall be accompanied by the annual license fee. (c) The annual license fee for persons engaged in busi- ness of a security patrol agency shall be Fifty Dollars ($50. 00) and the annual license fee for agents or employees shall be Twenty Dollars ($20. 00) each. (d) For re-issue or transfer of a license, the fee shall be Five Dollars ($5. 00) . SECTION VI. IDENTIFICATION CARD In addition to the license, the Weld County Sheriff shall issue to each licensee an identification card which shall include the following: (a) Name, address, and physical description of the licensee. (b) The name of the employer if the licensee is an employee or agent. (c) Signature of the licensee and that of the Weld County Sheriff. (d) The expiration date of the license and such other information as the Weld County Sheriff may deem advisable. -4- 0* 902 SECTION VII. VEHICLE, UNIFORM, BADGE AND INSIGNIA REQUIREMENTS The Weld County Sheriff shall be the agent of the Board of County Commissioners for inspection and authorization of all vehicle color and insignia, uniforms, badges and insignia used by the security patrol agency, its agents, or employees, within the County of Weld. No security patrol agency, its agents or employees shall use any vehicle color or insignia, badge, uni- form or uniform insignia without first obtaining said authoriza- tion as required by this section. (a) At the time of receipt of license, no vehicle color, vehicle insignia, badge, uniform, or uniform insignia shall be authorized which resembles that which is utilized by a legally constituted law enforcement agency in Weld County, in such a manner as may result in public confusion as to the actual identification of the security patrol agency. (b) A list including year, make, identification number , and license number of all vehicles used by the security patrol agency, its agents or employees in the conduct of the security patrol business shall be submitted to the licenseing authority upon the issuance of any security patrol license. Thereafter, the licensee shall submit to the licensing authority any addition to or deletion from said vehicle list within twenty- four (24) hours of disposal or acquisition of a vehicle. SECTION VIII. NOTICE OF CHANGE OF ADDRESS OR DISCHARGE OF LICENSEE (a) Any licensee pursuant to the provisions of this ordi- nance shall immediately notify the Weld County Sheriff of any change of address , and such change shall not be deemed to be a transfer of the license or require the payment of any additional fees. -5- ciP 902 1824106 � G (b) Whenever a security patrol agency, agent or employee is discharged for any reason or ceases to be employed as a security patrol, immediate notification shall be given to the Weld County Sheriff. (c) When any security patrol agency, agent or employee ceases to be employed as a security patrol or removes himself from the County, he shall forthwith surrender his Weld County identification card to the Weld County Sheriff. In the event the person surrendering his identification card shall be reemployed or conducts a business as a security patrol for the remainder of the year, the identification card may be reissued to him. SECTION IX. BOND REQUIRED OF LICENSEE Persons licensed as a security patrol agency shall furnish a good and sufficient bond in the sum of Ten Thousand Dollars ($10, 000. 00) conditioned on the faithful observance of this ordinance and conditioned on the faithful performance and honest conduct of a security patrol agency. Such bond shall secure from monetary loss the County of Weld and any person, firm or corporation who may have employed such licensee as security and been injured by any willful, wanton, negligent or dishonest act by said licensee or agent or employee of said licensee. SECTION X. SUSPENSION OR REVOCATION OF LICENSE The County Commissioners shall have the power to suspend or revoke any license granted under this Ordinance for violation of any federal or state statute, city of county ordinances, or any of the provisions of this ordinance, or for any act committed by the licensee which is detrimental to the health, welfare and safety of the public. It shall be considered a violation of a federal or state statute or city or county ordinance if charges are filed in any court and if the licensee is acquitted of said charge or charges, he shall be reinstated as a licensee under -6- cc* 902 1824106 ('7 this ordinance upon application to the Weld County Sheriff. For the purposes of this section, the Security Patrol Agency licensee shall be deemed responsible for compliance with this ordinance by any individual licensee in the employment of said agency. SECTION XI. RULES AND REGULATIONS PROMULGATED BY THE BOARD OF COUNTY COMMISSIONERS The Board of County Commissioners may promulgate from time to time rules and regulations to provide for the health, safety and welfare of the County of Weld in relation to the security patrol agency. Such rules may pertain by way of example to the duties of the licensees, manner of conduct and reports to be furnished to the Board of County Commissioners. SECTION XII. SEVERABILITY If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions. The Board of County Com- missioners hereby declares that it would have passed this ordinance and each and every section, subsection, paragraph, sentence, clause and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sen- tences, clauses, or phrases might be declared to be unconsti- tutional or invalid. SECTION XIII.
