RESOLUTION RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 55 :80 :3 FOR MICHAEL COUFAL' FOR A SINGLE FAMILY DWELLING AND SMALL FARM OPERATION ON A TRACT OF LAND LOCATED IN PART OF SECTION 15, TOWNSHIP 1 NORTH, RANGE 68 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Held County, Colorado, and I WHEREAS, the Board of::County Commissioners of Weld County, Colorado held a public meeting on the 9th day of April, 1980 at I I the hour of 9 : 00 o'clock a.m. to consider the application of Michael Coufal for a Conditional Use Permit for a single family i dwelling and small farm operation on the following described real estate, to-wit: The North one-half of the North one-half of the Southwest Quarter of Section 15, township 1 North, Range 68 West of. the Sixth Principal Meridian, Weld County, State of Colorado. Excluding the West • thirty feet thereof. I Said tract contains 40. 3 acres more or less. WHEREAS, the petitioner was present, and I WHEREAS, evidence was presented in support of the granting of the Conditional Use Permit for a single family dwelling and I small farm operation, and WHEREAS, Section 3. 3 .D. of the Weld County Zoning Resolution authorizes such a use in an Agricultural District upon approval of a Conditional Use Permit by the Board of County Commissioners , l and I WHEREAS, the Board of County Commissioners of Weld County, I Colorado heard all of the testimony and statements of those pre- sent, has studied the request of: the petitioner and the recommenda- tions of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, id satisfied that the request for a Conditional Use Permit for single family dwelling and small farm operation on I i I /Jta z a-t 800844 ..1-rU1 pO/7 , the hereina ove described real estate complies with all of the conditions s set forth in Section 3 . 3 .D. (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of WeldtCounty, Colorado that the application of Michael Coufal for a Conditional Use Permit for a single family dwelling and small farm operation on the hereinabove described tract of laid be, and hereby is, granted subject to the following: 1. The Development Standards contained in the Conditional Use Permit 2 . No building or electrical permits shall be issued on the Conditional Use Permit area until the Development. Standards for the Conditional Use Permit have been placed on the Conditional Use Permit plat and said plat has been delivered to the office of the Department of Planning Ser- vices. 3 . The applicant complying with the Weld County Geologic Hazard Regulations. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval contained in the Planning Commission recommendations dated April 1, 1980 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Conditional Use Permit by the Planning gommission and the Board of County Commissioners before such changes rom the plans and/or Development Standards shall be permitted. Any tap committed after April 1 , 1979 to a parcel of land which is in the. Boulder Creek drainage area shall be required to submit stock or water rights which have historically irrigated lands for which application is made. Such stock or water rights shall have derived their raw water source from Boulder Creek. Left Hand Water Supply Company shall have the right to not accept such water until after additional raw water storage has been procured by said Water Com- pany. 2. The Board of Directors of the Left Hand Water Supply Company shall have sole discretion to waive this requirements after they have procured storage facilities in the Boulder Creek drainage that will adequately supply water for a future filtration facility in the Boulder Creek drainage area. 3. Any tap committed after April 1 , 1979 to a parcel of land which is in the Boulder Creek drainage area shall be required to submit stock or water rights which have historically irrigated lands for which application is made. Such stock or water rights shall have derived their raw water source from Boulder Creek. Left Hand Water Supply rtCompaIy shall have the right to not accept such water until after additional raw water storage has been procured by said Water Com- pany. 2. The Board of Directors of the Left Hand Water Supply Company shall have sole discretion to waive this requirements after they have procured storage facilities in the Boulder Creek drainage that will adequately supply water for a future filtration facility in the BouldLr Creek drainage area. 3. This resolution is required because the current filtration capacity of the Left Hand Water Supply Company has been totally committed to otter domestic taps and the exchange potential of the current treatment facility has reached its maximum capacity. The Left Hand Water Supply Company is currently actively pursuing an agreement for such storage l facilities but makes no guarantees as to how soon these facili- ties may be adquired or additionIal treatment facility will be constructed.
