RE: APPROVAL OF PSYCHOLOGICAL AND/OR PSYCHIATRIC SERVICES AGREE-
MENT BETWEEN RICHARD DELANEY, PH.D. AND THE DEPARTMENT OF
SOCIAL SERVICES AND AUTHORIZATION FOR CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, an agreement between Richard Delaney, Ph.D. and
the Department of Social Services for psychological and/or
psychiatric services has been presented to the Board of County
Commissioners, and
WHEREAS, the term of said agreement is from July 1, 1983
to June 30, 1984, with an amount of $65. 00 per hour and not to
exceed $13, 520. 00, and
WHEREAS, after review, the Board deems it advisable to
approve said agreement, a copy of which is attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the agreement between
Richard Delaney, Ph.D. and the Department of Social Services for
psychological and/or psychiatric services be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be,
and hereby is, authorized to sign same.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 18th day of
July, A.D. , 1983, nunc pro tunc July 1, 1983.

PURCHASE OF SERVICE CONTRACT FOR PSYCHOLOGICAL OR PSYCHIATRIC SERVICES
THIS CONTRACT, made this 1st day of JULY , 19 83, between
the MELD County Department of Social Services , hereinafter referred to as
"County," and Richard Delaney. Ph.D.. Center for Therapeutic Learning, 1501 N. Clegeland,
hereinafter referred to as "Provider." Loveland, Colorado 80537
1 . This Contract shall be effective from July 1 . 1983 to June 30. 1984 ,
but shall automatically terminate with the removal of the child or the
expiration date of the facility license, whichever is earlier. This
contract is in lieu of and supersedes all prior purchase contracts between
the parties hereto relating to the services herein described.
2. The County agrees to purchase and Provider agrees to provide therapeutic
services as described below to the child/children JefferY liachsmuth, ester
Shumate. Richard Rivera. John Hall , Daniel Duran. Robert Nelsen, James Brinka+an,
Brandi Teter. Paul Horn and Gene Mott.
(Children may be added to or deleted from this list as they enter or leave
Therapeutic Foster Care)
3. The Provider holds a current valid state license and is in compliance with
the terms and conditions thereof.
SECTION I. Provider shall :
1 . Cooperate with a team of professionals in providing therapeutic foster
care.
2. Utilize therapeutic skills in controlling child's/children's behavior.
3. Support the caseworker's treatment and educational goals for the
child/children.
4. Cooperate in providing other services, as necessary, to meet the special
needs of the child/children.
SECTION II . County shall :
1 . Pay an amount not to exceed ti ; 420 q for services satisfactorily
performed hereunder. Paymentsf'ia '1 include:
A. Psychotherapy geared toward resolving personality defects in the child.
NOT TO EXCEED: $13,520
for all children involved. Rate of therapy: $65.00 per hour
2. Determine client eligibility for services p 26�00 per this co t+ra t.)
3. Assess and collect fees in accordance with the rules and regulations of
the Colorado Department of Social Services.
4. Pay Provider within 30 days of receipt of provider billing statement for
satisfactorily completed purchased services included in the billing
statement.
5. Monitor and provide supervision and consultation as needed or required to
assure satisfactory performance of the purchased services under this
contract.

1. Not charge any fees to clients for services provided under this contract
nor assign the obligations under this contract or enter into any sub-
contracts without the express written approval of the Director of the
County Department of Social Services or his appointed designee.
2. Comply with the requirements of the Civil Rights Act of 1904.
3. Safeguard the confidentiality of information regarding the child/children
and his parents in accordance with rules of the Colorado State Department
of Social Services.
4. Indemnify County, Colorado State Department of Social Services and the State
of Colorado against any liability and loss against all claims and actions
based upon or arising out of damage or injury, including death, to persons or
property caused or received in connection with the performance of this
Contract.
5. Keep such records as are necessary for review, inspection, or audit by Federal,
State Department, County, or other authorized personnel for a period of
five (5) years.
6. Adhere to applicable Federal, State, and local laws that have been or may
hereafter be established.
Section IV. General Provisions:
1. The parties to this contract intend that the he Govt emp

provider will be solely and entirely responsible for its acts and the acts
of its agents, employees, and servants during the performance of this Contract.
2. Payment pursuant to this Contract is in County, State of Colorado, or Federal
funds, whether in whole or in part, and is subject to and contingent upon
the continuing availability of County, State of Colorado, or Federal funds
for the purpose thereof.
3. Either party may terminate this Contract by giving thirty (30) days prior
written notice. The .County Department reserves the right to terminate this
Contract without prior notice in the event of an emergency affecting either
the child or the Provider, but the parties shall not be released from the
duty to perform their obligations up to the date of termination.
4 . In the- event this Contract is terminated, final payment to the Provider may
be withheld at the descretion of the County until final audit. Incorrent
payments to the Provider due to csissionfraud, or defalcation
equent pagents
shall be recovered from the Provider by deduction
