That the proposal is consistent with Chapter 22 of this Code and any other applicable code provision or ordinance in effect. 2. That the proposal is consistent with the intent of the district in which the use is located. 3. That the uses which would be permitted will be compatible with the existing surrounding land uses. 4. That the uses which would be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by Chapter 22 of this Code or Master Plans of affected municipalities. 5. That the application complies with Articles V and XI of this Chapter if the proposal is located within an Overlay Zoning District or a Special Flood Hazard Area identified by maps officially adopted by the County. 6. That if the use is proposed to be located in the A (Agricultural) Zone District, the applicant has demonstrated a diligent effort has been made to conserve prime farmland in the locational decision for the proposed use. 7. MEMORANDUM v Ras- TO: Board of County Commissioners �'� ��� DATE: January 26, 2026 FROM: Angela Snyder, Planning Services SUBJECT: Modification to BOCC Resolution USR25-0019 PAGE 4 REQUIRED REVISIONS Please remove Condition of Approval 1.B., on Page 4, of the resolution which currently reads: "An Improvements and Road Maintenance Agreement is required for upfront, off-site improvements with this project. Road maintenance includes, but is not limited to, dust control and damage repair to specified haul routes. The Agreement shall include provisions addressing engineering requirements, submission of collateral, and testing and approval of completed improvements. The required upfront off-site road improvements are:" And replace Condition of Approval 1.B., on Page 4 with the following language: "An Improvements and Road Maintenance Agreement is required for upfront off-site and triggered off-site improvements with this project. Road maintenance includes, but is not limited to, dust control and damage repair to specified haul routes. The Agreement shall include provisions addressing engineering requirements, submission of collateral, and testing and approval of completed improvements. The required upfront off-site road improvements are:" PAGE 5 REQUIRED REVISIONS Please remove Condition of Approval 1.B.2.a., on Page 5, of the resolution which currently reads: "County Road 50 southwestbound, left turn, deceleration lane, per Chapter 4 of the Weld County Engineering and Construction Criteria(WCECC) manual, at the County Road 50/County Road 380 intersection, meeting the pavement design requirements of Chapter 9 of the WCECC manual." Please add a Condition of Approval 1.B.3.a., on Page 5, with the following language: 3) Weld County triggered off-site road improvements: a. Construct a County Road 50 southwest bound, left turn deceleration lane, per Chapter 4 of the Weld County Engineering and Construction Criteria (WCECC) manual, at the County Road 50 / County Road 380 intersection, meeting the pavement design requirements of Chapter 9 of the WCECC manual if determined by Weld County such an improvement would be beneficial to the safety and operation of said intersection. Widening of County Road 50 within the limits of the turn lane will be required with the construction of the turn lane. Hello
