The proposal has been reviewed by Development Review on behalf of the Weld County Department of
Public Works and the Department of Planning and Zoning. Staff comments made during this phase of the
application process may not be all-inclusive, as other issues may arise during the remaining application
process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: Use by Special Review for Open Mining and Processing of Minerals (sand and gravel)
in the A(Agricultural)Zone District.
This project is north of US Highway 34 and is east of County Road 69.
Parcel number 096525100005.
Access is from County Road 69.
ACCESS
Development Review has reviewed the application materials related to access and determined the access
for this site will be an existing, permitted access(AP20-00191)at the northern end of the County-maintained
portion of County Road 69. The project site is located approximately one mile east of County Road 69 and
will be accessed via a series of existing private oil and gas roads.
Per Section 8-14-30.6.3., an Access Permit is required for changing the use or type of traffic of any existing
access location. Please refer to Chapter 8 of the Weld County Code for more information regarding access.
ROADS AND RIGHTS-OF-WAY
County Roads 50, 69, and 380 are paved roads and designated on the Weld County Functional
Classification Map (Code Ordinance 2017-01) as local roads, which require 60 feet of right-of-way. The
applicant shall delineate and label on the USR map the existing rights-of-way (along with the documents
creating the existing rights-of-way) and the physical locations of said roads. Pursuant to the definition of
setback in the Weld County Code, Section 23-1-90, required setbacks are measured from the right-of-way
lines. Be aware that physical roadways may not be centered in the rights-of-way. The foregoing roads are
maintained by Weld County.
Per Chapter 8, Article 13, Section 8-13-30.B, a Weld County Right-of-Way Use Permit is required for any
project that will be occupying, constructing, or excavating facilities within, and or encroaching upon, any
County rights-of-way or easement. Right-of-Way Use Permit instructions and application can be found at:
https://www.weld.gov/Government/Departments/Public-Works/Permits/Right-of-Way-Permits.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
Note: Please be aware that setbacks from unmaintained section line rights-of-way must also be observed.
TRAFFIC
Latest ADT on County Road 69 counted 339 vpd with 34%trucks. The 85th percentile speed on this portion
of County Road 69 is 53 mph.
The site is anticipated to be in operation for 24 hours daily. There are 14 employees anticipated to be on
site with up to 11 trucks arriving and then departing during each hour of operation.Therefore, approximately
28 passenger vehicle trips and 520 truck trips are expected to occur each day with approximately 36 trips
occurring during the morning and afternoon peak hours.
Table 1,from the applicant's traffic impact study(provided below)summarizes the estimated trip generation
for the proposed project.

No tracking control is required with this project.
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT WITH UPFRONT IMPROVEMENTS
Development Review is requesting an Improvements and Road Maintenance Agreement for dust control,
damage repairs to specified travel routes, and the upfront off-site road improvements detailed below:
CDOT Upfront Off-site Road Improvements:
• US 34 southeastbound left turn deceleration lane turning onto northbound County Road 69 (Full
length of 800' + Storage + 300'taper).
• US 34 southeastbound left turn acceleration lane turning from southbound County Road 69 (Full
length of 1,300' + 300' taper).
Weld County Upfront Off-site Road Improvements:
• County Road 50 southwestbound left turn deceleration lane per Chapter 4 of the WCECC manual
at the County Road 50/County Road 380 intersection meeting the pavement design requirements
of Chapter 9 of the WCECC manual.
• County Road 69 southbound left turn deceleration lane per Chapter 4 of the WCECC manual at
the County Road 69/US-34 intersection meeting the pavement design requirements of Chapter 9
of the WCECC manual.

DRAINAGE REQUIREMENTS
This area is within a Non-urbanizing Drainage Area. Non-urbanizing Drainage Areas typically require
detention of stormwater runoff from the 1-hour, 100-year storm event falling on the developed site and
release of the detained water at the historic runoff rate of the 1-hour, 10-year storm event falling on the
undeveloped site having a 2% impervious value.
In compliance with Section 8-11-45, of the Weld County Code, the applicant has submitted a Drainage
Narrative meeting the requirements for an exception to stormwater detention. The qualifying exception
(Exception 6) reads, "Gravel pits if the stormwater drains into the gravel pit. Releases from the site shall
comply with the Weld County Engineering and Construction Criteria, including dewatering. Topographical
information shall be provided."
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist on the
property.
GRADING PERMIT
If more than one(1)acre of land is to be disturbed for construction of non-gravel pit items such as structures,
parking lots, laydown yards, etc., a Weld County grading permit will be required prior to the start of
construction. Grading Permit applications are accepted after the planning process is complete (map
recorded). An Early Release Request Form may be entertained only after the applicant, Public Works and
Planning Department have reviewed the referral and surrounding property owner comments. The Early
Release Request may or may not be granted depending on referral comments and surrounding property
owner concerns. Contact Development Review for more information.
COLORADO CONSTRUCTION STORMWATER DISCHARGE PERMIT
A Colorado Stormwater Discharge Permit is required when disturbing more than one (1) acre of land.

CONDITIONS OF APPROVAL
A. An Improvements and Road Maintenance Agreement is required for upfront off-site improvements with
this project. Road maintenance includes, but is not limited to, dust control and damage repair to
specified haul routes. The Agreement shall include provisions addressing engineering requirements,
submission of collateral, and testing and approval of completed improvements. The required upfront
off-site road improvements are:
1. CDOT Upfront Off-site Improvements:
a. US 34 southeastbound left turn deceleration lane onto northbound County Road 69(Full length
of 800' + Storage + 300'taper). (Development Review)
b. US 34 southeastbound left turn acceleration lane onto northbound County Road 69 (Full length
of 1,300' + 300' taper). (Development Review)
2. Weld County Upfront Off-site Improvements:

C. The applicant shall submit a recorded copy of all access agreements signed by all owners of private
property whose property is crossed for access to the project site. The access agreement shall be for
ingress,egress,and utilities(if applicable)and shall be referenced on the USR map by the Weld County
Clerk and Recorder's reception number. (Development Review)
D. The USR map shall be amended to delineate the following:
1. County Roads 50, 69 and 380 are paved roads and are designated on the Weld County Functional
Classification Map as local roads which require 60 feet of right-of-way. The applicant shall

documents) and the physical location of the roads. All setbacks shall be measured from the edge

Prior to Construction:
If more than one (1) acre is to be disturbed for construction outside of the gravel mining area, a Weld
County grading permit will be required. (Development Review)
Prior to Operation:
Accepted construction drawings and construction of the upfront off-site roadway improvements are
required prior to operation. (Development Review)
DEVELOPMENT STANDARDS (NOTES ON THE USR MAP)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off-site tracking. (Development Review)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

4. Any work that may occupy and or encroach upon any County rights-of-way or easement shall acquire
an approved Right-of-Way Use Permit prior to commencement. (Development Review)
5. The Property Owner shall comply with all requirements provided in the executed Improvements
Agreement. (Development Review)
6. The Improvements Agreement for this site may be reviewed on an annual basis, including a site visit
and possible updates. (Development Review)
7. The historical flow patterns and runoff amounts will be maintained on the site in such a manner that it
will reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to runoff rate and velocity increases, diversions, concentration and/or unplanned
ponding of stormwater runoff. (Development Review)
8. Weld County is not responsible for the maintenance of onsite drainage related features. (Development

The Staff of the Weld County Oil and Gas Energy Department (OGED) appreciates the opportunity to
comment on the captioned planning case. Staff has completed review of the proposal and have no
conflicts with the proposed activity. We have included additional comments below:
1. There are no active or proposed 1041 WOGLA Permits on the associated parcel. There are
several oil and gas well sites in the area surrounding the parcel.
2. The parcel includes five (5) inactive oil and gas wells listed in Table 1. Additional information
regarding the active well is available from the Energy & Carbon Management Commission
(ECMC). OGED recommends that the Applicant review this information and contact the
responsible operator regarding well infrastructure that may have been abandoned in place
prior to conducting operations in proximity to the wells.

3.5 (4) For those access locations that have a high percentage of trucks using the access, it
may be required that each auxiliary lane be built to full length and width according to table 4-6
and the taper length shall extend beyond the full length.
3.8 (4)(e) A left turn acceleration lane may be required if it would be a benefit to the safety and
operation of the roadway or as determined by subsection 3.5.
4.8(4)(a) When necessary to redirect the traveled way or install a speed change lane, a paved
shoulder adjacent to the lane shall be provided where no curb and gutter is present
(c) Shoulders adjacent to a speed change lane shall be four feet in width.

CDOT has carefully re-reviewed your proposed haul route.
The proposed haul route suggests truck traffic will not capitalize upon the most direct highway
access (a paved route with higher posted speeds and no delays).
As a state agency, the Colorado Department of Transportation (CDOT) is mandated to ensure the
safety of all road users and the long-term integrity of the state's public infrastructure. Our decisions
regarding designated haul routes are based on a comprehensive set of factors, including:

• Engineering and Safety Data: Our route planning is guided by decades of data on
vehicle types, traffic patterns, and the capacity of our roadways. Highways are engineered
to handle the size, weight, and volume of commercial truck traffic, minimizing impacts on
residential and local collector roads.
o Our decisions are guided by principles outlined in the Colorado Freight Plan and
are supported by our ongoing traffic and safety data analysis.
o Our Roadway Design Guide and Asset Management Plans demonstrate that non-
designated routes lack the structural capacity to sustain a consistent volume of
heavy commercial traffic without significant and costly degradation.
• Public Safety: Designating routes for heavy commercial vehicles is a critical measure for
separating them from pedestrian, cyclist, and passenger vehicle traffic. This is particularly
vital in areas with higher population density or where roads are not built to the standards
required for commercial freight.
• Infrastructure Preservation: Public roads, bridges, and culverts are designed to specific
load limits. By concentrating heavy truck traffic on designated, purpose-built routes, we are
able to preserve the lifespan of our broader road network and reduce the burden of
maintenance and repair on the public.
We must respectfully state that CDOT will not authorize any haul route that is fundamentally at
odds with decades of established traffic data and the engineering principles that govern our state's
transportation network, leading to public safety risks and infrastructure degradation.
Our process for designating and approving haul routes is designed to provide a predictable and safe
framework for all users.

The TIS is stamped on page 16 by the traffic engineer.
Addressing your comments on the haul route, 70 Ranch, LLC (the permittee)is the owner of the private road that
Bruce mentions below. Bonanza Creek holds leases on the land,the 20 mph speed limit is dictated by 70 Ranch,
LLC.
70 Ranch is a large property(see attached map showing property and private roads)and the permittee is
requiring that the drivers split the accesses to minimize traffic on their private roads as well as any conflicts with
oil and gas traffic at the private bridge over the canal. Both accesses onto county roads (CR 388 and CR 69) are
gated and locked which will require drivers to exit their vehicle.Access to the locked gates will be provided by
the permittee to direct which gate the driver is able to use.

A CDOT access permit is required.
CDOT Permit Applications. Applications must now be submitted through the CDOT online portal.
Stamped Study. Per new statewide traffic assessment guidelines, a traffic study must be stamped and
signed in order to be reviewed and comments provided.This is not stamped. CDOT will not review an
unstamped version.
Haul Route.
I will offer one high level comment.
• Any haul route that is not the most direct, expedient route to a highway access is concerned by
CDOT to be self governance.
• Self-Governance/Regulation. It has been CDOT's experience that self-regulation of traffic
volume is not a reliable method of traffic control, as it conflicts with truck driver and business
profitability. Self-governance/regulation should not be factored into TIS details.
Our CDOT Inspector, Bruce Barnet, did a site visit and found a large metal gate at near the end of
380 with a a sign on the gate that states "KEEP THIS GATE CLOSED AT ALL TIMES", behind it a

very large "Bonanza Creek" sign "YOU WILL OBEY THESE RULES" sign, A 70 Ranch sign with
additional rules, a posted speed limit sign of 20 mph.
CDOT believes the most expedient route that truck drivers will default to is CR 69 and US-34, a
paved county road to an easily accessible four lane highway access with a posted speed of 65
mph.
This, versus the proposed two lane road (380 to CR 61) with a majority of 380 (3.23 miles) being an
unpaved private road, with a posted speed limit of 20 mph and a gate that must remain closed at all
times..
The truck travelling directly south on CR 69 to US-34 will arrive at CR 61 & US 34 minutes sooner,
without including the additional time required to open and close the gate.
A revised study is required and should reflect all traffic traveling straight soth on CR 69 to US-34.

A CDOT access permit is required.
Permit Application Applications must be submitted through the CDOT online portal. CDOT can no
longer accept the PDF applications.
• A State Highway Access Permit application must be completed and submitted to CDOT by the
property owner. Prior to Town/City/County final approvals.
• CDOT requests the town/city/county make CDOT Access permits a Condition of
Approval (COA) and highway improvement completion a condition of commencement of
Operations (CO)

• The highway access permit application is available online
at https://socgov.my.site.com/accesspermits/s/login/
• The "Permittee" is the property owner.
• If the property owner is a legal entity, CDOT will also require a statement of authority.
• It may take 2 weeks for CDOT to process the application, from receipt of all required
documents.
• The permit will be sent by CDOT to the Permittee for signature via DocuSign.
a The DocuSign email will also provide a PayPal link for convenient payment of the
associated fee.
Proposed Haul Route
The proposed haul route suggests truck traffic will not capitalize upon the most direct highway access
(a paved route with higher posted speeds and no delays).
As a state agency, the Colorado Department of Transportation (CDOT) is mandated to ensure the
safety of all road users and the long-term integrity of the state's public infrastructure. Our decisions
regarding designated haul routes are based on a comprehensive set of factors, including:
• Engineering and Safety Data: Our route planning is guided by decades of data on vehicle
types, traffic patterns, and the capacity of our roadways. Highways are engineered to handle
the size, weight, and volume of commercial truck traffic, minimizing impacts on residential
and local collector roads.
oOur decisions are guided by principles outlined in the Colorado Freight Plan and are
supported by our ongoing traffic and safety data analysis.
oOur Roadway Design Guide and Asset Management Plans demonstrate that non-
designated routes lack the structural capacity to sustain a consistent volume of heavy
commercial traffic without significant and costly degradation.
• Public Safety: Designating routes for heavy commercial vehicles is a critical measure for
separating them from pedestrian, cyclist, and passenger vehicle traffic. This is particularly
vital in areas with higher population density or where roads are not built to the standards
required for commercial freight.
• Infrastructure Preservation: Public roads, bridges, and culverts are designed to specific load
limits. By concentrating heavy truck traffic on designated, purpose-built routes, we are able
to preserve the lifespan of our broader road network and reduce the burden of maintenance
and repair on the public.
We must respectfully state that CDOT will not authorize any haul route that is fundamentally at odds
with decades of established traffic data and the engineering principles that govern our state's
transportation network, leading to public safety risks and infrastructure degradation.
