PROJECT BACKGROUND AND OVERVIEW: The applicant is requesting an expansion of an existing sand and gravel mining operation. The operation currently includes an asphalt and concrete batch plant and recycling plant as accessory uses. The site will be mined in 7 phases over a fifteen-year period. Reclamation of the expanded site will occur as mining takes place and consists of irrigated farmland, a 32.7 acre pond with wetland benches, and a number of smaller ponds including some designed for a fish farm operation. The proposed expansion is partially within the City of Greeley's Long Range Expected Growth Area (LREGA). The LREGA is the area that is anticipated for growth in the next twenty years. The LREGA bisects the midpoint of the site on the "O" Street (WCR 64;1 alignment. The site is approximately one-quarter mile from the nearest City of Greeley municipal boundaries. The Poudre River Ranch development is the closest project to the site. This development is south of the Cache la Poudre River and east of 83rd Avenue. The final phases of this mixed residential and light commercial development are in the planning process. SITE DATA: Expansion Site Size 167 acres Proposed Land Use Sand and Gravel Mining Surrounding Zoning: North - Weld County Agriculture South - Weld County Agriculture East - Weld County Agriculture West - Weld County Agriculture Surrounding Land Uses: North - Pasture and Cultivated Fields South - Cache la Poudre River, Sand and Gravel Operation East - Pasture, Cultivated Fields, Future Sand and Gravel Operation West - Pasture and Cultivated Fields KEY ISSUES AND ANALYSIS: Does the request comply with the City of Greeley Comprehensive Plan? The Comprehensive Plan identifies sand and gravel deposits as an important mineral resource that is a basic component in roadway and building construction. The following Comprehensive Plan policies apply to this request. Comprehensive Plan Policy 5.3 [The City should]insure that proposed land use developments do not permanently preclude the extraction of commercial sand and gravel deposits on a case by care basis until such time that a detailed mineral extraction plan is adopted. Staff Comment: The requested amendment to the permit provides for the expanded extraction of additional commercial deposits. The request complies with this policy. Comprehensive Plan Policy 5.4 [The City should] insure that sand and gravel operations sites are reclaimed in a manner that enhances both the natural environment and anticipated future land uses. Staff Comment: Reclamation of the expanded site will consist of irrigated farmland, a 32.7 acre pond with wetland benches, and a number of smaller ponds including some Planning Comm. Summary 2 WCR Firestien Pit designed for a fish farm operation. The reclamation plan, except for the fish farm operation, is typical for sand and gravel operations. Similar reclaimed sand and gravel operations are commonly used for residential development, recreation and farming. The request has been referred to the Colorado Division of Wildlife (DOW). The reclamation and fish farm operation, as a condition of approval, should comply with the DOW comments and recommendations. If the DOW recommendations are followed, the request can enhance both the natural environment and anticipated future land uses. ADMINISTRATIVE REVIEW TEAM: The Administrative Review Team informally reviewed this item on August 14, 2000. The only comment was concerning the reservation of right-of-way for the future expansion of 83r° Avenue. The requested expansion is not adjacent to this road. RECOMMENDATION: Planning Staff recommends that the Planning Commission find that the requested amendment to a USR is partially located in the City of Greeley's Long Range Expected Growth Area (LREGA), and that the request is consistent with the City of Greeley Comprehensive Plan policies: 5.3 - The requested amendment to the permit provides for the expanded extraction of additional commercial sand and gravel deposits; 5.4 - The natural environment and anticipated future land uses are enhanced by the proposed amendment to the USR; And recommend approval of the request to the Weld County Planning Commission with the following condition; • Reclamation of the site and the future fish farm operation shall comply with the recommendations of the Colorado Division of Wildlife. This project falls under the purview of the Use by Special Review Standards (open pit mining). Our comments and requirements are as follows: COMMENTS: Access: The applicant is proposing to use the existing accesses on to WCR 27 (83rd Avenue). This sccess t as been improved with acceleration and deceleration to accommodate heavy truck traffic. Circulation and Parking: There is adequate employee and truck parking. Improvements Agreement: The applicant has an existing Road Improvements Agreemert with the Wald Cou! ity Public Works that indicates a designated haul route. REQUIREMENTS: \NCR 27 (83rd Avenue) is designated on the Weld County Transportation Plan Map as an arterial status read requiring a 100-foot right-of-way at full build out. The applicant needs to reserve an additional 20-foot right-of-way adjacent to WCR 27. \NCR 64.5 is designated on the Weld County Transportation Plan May as a collector status road, which requil es an 80-foot right-of-way at full build out. The applicant shall reserve an additional 10-foot right-of-way adjacent to \NCR 64.5. No additional access shall be granted to WCR 64.5 from the facility. The Weld County Public Works Department is working on the reconfiguration of the curve on 83rd Avenue (Wr;R 27)at WCR 64.5. This curve section will be realigned adjacent to your parcel mining cell No. 3. It appears in your reclamation plan for Pond "H" that the realigned roadway will miss the pond. The fuel tank was identified but not shown or described on the site plans submitted through Weld County for review. In previous discussions on the location of an asphalt batch plant the Fire District requested the installation of a fire hydrant on site to provide adequate means of protecting the facility. The response of your company was to hold off on the asphalt plant. At that time there was no discussion about the fuel tank. The installation of the fuel tank will be approved with the following conditions: 1) As stated by the State Oil Inspection it must comply with NFPA 30 and 30A. It shall not be filled until inspections by the Fire District and the State have been completed. Any conditions not meeting the codes shall be corrected prior to use. 2) No other tanks shall be placed within the concrete containment. The site at WCR 13 south of Hwy 392 in Windsor was reviewed, within that containment an unleaded tank was installed. Materials, drums, buckets or other materials shall not be stored in the containment. The temporary tank located on the site should be removed. 3) A security fence was not indicated on the drawing for the WCR 27 site. The WCR 13 site does not have a security fence for the fuel tanks. Fencing is required for fuel tanks and propane tanks. The operation of fuel islands must be secured when personnel are not at the site. 4) Fire extinguishers meeting a 20BC rating must be located near fuel tanks, propane tanks, and fuel islands. Extinguishers must be mounted in accordance with NFPA 10. 5) Tanks must be properly labeled. 6) Personnel at the site must be trained in the use of fire extinguishers on an annual basis in accordance with OSHA requirements. You may contact this office to schedule fire extinguisher training As stated above the Fire District is interested in establishing a reliable source of water in the area of the plant for fire fighting purposes. At the present time the closest fire hydrant is located approximately 3.8 miles from your site. With this distance and the time to fill the Fire Department Tanker we can not maintain adequate water flows to sustain an attack on a fire. With the water supply available to us, we will be confined to a defensive mode of fire fighting and concentrating on the protection of life. By providing a fire hydrant at your site, or even assisting in the installation of the hydrant at WCR 27 and WCR 66 you would be assisting us in protecting your site. You have the means to improve fire fighting capability to protect your site and your neighbors. We are aware that installing a fire hydrant is an expense. There are however, offsets to any expense. The fire rating for that area of the Fire District is a Class 9. The primary reason for the classification is due to the lack of available water supplies. The Fire District is trying to improve water supplies which will eventually lower the fire rating and decrease the cost of fire insurance. The subject property is located outside the Town's Growth Management Area, but within the Community Influence Area. The subject property is depicted partially as Community Separator and partially as Parks, Open Space & Floodplains on the Town's Land Use Plan map. The Windsor Comprehensive Plan states that the Community Separator land use depiction provides for areas of open space and open lands which generally have little or no development, with the exception of agricultural activities, while the Open Space depiction provides for lands that are open and generally free from development. Since the mining operation is not the ultimate end-use of the property and does not propose development at this time, the proposed gravel mining use is consistent with the Town's Land Use Plan map. The application materials indicate that the expansion area will allow the mining of additional land area, however, it will not increase truck traffic or hours of operation. Additionally, although the application materials indicate that all trucks will continue to exit the property on Weld County County Road 27 and that the majority of truck traffic will proceed north, it was confirmed with Ms. Danna Ortiz, the applicant's representative, that the majority of the truck traffic will continue to proceed south towards the City of Greeley. Therefore, the Town of Windsor Planning Commission recommends approval of this amended Use by Special Review permit. Thank you for the opportunity to review this proposal. Therefore the Division's resources are stretched thin. I reviewed the mining and reclamation plans for the Hall-Irwin property. From years of District patrol along the Poudre River, I am familiar with the properties in question. You asked whether it would be necessary to conduct a search for Preble's meadow jumping mouse and Ute Ladies Tresses Orchid on this site prior to onset of development. This parcel is located in an area designated by the U S Fish and Wildlife Service as a potential Preble's mouse area. However, because the portions of the property that will be mined and developed are irrigated agricultural fields tilled annually, the site is not considered suitable for Preble's mice. For the same reason the parcel is not suitable habitat for Ute Ladies Tresses Orchid. Consequently, unless portions of the property that are untilled pasture land will be developed, there is no need to conduct Preble's or orchid search as part of the development plan. The Division would suggest a 100 yard non development setback from the center of the river be maintained, post mining, to provide an adequate movement corridor for wildlife and potential site for Prebles mouse habitat. In previous meetings with Brett Hall, the Division suggested that pond reclamation plans shoul.d include irregular shoreline contours, irregular pond bottoms, and varying shoreline slope. The reclamation plan you sent indicates that pond H will be reclaimed in such a fashion. We woulc encourage the developer to reclaim the rest of the ponds in a similar manner. When Hall Irwin begins reclaiming the wetland portions of this development, the division would be eager to assist in working together to develop the best possible wetland for wildlife. The reclamation plan indicates that an aqu-culture facility will be created on a portion of the site after mining is completed. The fish farm will need to be inspected and licensed. by the Division of Wildlife before it goes into production. Thank you for the opportunity to comment on this proposal.
