RE: GRANT REQUEST FROM LAMBLAND, INC., DBAA-1 ORGANICS, C/O ROBERT
YOST TO PRE-ADVERTISE USE BY SPECIAL REVIEW PERMIT#1285
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has received a request from Lambland, Inc., dba A-1 Organics,
do Robert Yost, 16350 Weld County Road 76, Eaton, Colorado 80615, for pre-advertisement of
an application for a Site Specific Development Plan and Use by Special Review Permit#1285
for a Solid Waste Disposal Site and Composting Facility, and
WHEREAS, said property is described as part of Section 36, Township 3 North,
Range 64 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, after study and review the Board deems it advisable to grant said request,
with the hearing date to be set as November 1, 2000, at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request from Lambland, Inc., dba A-1 Organics, do Robert
Yost for pre-advertisement of an application for a Site Specific Development Plan and Use by
Special Review Permit#1285 for a Solid Waste Disposal Site and Composting Facility be, and
hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said
request be, and hereby is, set as November 1, 2000, at 10:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of October, A.D., 2000.

COLORADO SUBJECT: Request for Preadvertisement
Lambland, Inc., dba A-1 Organics, do Robert Yost, has submitted a request that the application
for Use by Special Review Permit #1285, which will be heard by the Planning Commission on
October 17, 2000, be preadvertised. If you wish to approve this request, a hearing before the
Board on November 1, 2000, will allow adequate time for advertising.

The Department of Planning Services' is requesting a pre-advertisement for the above referenced
case, at the request of the applicant. Attached to this memo is a letter from Bob Yost,
representative, requesting this case be heard by November 15, 2000,for reasons stated in his letter.
The case is scheduled before the Weld County Planning Commission on October 17, 2000. The
Department of Planning Services'staff recommends approval of the pre-advertisement of this case.

Dear Ms Chester,
Al Organics would like to request that the department pre-advertise our application for a USR
arid CD for the Rattler Ridge Organic Recycling facility.
We have enclosed a $35.00 check to cover the fee per your instructions.
It is our hope that the permit for the facility can be completed and approved by mid November i f
at all possible. Of course we realize that the timing will depend on how the referrals come in and
any need for additional information you may have. I will do my best to respond as quickly as
possible to any request you may have.

Subject: Keenesburg Rattler Ridge, Pilot Composting Project
Dear Mr. Yost:
The Weld County Departments of Planning Services and Public Health and Environment have
reviewed your September 12, 2000 letter. Your letter requests County approval to expand your
existing "composting pilot study," also known as the Rattler Ridge Composting site, from an area
of 5 acres to 15 acres.
As you are aware., in a letter dated October 8, 1999,the County agreed not to pursue the
operation of the "composting pilot study"as a violation of the Weld County Zoning Ordinance or
the Solid Waste Disposal Sites and Facilities Act(§ 30-20-100.5, CRS, as amended), so long as
the facility complied with the terms and conditions described in that letter. Your company has
applied for a Use by Special Review(USR) and Certificate of Designation (CD)to operate the
facility on a permanent basis. The USR and CD case is scheduled for consideration by the Weld
County Planning Commission on Tuesday, October 17, 2000, and presumably will be considered
by the Board of County Commissioners shortly thereafter.
Based upon staff observations, the "composting pilot study" has complied thus far with all of the
terms and conditions of the October 8, 1999 letter. Therefore, the County will not pursue the
operation of this site as a violation of these laws, including your expansion of the "composting
pilot study" from 5 acres to 15 acres. Be advised, however, that this assurance will only be for
the time to and until the date when the Board of County Commissioners either approves or denies
the USR and CD, or until three months after the date of this letter, whichever is later.
The operation of the "composting pilot study"must continue to comply with all of the terms and
conditions of our October 8, 1999 letter. Also, please be advised that allowance of the expansion
in no way should be construed as approval for a permanent facility.
