Subject: Request for approval of a Minor Resubdivision, Case Number S-518 - vacation of
Block 1, Lots 2, 3, 4, 5, 6, and 7 of the Peterson-Alexander Subdivision including the
southern portion of 70th Avenue Court, being part of Section 16, Township 5 North,
Range 66 West of the 6th P.M., Weld County, Colorado
Dear Commissioners:
The attached application and submitted materials are concerning a request made by the Reverend
Danny Perdew of Faith Tabernacle Church. The request is to vacate Block 1, Lots 2, 3, 4, 5, 6, and
7 of the Peterson-Alexander Subdivision including the southern portion of 70th Avenue Court, Weld
County. This request is a Condition of Approval for USR 1217 (Item "m"). The property is located
east of and adjacent to WCR 29 (71st Avenue) and north of and adjacent to US Highway 34
Bypass Frontage Road (28th Street) right-of-way.
Based upon the submitted application materials and other relevant information regarding this
request, the Department of Planning Services' staff recommends approval of this request.
This determination was based on the following:
• The submitted materials are in compliance with Section 8.2.5 of the Weld County
Subdivision Ordinance.
• The platted lots have not been used for its intended purpose since the recording of the
approved plat.
• Seventy(70)percent of the landowners adjacent to the proposed subdivision have waived
2000-1917 ILL/3-zS
any objection to the vacation by signing a petition. There are two adjacent property owners,
one that signed, and one that did not sign on the advice of legal counsel.
• The vacation would be compatible with the surrounding area and uses, be consistent with
efficient and orderly development, is consistent with the Weld County Comprehensive Plan,
and would not deprive any parcel of adequate access to a public road or street right-of-way.
Conditions of Approval:
A. The applicant shall submit in writing as part of this application a request that Lots
2, 3, 4, 5, 6, and 7, Block 1 be vacated (combined into a single lot).
B. The applicant shall record the deed at the Clerk and Recorder's Office and provide
a copy of the recorded deed to the Department of Planning Services.
C. The City of Greeley has identified WCR 29 (71st Avenue)as a minor arterial and has
annexed within one-half mile of this location. The typical cross section reflecting the
minor arterial requires 90 feet of right-of-way between intersections and 120 feet at
the intersection. There is presently 60 feet of right-of-way. A total of 45 feet from
the centerline of Weld County Road 29 (71st Avenue) right-of-way reservation for
future expansion of Weld County Road 29 (71st Avenue) shall be delineated on the
plat.
D. The applicant shall contact the Milliken Fire Protection District to obtain, in writing,
that the proposed fire hydrant number(s) and location(s) is sufficient to adequately
address service to this parcel. Evidence shall be submitted to the Department of
Planning Services'.
E. The applicant shall delineate an utility easement that meets the requirements of
Section 10.6 of the Weld County Subdivision Ordinance, as amended. This
easement shall be located south of the north property line, immediately adjacent to
Lot 1 and Lot 2 of the Peterson-Alexander Subdivision.
F. The Minor Resubdivision map shall be recorded in the Office of the Weld County
Clerk and Recorder. The map shall be prepared in accordance with the
requirements of Section 8.2.5.6 of the Weld County Subdivision Ordinance, as
amended.

Subject: Modification to USR 1217 Site Plan
Dear Mrs Perdew:
The Department of Planning Services' wishes thank you for visiting our office on Friday August 4,
2000 to review your Site Plan for Use by Special Review (USR 1217). During the course of the
meeting, you stated your desire to modify the entry parking area immediately south of the
sanctuary entry. Your proposal consisted of the removal of four (4) parking stalls, including one
handicapped stall and replacing this parking area with a landscaped planter that may include a
water feature. Further, you stated that there is additional parking available on-site to meet the
requirements set forth in Section 41 of the Weld County Zoning Ordinance.
The Department of Planning Services' reviewed your request for this modification of USR 1217 and
have determined that this does not constitute a substantial change to your original submittal.
Therefore, our office will grant you this modification to the site plan. With this modification, a new
planting area is created, thus the Department of Planning Services requests a revised Landscape
Plan for Phase 1, of the Church property. Please submit this drawing and related information to
this office for review and approval.
On another subject, the Clerk to the Board failed to provide notice to surrounding property owners
for approval of a Minor Resubdivision, Case Number S-518 - vacation of Block 1, Lots 2, 3, 4, 5,
6, and 7 of the Peterson-Alexander Subdivision including the southern portion of 70th Avenue
Court, being part of Section 16, Township 5 North, Range 66 West of the 6th P.M., Weld County,
Colorado. Due to this circumstance, the case that was to be heard by the Board on Wednesday
August 9th at ten o'clock in the morning will be continued until proper notification may be provided
by the Clerk to the Board's office.

SUBJECT: Update from Dean Prather, Milliken Fire Protection Dist.
Ogle spoke with Prather regarding Faith Tabernacle Church and the existing conditions on site
specifically pertaining to meeting the requirements of the Milliken Fire Protection District.
Prather acknowledged he has been on vacation for the past week, however, the on-site conditions
as has been documented are:
Hydrants have been installed, however, fire flow has not been check by the Fire
District.
Area Alarm System is not fully functional, and not completely installed. Further,
system has not been tested by the Fire District.
The kitchen hood has been installed, however the fire suppression system has not
been checked by the Fire District.

The Department of Planning Services'staff will make a recommendation concerning this application

Alexander Peterson Subdivision; Part of Section 18, Township 5 North, Range 66 West of the
6th P.M., Weld County, Colorado.
Dear Mr. Perdew:
Your application and related materials for the request described above are complete and in order at the
present time. In addition, I have scheduled a meeting with the Weld County Utilities Advisory Committee
for Thursday, January 13, 2000, at 10:00 a.m. This meeting will take place in the Weld County Planning
Department, Room 210, 1555 N. 17th Avenue, Greeley, Colorado.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within
three miles of the property in question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the
submitted materials to the Greeley Planning Commission for its review and comments. Please call the
