HomeMy WebLinkAbout20001745.tiff tl ;3 1111111111111111111 III 11111111111111111 III 11111 IIII ���� 2786423 08/10/2000 02:32P JA Suki Tsukamoto 1 of 3 R 15.00 D 0.00 Weld County CO RESOLUTION RE: APPROVE CORRECTION TO PLANNED UNIT DEVELOPMENT PLAT, S #536 - IS SKYWAY, LLC; HORIZON INVESTMENTS, LLC; SKYWAY DRIVE, LLC; AIM PROCESSING/TENBAR, INC.; AND JOHN AND ALISON PETERSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 24th day of July, 2000, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of TS Skyway, LLC; Horizon Investments, LLC; Skyway Drive, LLC; Aim Processing/Tenbar, Inc.; and John and Alison Peterson for a correction to the Planned Uni: Development Plat for the First Filing, Vista Commercial Center Planned Unit Development Final Plan, S #536, on the following described real estate, to-wit: Part of the NW1/4 of Section 8, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, Section 28.15.4 of the Weld County Zoning Ordinance describes the procedure for correcting a Planned Unit Development Plat, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations 01 the Weld County Planning Department and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The request is in conformance with Section 28.15.4 of the Weld County Zoning Ordinance, because it involves a technical correction of ownership of Lots 2, 3, 4, 5, 8, and 11, and Outlot J, Block 3, Vista Commercial Center, and eliminates an easement between Lots 2 and 3. 2. In accordance with the requirements of Section 28.15.4 of the Weld County Zoning Ordinance, the requested correction is consistent the approved Planned Unit Development Zone District, in that: a. Section 28.14.1.6.1 - The proposal is consistent with the Weld County Comprehensive Plan. Specifically, PUD.Policy 4.1 states, "The design of a planned unit development should ensure compatibility and harmony with existing and planned uses on adjacent properties and within the planned unit development." This request will create non-buildable outlots that will help mitigate negative impacts from the underlying property that was used as a landfill by the City of Longmont. b. SKYWAY DRIVE, LLC; AIM PROCESSING/TENBAR, INC.; AND JOHN AND ALISON PETERSON PAGE 2 located. This Planned Unit Development was originally approved by the Board of County Commissioners in 1997. The Planned Unit Development Zone District allows for industrial and commercial uses as permitted in the I-1 (Industrial) and C-3 (Commercial) Zone Districts. This request is consistent with the intent of the original Planned Unit Development. c. Section 28.14.1.6.3 - The uses, buildings, and structures which will be permitted will be compatible with the existing or future development of the surrounding area as permitted by the existing zoning, and with the future development as projected by the Comprehensive Plan and any other applicable Weld County Ordinance in effect, or Master Plans of affected municipalities. This request has been submitted with the cooperation of the City of Longmont, the operators of the adjacent landfill. In a referral response, dated July 18, 2000, the City of Longmont has indicated no conflicts exist with its interests. d. Section 28.14.1.6.4 - This requested correction will have little, if any, affect upon the Performance Standards as outlined in Section 35.3 of the Weld County Zoning Ordinance. e. Section 28.14.1.6.5 - The application complies with the Weld County Zoning Ordinance, Section 50, Overlay District Regulations if the proposal is located within the Overlay District Areas identified by maps officially adopted by Weld County. NOW, THEREFORE, BE IT RESOLVED by the E3oard of County Commissioners of Weld County, Colorado, that the application for a correction to PUD Plat for the First Filing Vista Commercial Center PUD Final Plan, S #536, on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to recording the plat: A. Outlots "S" and "R" shall be designated as non-buildable on the plat. B. The plat shall indicate easements are fifteen (15) feet in width. C. The plat shall clarify that a fifteen (15) foot drainage and utility easement exists in Outlot "R." D. A line servicing the oil and gas well on Outlot "J" runs through the existing utility and drainage easement now part of Outlot"S." All reference to a drainage easement on the south side of Lots 2, 3. 4, and 5 shall be removed from the plat. F. The plat shall be changed to include a continuous fifteen (15) foot utility easement along the south lot line of Lots 2, 3, 4, 5, 8, and 11, and Outlot "J," as approved by the Weld County Utility Board on July 13, 2000. G. The plat shall show the utility easement along the north side of Lot 3 (between Lots 2 and 3) has been vacated. H. The plat shall be amended to include the following note: 1) Landfill gas conditions may be encountered in excavations within utility easements. Care should be taken when installing utilities in the southern easements. If possible utilities should access from the easement adjacent to Skyway Drive. If utilities are installed in southern easements, a worker protection plan should be developed to address the hazards encountered while excavating in gaseous soils. Effective December 1, 1999, Building Permits issued on the lots will be required to adhere to the fee structure of the Southwest Weld Road Impact Program area 1. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services's staff recommendation for approval is conditional upon the following: 1. Prior to recording the plat: A. Outlots "S" and "R" shall be designated as non buildable on the plat. B. The plat shall indicate easements are fifteen (15) feet in width. C. The plat shall clarify that an easement exists in Outlot "R". D. A utility line servicing the oil and gas well on Outlot "J" runs through the existing easement along the south property line of lots 11, 8 and Outlot"J". The plat shall be amended to indicate this easement is only for the existing line, no other utilities shall be located in this easement. E. All reference to a drainage easement on the south side of the lots shall be removed from the plat. Kris Pickett, of Kris Pickett Engineering Company, has indicated drainage is not necessary in this location. Mr. Pickett shall submit written approval, with the appropriate engineers stamp, of this change to the submitted drainage report. F. The plat shall he amended to include a continuous fifteen foot utility easement along the south lot line of the newly amended lots, as approved by the Weld County Utility Page 3 Board on July 13, 2000. This process is defined in Section 8 of the Subdivision Ordinance. There is latitude in the ordinance to administratively correct a plat when the purpose of the correction is to eliminate a technical error. Unfortunately, adding easements is not considered a technical error. As a matter of fact, the Ordinance eliminates the possibility of interpreting an easement change as a technical error by defining this activity as one of the reasons for the re-subdivision process. I have attached a copy of Section 8 for your convenience. Please note, that when submitting for an easement change, drainage plans & complete engineering is also required. En en though they had a monitoring system in place there was a migration of Methane gas onto the affected property. During the course of the investigation that Horizon Investments had carried out by Western Environmental Engineering it was also discovered that trash had been buried out side of the boundary of the landfill. After several months of investigation and discussion with the City of Longmont it was decided that the best solution was for the City to own any land with contamination. This will accomplish three goals: L The City will own all of the area in question. 2. It will allow them,the City, to not only monitor but also to take whatever corrections are necessar, on property owned entirely by them. 3. This,in addition.will give the owners of all property involved clean uncontaminated property to sCll. build on or what ever,without concern of possible contamination of their lots. The amended plat was received July 13, 2000, and is titled "First Replat of Lots 2, 3, 4, 5, 8, 11 and outlot "J" Block 3 of the Corrected Plat of Vista Commercial Center Filing I and Vacation of the 15' Utility Easement Along East Side of Lot 3, Block 3." This plat was submitted 1:o replace the plat, dated June 7, 2000, that was initially submitted. As you are no doubt aware. the property immediately south of the Vista Commercial Center Filing I was used for disposal of municipal solid waste from 1966 through 1993. At some point during this period, refuse was placed north of the south property line of the Vista Commercial Center (refuse extends approximately 15 feet north of this line) Recent investigations conducted by consultants to the City of Longmont and the applicant have found explosive gas in the refuse and in undisturbed soils in an area extending from the property line to as much as 51 feet north of the property line. The plat submitted with the application materials on June 7, 2000, created a new 50 foot wide lot along the southern edge of the development and moved the utility easement into the lots north of the new lot (approximately 50 feet north of its current location). VVe are concerned, however, that the plat received on July 13, 2000, moves the utility easement back to its original location, an area known to have been impacted with landfill gas and where refuse has been disposed in the past. Any utility installed in the easement will be placed directly in refuse and could result in explosive conditions due to landfill gas. Additionally, according to the EPA1 since landfill gas will generally migrate through the path of least resistance, utilities constructed in this easement would create a conduit for further gas migration, possibly to a structure. Solid Waste Disposal Facillly Criteria, Technical Mpnu_c Sheri Lockman July 14, 2000 Page 2 As a result, we recommend that the easement be returned to the location proposed on the plat dated June 7, 2000, except that it be extended in the same alignment across lots 9 through 11. This would allow for utility installation outside of the area that has been impacted by the landfill. We also recommend that a note be placed on the plat to alert potential purveyors that gas conditions may be encountered. In the event the utility easement remains as proposed in the July 13, 2000 plat, we recommend that notes be placed on the plat that alert potential purveyors to the conditions that will be encountered. The notes should also require the following: • Engineered controls to prevent gas migration (e.g. seepage collars and clay plugs) • A worker protection plan that addresses the hazards encountered in excavating gaseous soils and refuse. The plan should consider explosion hazards, inhalation of and dermal contact with organic and acidic vapors, inhalation of and dermal contact with potentially infectious materials, and dermal contact with potentially hazardous liquids and solids. • Limitation of the area of final cover disturbed and a requirement that the cover be returned to its original condition. A final option would be to vacates the easement so that no excavation would occur in the area.
