HomeMy WebLinkAbout20000477.tiff HEARING CERTIFICATION DOCKET NO. 2000-06 RE: CHANGE OF ZONE #533 FROM A(AGRICULTURAL)ZONE DISTRICT TO E (ESTATE) ZONE DISTRICT FOR THREE (3) LOT MINOR SUBDIVISION - SHAWN AND PAULA PETERSBURG A public hearing was conducted on February 23, 2000, at 10:00 a.m., with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated February 7, 2000, and duly published February 10, 2000, in the South Weld Sun, a public hearing was conducted to consider the request of Shawn and Paula Petersburg for Change of Zone #533 from the A (Agricultural) iZone District to the E (Estate) Zone District for a three (3) lot Minor Subdivision. Lee Morrison, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Gathman gave a brief description of the location of the site, which will be serviced by the Left Hand Water District. Mr. Gathman stated there are residences on Lots 1 and 3, and Lot 2 is vacant. He stated a tap I-as been purchased from the Left Hand Water District; the internal road will be accessed from Weld County Road 10 located along the south side of the property; and three of the ten referral entities responded with comments. In response to Chair Kirkmeyer, Mr. Gathman clarified Lots 1 and 3 currently have residences; however, Lot 2 is vacant. He stated this proposal is consistent with the Weld County Comprehensive Plan; the site is designated as prime fannground, but the small size, shape of the site, topographic relief, and dry pond areas make it difficult to farm; it is not within an Urban Growth Boundary or classified as an urban scale development; it will have a minimal impact on surrounding uses; and because the site is located within the Geologic Hazard Area Overlay, the applicant is required to obtain a Geological Hazard Development Permit. Commissioner Ceile commented the application indicates there are 32 acres available for development; however,the proposed lot sizes add up to 44 acres. In response to Commissioner Baxter, Mr. Gathman stated the surrounding uses include some farming, horse pastures, residential lots, and a 19-lot subdivision to the north. In response to Chair Kirkmeyer, Mr. Gathman stated he is not sure when the illegal split of the property occurred, and reiterated the only access will be from Weld County Road 10 and all other accesses will be closed. Responding to Commissioner Baxter, Mr. Morrison s:ated surveyor could clarify whether the existing monument is accurate. Commissioner Baxter commented that item 2000-0477 PL1376 HEARING CERTIFICATION - SHAWN AND PAULA PETERSBURG (COZ #533) PAGE 2 number 5, listed on page 2 of the Rezoning Plat indicates that although there are conflicting monuments,the western set of corner monuments has been adopted. Mr. Gathman stated reason of approval #2.E.1 of the Draft Resolution should be corrected to stated the site does lie within an overlay district adopted by Weld County as indicated in item #2.E.3. Shawn Petersburg, applicant, clarified Lot 1 is owned by Ricky Lauridsen, and was divided from the rest of the parcel in the late 1970's resulting in an illegal split. Mr. Petersburg stated he owns approximately 32 acres. He explained by including the neighbor's property as part of the Minor Subdivision, the illegal land split will be corrected. In response to Chair Kirkmeyer, Mr. Petersburg stated the illegal split occurred in the early 1970's. In response to Commissioner Baxter, Mr. Petersburg stated there is no dispute over the monument on the east side of the property. In response to Chair Kirkmeyer, Mr. Petersburg stated he has reviewed and agrees with the Conditions of Approval and Development Standards. No public testimony was offered concerning this matter. Commissioner Hall moved to approve the request of Shawn and Paula Petersburg for Change of Zone #533 from the A (Agricultural) Zone District to the E (Estate) Zone District for a three (3) lot Minor Subdivision, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record,with an amendment to Reason of Approval#2.E.1 to delete the word"not." The motion was seconded by Commissioner Vaad. Mr. Morrison suggested Reason of Approval #2.E.1 be amended to state, "The proposed Change of Zone does not lie within any overlay district identified by the maps officially adopted by Weld County other than the Geologic Hazard Area Overlay." The motion carried unanimously. This Certification was approved on the 28th day of February, 2000.
