RE: DISCONTINUANCE OF WELD COUNTY LONG-TERM CARE BIO-ETHICS
COMMITTEE AS A BOARD OR COMMITTEE APPOINTED BY BOARD OF COUNTY
COMMISSIONERS OF WELD COUNTY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated March 25, 1996, the Board of County Commissioners
approved the Weld County Long-Term Care Bio-Ethics Committee ("the Committee") Bylaws,
which Bylaws the Board amended by Resolutions dated May 14, 1997, and June 28, 1999, and
WHEREAS, said Bylaws included having the Board appoint the Committee members,
and
WHEREAS, the Committee desires to discontinue having Committee members
appointed by the Board, and
WHEREAS, the Board desires to comply with such request and to thereby discontinue
the Committee as a board or committee appointed by the Board.
NOW, THEREFORE, be it resolved by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Long-Term Care Bio-Ethics Committee be, and hereby
is, discontinued as a board or committee appointed by the Board.
BE IT FURTHER RESOLVED by the Board that it requests the Committee to amend its
Bylaws to reflect such discontinuance and consequently to resume its existence as a "stand
alone" committee appointing its members in a different manner.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 5th day of June, A.D., 2000.

Dear Mr Connell:
The Board of County Commissioners of Weld County has been advised by Ms. Linda Piper that
the Weld County Bio-Ethics Committee desires to act as a stand alone working committee
without being appointed by the Board. The original structure of the Bio-Ethics Committee was
intended to make the committee appointed by the Board of County Commissioners so that The
committee and its members would be covered by Weld County's insurance. The Board
understands you and the other committee members have been advised that once the appoint iHit
relationship between the committee and the county is severed, all insurance coverage once
afforded the committee and its members ceases. The Board will honor the committee's desire by
adopting a resolution to severe the relationship.
The Board of County Commissioners is pleased the committee will continue to function and
provide a valuable service to the community. We thank you and the committee members for
your continued interest and commitment to the important issues related to long term care.

Subject: Long Term Care Bio Ethics Committee -Reply
The only reason it was set up under the BOCC for appointments was to come
under the County's insurance umbrella. If the desire is to be a committee cn
its own, the committee and its members won't be covered. The answer to your
question is that if the Board is to be deleted from the process, the bylaws
for the committee will need to change and the Board needs to send the
committee and its members a letter saying the relationship with the Board and
insurance coverage by the County are eliminated. Bruce.

Bruce:
We are looking to take the LTC Bio Ethics Committee out from under the
Commission and make it a stand along working committee. This has been
discussed with Commissioner Vaad, Chuck Connell from the Committee and the LTC
Committee as a whole. It has been agreed that there is no real reason for it
to remain under the Commission and by continuing to do so we are causing my
staff, Vicki and the Commission endless work trying to keep the slots filled
with appointments. Since the committee is made up of professionals, it is a
revolving door of staff on and off the committee.
What do we need to do to bring this about? Some formal process?
