RE: ACTION OF THE BOARD CONCERNING MOBILE HOME PERMIT#2218 - RICHARD
KUEHNE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute arid the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado., on the 18th
day of September, 2000, considered the request of Richard Kuehne, P.O. Box 46, Gill,
Colorado 80624, for Zoning Permit for a Mobile Home, ZPMH #2218, for a self-contained
camper to be used as a principal dwelling, and
WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
Lot 10, Block 5, Unincorporated Town of Gill,
located in Section 27, Township 6 North, Range 64
West of the 6th P.M., Weld County, Colorado
WHEREAS,. the Board of County Commissioners, having heard all of the testimony,
finds that the applicants' request for a Mobile Home Permit for a self-contained camper to be
used as a principal dwelling does not fully comply with the Weld County Zoning Ordinance and
should be denied for the following reasons:
1. Section 43.2.6.1.1 - The proposed use is not compatible with the surrounding
area or with the character of the neighborhood, and it may have adverse effects
on the immediate area. This proposal does not comply with the definition of a
Dwelling Unit as set forth in the Weld County Zoning Ordinance. The camper is
a mobile recreational vehicle not intended for being a permanent dwelling.
2. Section 43.2.6.1.3 - The applicant is not proposing any separate sewage or
water source. The proposed source of water and sewer would be from the
existing tap and septic system used for Lots 11 and 12, which are separate legal
parcels. The applicant has not obtained the prior approval of the North Weld
County Water District for use of water from the existing tap on Lots 11 and 12 by
the occupants of the camper. Additionally, the applicant has produced no
evidence showing that the septic system on Lots 11 and 12 is sufficient to serve
the dwelling unit on those lots and the proposed camper.
3. Section 43.2.6.1.4 - The proposal does not provide for the general health, safety,
and welfare of the inhabitants or County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Richard Kuehne for permission to place a self-
contained camper to be used as a principal dwelling on the above described parcel of land,
which was found not to be in compliance with Section 43 of the Weld County Zoning Ordinance,
be, and hereby is, denied.

The Department of Planning Services' staff has reviewed this request and recommends that this
request be denied for the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown
compliance with Section 43.2.6 of the Weld County Zoning Ordinance, as follows:
a. Section 43.2.6.1.3 -Availability of adequate water and sewage disposal facilities.
The applicant is not proposing any sewage or water source. The Department of Health is
recommending denial of the application unless a septic system is installed and an approved
water supply be made available.
b. Section 43.4.2 -States the applicant has submitted a petition containing the signatures of
at least seventy percent(70%)of the people owning property within five hundred(500)feet
of the property on which the self contained camper is proposed to be located. The petition
shall indicate that the surrounding property owners who have signed the petition have 110
objections to the issuance of a zoning permit for the self contained camper.
The applicant did not submit a petition with signatures.
2. The application does not meet the definition of either a mobile home or a dwelling unit as set forth
in the Weld County Zoning Ordinance.

Should the Board of County Commissioners approve this request, the Department of Planning
Services' staff recommends the following conditions be attached:
1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home
on the property.
2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved
septic system and a legal water supply.
3. The mobile home shall not be occupied until such time that the applicant has complied with
Conditions 1 and 2 stated above.
4. The applicant shall utilize the existing residential access to this parcel, and no additional accesses
shall be granted.
5. Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a
result of the proposed development,the applicant/landowner shall be responsible for controlling the
noxious weeds
6. The applicant shall maintain compliance with section 43.2.6 of the Weld County Zoning Ord nance
at all times.

WCR 55.10 (2"d St.) is designated on the Transportation Plan Map as a platted town site , which require s
an 80-foot right-of-way at full build out. There is presently an 80-foot right-of-way. This road s

Environmental Health Services has reviewed this proposal. Our Department has a cone em with
this application because they are proposing a principal dwelling with self contained sewage and
water supply. We recommend denial unless the following conditions are recommended to be
part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system(s) end shall
be installed according to the Weld County Individual Sewage Disposal Regulatiors.
2. An approved water supply shall be available on Lot 10.
GENERAL COMMENT:
The proposed acreage currently does not meet current Weld County Health Department
policy. We would encourage the applicant to increase the acreage. However, in the event
the applicant cannot or chooses not to increase the lot size, please place the following note
onto the plat.
Note: Future development may necessitate a larger lot than what is displayed on the plat.
In addition, a larger lot would provide additional dilution and attenuation of sewage wastes
which may beneficial to the environment.
Please Note:
Our Department recommends the applicant to set aside an area for a septic system replacement
envelope.
