HomeMy WebLinkAbout20001578.tiff RESOLUTION RE: APPROVE MINOR RESUBDIVISION, S #535 - DAVID RIEDIGER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 28th day of June 2000, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of David Riediger, for a Minor Resubdivision, S #535, on the following described real estate, to-wit: Lot 13 B, Northwest Estates Subdivision, W1/2 SW1/4, Section 29, Township 7 North, Range 67 West of the 6th P.M., Weld County, Colorado, and WHEREAS, Section 8.2.6 of the Weld County Subdivision Ordinance provides standards for review of said Minor Resubdivision, S #529, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 8.2.5 of the Weld County Subdivision Ordinance. 2. The request is in conformance with Section 8.2 of the Subdivision Ordinance. as follows: a. Section 8.2.1 - The applicant is requesting to vacate a 1-foot portion of an existing drainage and utility easement(not a right-of-way).The Weld County Utilities Coordinating Advisory Committee approved the request at its June 22, 2000, meeting. b. Section 8.2.2 - Seventy percent (70%) of the adjacent landowners have signed a petition to waive any objection to this application. The applicant owns the current property upon which the easement vacation is proposed and the adjacent property owner bordering the easement has signed a petition waiving any objection to this application. c. Section 8.2.3 - The vacation is consistent with the surrounding area and uses (in an existing residential subdivision), and with the Weld County Comprehensive Plan. Goal R.2 states, "Ensure that adequate public services and facilities are available to serve the residential development or district." Section 8.2.4 -The overall width of the easement is thirty(30)feet between the side property line for Lot 13B and the adjacent lot(Lot 11). Section 10.6 of the Weld County Subdivision Ordinance requires a minimum total width of 20 feet to be apportioned equally between property lines. This existing easement exceeds these requirements. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of the Weld County Board of Commissioners for a Minor Resubdivision, S #535, on the hereinabove described parcel of land be, and hereby is, granted subject to the following condition: 1. The applicant shall be responsible for submitting a Minor Resubdivision map to be recorded in the Office of the Weld County Clerk and Recorder,as well as paying the recording fee in accordance with Section 8.2.5.6 of the Weld County Subdivision Ordinance. The Utility Board approved the request at their June 22, 2000 meeting. 8.2.2 - Seventy (70) percent of the landowners adjacent to the proposed right-of-way vacation waive any objection to the vacation by signing a petition. Seventy (70%) have signed a petition to waive any objection to this application. The applicant will own the current property upon which the easement vacation is proposed and the adjacent property owner for which the easement borders has signed a petition waiving any objection to this application. S-535 - Riediger Minor Resubdivision 2000-1578 -'L142-2-) 8.2.3 - The vacation shall only be permitted when it is compatible with the surrounding area and uses, is consistent with efficient and orderly development, is consistent with the Weld County Comprehensive Plan, and does not deprive any parcel of adequate access to a public road or street right-of-way. The vacation is consistent with the surrounding area and uses (in an existing residential subdivision), is consistent with the Weld County Comprehensive plan. There is currently only one utility located within this easement(phone company)and it is located approximately 25-30 feet from the portion of the easement that is proposed to be vacated. 8.2.4 - The vacation of any right-of-way may require the reservation of an easement for public utility or drainage purposes in order to meet the easement requirements of Section 10.6. The overall width of the easement is (30) thirty-feet between the side property line for Lot 13B and the adjacent lot (Lot 11). The Weld County Public Works Department recommends approval. The abutting property has an existing 10-foot utility easement in place. Item 10.6.1, Subdivision Ordinance No. 173-E (Easement Standards) states that the easement shall follow rear and side lot lines wherever practical and shall have a minimum total width of 20 feet apportioned equally on abutting properties. LOCATION: North of WCR 76, approximately 3/4 mile west of SH 257 Chris Gathman, Planner, presented Case S-535. Chris noted that the applicant is proposing to vacate a 1' portion of an existing 20'access and utility easement. There is currently,with the adjacent property owners easement added, 30' of easement. In the current Subdivision Ordinance, there is a required 10' property easement on both sides of property lines. The adjacent property owner has signed off on this vacation and as this fulfills the 70% signatures as required. Chris noted that the vacation appears to be compatible. Ron Kikendall,the applicant, noted that they are asking for a 1'vacation as the house is already built Ron noted that the title company caught this discrepancy and will not sign off until resolved. Don Carroll clarified that the remaining easement would be 19' on this side of the property line plus the adjacent 10' on the adjacent property. Don asked if there were any utilities in the area requested for a vacation. Mr. Kikendall noted that there is a U.S. West line on the neighbors side of the property line, but nothing on the applicant's side of the property line. Don Carroll noted that several members were not present, but that they would come in to listen to the tape and vote on this case in order to achieve quorum. Don Magnuson moved to approve the requested 1' vacation of the 20' easement. Don Carroll seconded the motion. Doug Dalton of Public Service Company listened to the tape and looked at the proposed vacation on June 22, 2000 at 3:00 p.m. and voted in favor of the vacation. Cody Wooldridge of Central Weld Water District listened to the tape and looked at the proposed vacation on June 22, 2000 at 3:30 p.m. and voted in favor of the vacation. Motion passed.
