HomeMy WebLinkAbout20000535.tiff • s5 RESOLUTION RE: ACCEPT FOUR PETITIONS FROM VARIOUS INDIVIDUALS AND AUTHORIZE VACATION OF A PORTION OF WELD COUNTY RIGHT-OF-WAY FOR WELD COUNTY ROAD 126 - S27, T11 N, R67 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Road Petition from Andesite Rock Company, 7321 East 88th Avenue, Henderson, Colorado 80641, a copy of which is attached hereto and included by reference, all requesting vacation of a portion of Weld County Road 126, being more fully described as follows: All that portion of the existing Weld County Road 126 (old Weld County Road 126) subject to dedicated and recorded easements and rights-of-way that lies south of the north line of Lot 1, Block K of the Town of Carr, said portion of the existing Weld County Road 126 starts at the east line of Section 27 and continues west to the west line of Lot 2, Block K, said west line being the point of intersection described in attached Exhibit A. Excluded from said vacation is that portion of the new Weld County Road 126 described in attached Exhibit B, and WHEREAS, the Board has been presented with a Road Petition from Kenneth and Sharon Mosness, 9961 Weld County Road 126, Carr, Colorado 80612, a copy of which is attached hereto and included by reference, all requesting vacation of a portion of Weld County Road 126, being more fully described as follows: The existing public road right-of-way for Weld County Road 126 within Section 27, Township 11 North, Range 67 West of the 6th P.M., Weld County, Colorado being a 60-foot strip of right-of-way as recorded July 9, 1914, in Book 373, Page 423, Weld County, Colorado, subject to dedicated and recorded easements and rights-of-way. (See attached Exhibit drawing.) Excluded from said vacation is that portion of the new Weld County Road 126 described in attached Exhibit B which over laps with the area described in the recorded right of way, and WHEREAS, the Board has been presented with a Road Petition from Terry Grazing Association, P.O. (See attached Exhibit A.) Excluding that portion of the new Weld County Road 126 described in attached Exhibit B, and WHEREAS, the Board has been presented with a Road Petition from Lloyd and Marjorie Thomas, Trustees, 7900 Weld County Road 120, Carr, Colorado 80612, a copy of which is attached hereto and included by reference, all requesting vacation of a portion of Weld County Road 126, being more fully described as follows: All that portion of Weld County Road 126 subject to dedicated and recorded easements and rights-of-way lying south of the north line of Section 26, and west of the north quarter corner of Section 26, and terminates at the west line of Section 26. (See attached Exhibit A.) Exclusion to the vacation is that portion of the new Weld County Road 126 described in Exhibit B, and WHEREAS, the County Attorney's Office and the Department of Public Works recommend approval of said requests since the old and abandoned portions of Weld County Road 126 will no longer be needed for the safety and welfare of the traveling public once the new portion of Weld County Road 126 is complete, and WHEREAS, by notice dated February 24, 2000, the adjoining landowners were mailed ten days notice by the Clerk to the Board of a public hearing set for March 6, 2000, to consider the vacation, in accordance with the requirements of Section 43-2-303(2)(b), C.R.S., of that portion of right-of-way which is described above, and WHEREAS, the Board of County Commissioners convened a public hearing on March 6, 2000, heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of the old and abandoned portions of Weld County right-of-way which are described above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road provided the new Weld County Road 126 is constructed as planned, and WHEREAS, the Board of County Commissioners deems it advisable to vacate said portions of Weld County right-of-way, with said vacations to become effective upon recording as required below, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the four Road Petitions from Andesite Rock Company, Kenneth and Sharon Mosness, Terry Grazing Association, and Lloyd and Marjorie Thomas, Trustees, be, and hereby are, accepted. 111111111111111111111111 III 111111111111 III 11111 Vii IIII 2000-0535 2845885 05/03/2001 03:17P JA Suki Tsukamoto EG0039 2 of 11 R 0.00 D 0.00 Weld County CO • • RE: VACATION OF A PORTION OF WCR 126 PAGE 3 BE IT FURTHER RESOLVED by the Board that the portion of Weld County right-of-way which is described above be, and hereby will be, vacated effective on the date this Resolution is recorded.
