HomeMy WebLinkAbout20000606.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MARCH 13, 2000 TAPE #2000-07 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, March 13, 2000, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara J. Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall - EXCUSED Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Baxter moved to approve the minutes of the Board of County Commissioners meeting of March 8, 2000, as printed. Commissioner Vaad seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Vaad moved to approve the Certification of Hearings conducted on March 8, 2000, as follows: 1)A Site Specific Development Plan and Special Review Permit #1249, Jim Perry; and 2) A Site Specific Development Plan and Special Review Permit#1252, Canvey Graves and Sue Hickman. Commissioner Geile seconded the motion, which carried unanimously. ADDITIONS TO AGENDA: The following were added to the Agenda under New Business: 4) Consider Agreement for the Use of Soil and/or Gravel for Road Purposes and authorize Chair to sign - Phillip and Sarah Pfannebecker; and 5) Consider Construction Materials Special 111 Operation Reclamation Permit Application and authorize Chair to sign CONSENT AGENDA: Commissioner Vaad moved to approve the consent agenda as printed,. Commissioner Baxter seconded the motion, and it carried unanimously. PUBLIC INPUT: There was no public input. 2000-0606 BC0016 WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $603,494.68 Commissioner Baxter moved to approve the warrants as presented by Mr. Warden. Commissioner Geile seconded the motion, which carried unanimously. NEW BUSINESS: CONSIDER TEMPORARY ROAD CLOSURE OF VARIOUS WELD COUNTY ROADS - WCR 21 BETWEEN STATE HIGHWAY 52 AND WCR 8; WCR 44 BETWEEN WCR 41 AND 43; 83RD AVENUE BETWEEN STATE HIGHWAY 34 AND WCR 54,ALSO 28TH STREET BETWEEN 83RD AVENUE AND STATE HIGHWAY 34; AND WCR 18 BETWEEN STATE HIGHWAY 85 AND WCR 25: Commissioner Vaad moved to approve said closures. Commissioner Geile seconded the motion, which carried unanimously. CONSIDER APPOINTMENTS AND REAPPOINTMENT TO FAMILIES, YOUTH AND CHILDREN COMMISSION: Commissioner Geile moved to appoint Janet Flaugher and Tracey Frank, and reappoint Jennifer Higgins to the Families, Youth and Children Commission with terms expiring December 31, 2002. Seconded by Commissioner Baxter, the motion carried unanimously. CONSIDER REAPPOINTMENTS TO BUILDING TRADES ADVISORY COMMITTEE: Commissioner Baxter moved to reappoint Larry Jorgensen, Mark Doty, Jim Morris, and Scott Renfroe to the Building Trades Advisory Committee with terms expiring April 10, 2003. Seconded by Commissioner Geile, the motion carried unanimously. CONSIDER AGREEMENT FOR THE USE OF SOIL AND/OR GRAVEL FOR ROAD PURPOSES AND AUTHORIZE CHAIR TO SIGN-PHILLIP AND SARAH PFANNEBECKER: Lee Morrison,Assistant County Attorney, stated under this agreement Phillip and Sarah Pfannebecker will grant Weld County access to enter their property to obtain fill dirt for Weld County road projects. In response to Chair Kirkmeyer, Mr. Morrison stated the County will pay the property owner a royalty of 50 cents per cubic yard for all material removed during the term of the lease. He further stated the term of the agreement will begin upon approval of the Construction Materials Special 111 Operation Reclamation Permit from the Division of Minerals and Geology, and added this agreement needs to be completed as soon as possible for use during the upcoming construction season. Commissioner Baxter moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Vaad, the motion carried unanimously. CONSIDER CONSTRUCTION MATERIALS SPECIAL 111 OPERATION RECLAMATION PERMIT APPLICATION AND AUTHORIZE CHAIR TO SIGN: Mr. Morrison stated this application requires approval to be sent to the Colorado Division of Minerals and Geology in conjunction with the agreement discussed above. Commissioner Baxter moved to approve said application and authorize the Chair to sign Seconded by Commissioner Geile, the motion carried unanimously. PLANNING: CONSIDER CANCELLATION AND RELEASE OF COLLATERAL FOR VISTA COMMERCIAL CENTER SUBDIVISION, FIRST FILING, S #408 - HORIZON INVESTMENTS, LLC: Kim Ogle, Department of Planning Services, stated on November 24, 1999, the Weld County Departments of Public Works and Planning Services conducted a visual inspection of the site, at the request of the property owner, and determined that no repairs are necessary. Mr. Ogle stated staff recommends release of the remaining collateral in the amount of$63,584.85. He further stated Vista Commercial, First Filing, will be scheduled to be placed on the Weld County roadway system for full maintenance once the collateral is released. Minutes, March 13, 2000 2000-0606 Page 2 BC0016 Commissioner Geile moved to cancel and release said collateral in the amount of $63,584.85 for Vista Commercial Center Subdivision, First Filing,S#408,to Horizon Investments, LLC. The motion,which was seconded by Commissioner Baxter, carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
