HomeMy WebLinkAbout20000495.tiff RESOLUTION RE: APPROVE CONTRACT AMENDMENT#3 FOR JTPA OLDER WORKER PROGRAM AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Contract Amendment#3 for the JTPA Older Worker Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Area Agency on Aging, and the Colorado Department of Labor and Employment, with terms and conditions being as stated in said amendment, and WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Contract Amendment#3 for the JTPA Older Worker Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Area Agency on Aging, and the Colorado Department of Labor and Employment be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said amendment. Enclosed for Board approval is a modification request to transfer funds between line items , and adding an equipment request. We are requesting $5,500 be transferred from the Direct Training line. $3,500 of these funds are to be moved to the Training Related line and $2,000 is requested to be used to purchase a PC for the Older Worker Case Manager. The $3,500 that will be transferred from Direct Training to the Training Related line is to adjust the current levels of spending. Piper, Director , Weld County Area Agency on Aging at (970) 353, 3800, ext. 3320. 2000-0495 DEPARTMENT OR AGENCY NAME KAA CONTRACT ROUTING NUMBER 00-0250 CONTRACT AMENDMENT#Three This AMENDMENT, made this 29th day of February , 2000 , by and between the State of Colorado for the use and benefit of the Department of LABOR AND EMPLOYMENT, 1515 Arapahoe Street,Tower 2, Suite 400,Denver,Colorado 80202-2117 hereinafter referred to as "the State", and the WELD COUNTY AREA AGENCY ON ACING,ja County Government Agency), whose address or principal place of business is 1551 North 17th Avenue, P. O. Box 1805, Greeley,Colorado 80632 hereinafter referred to as "the Contractor." FACTUAL RECITALS Authority exists in the Law and Funds have been budgeted, appropriated, and otherwise made available, and a sufficient unencumbered balance thereof remains available for payment in Fund Number 100, Appropriation Code 201, (Organizational Code 4111, Program Code 1100, Function Code 7500, and Grant Budget Line Code 4219) under Contract Encumbrance Number C981026 . The parties entered into a contract("Original Contract") dated JulL1,1997, more fully described below. The Original Contract provided for: providing the State services under the JTPA Title II-A, 5% Older Worker for employment and training services to older workers,and the Title III, EDWAA, to provide employment and training services to participants 55 years of age and older. The Contract Amendment#ONE provided for: extending the period of performance for the PY97 funding for both the JTPA Title II-A,5% Older Worker,and Title III-EDWAA funding; and, to add funding for PY98 JTPA Title II-A,5% Older Worker. The Contract Amendment#Two provided for: extending the period of performance to June 30, 2000; adding Thirty-eight Thousand Dollars ($38,000) of PY99 JTPA Title II-A, 5% Older Worker funds and enrolling an additional 19 participants. The State and the Contractor have mutually agreed that changes to the Original Contract are now required because of: the need to modify the budget, to move funds from the Direct Training budget line item to the Training Related budget line item, to adjust for current spending levels and to purchase new computer equipment for the Older Worker Case Manager. This budget modification does not impact the goals and objectives of the statement of work. It is the intent of the parties in entering into this Contract Amendment# T_hree to: move Five Thousand Five Hundred Dollars($5,500.00) out of the Direct Training budget line item to the Training Related budget line item. Within the Training Related budget line item,Two Thousand Dollars ($2,000.00) will be used to purchase a new personal computer(replacing an old Vax module and old Page I of 6 -ock> c✓-/9S 386 personal computer); and Three Thousand Dollars ($3,000.00)will be used for salary expenses for additional case management time; Two Hundred Dollars ($200.00)will be used for operating expenses related to additional case management time; and,Three Hundred Dollars ($300.00) will be used for support services (i.e. client transportation). All required approvals, clearances and coordination have been accomplished from and with all appropriate agencies. NOW,THEREFORE, it is hereby agreed that: Consideration for this amendment to the Original Contract, CE number C981026 , Contract Routing number KAA 981026 , dated July 1, 1997, consists of the payments which shall be made pursuant to this Amendment and the promises and agreements herein set forth. 2. It is expressly agreed between the parties that this Amendment is supplemental to the Original Contract, Contract Routing Number KAA 981026 , dated July 1, 1997, Contract Amendment # One, Contract Routing Number KAA 99-0032 , dated May 11, 1998, Contract Amendment# Two, Contract Routing Number KAA 00-0075 , dated July 1, 1999, hereinabove referred to as the "Original Contract," which is, by this reference, incorporated, made a part hereof, and identified as "Attachment A". All terms, conditions, and provisions the Original Contract, unless specifically modified herein, are to apply to this Amendment as though such terms, conditions, and provisions were expressly rewritten, incorporated, and included herein. 3. It is agreed by and between the parties that the Original Contract is and shall be modified. altered, and changed in the following respects only1: C. STATEMENT OF WORK. The Contractor agrees to perform, in a professional and workmanlike manner, the obligations and responsibilities set forth in the "Scope of Services" (Section C.3.B., Section C.4.F., and Section C.4.J.) 3. FUNDING AND BUDGET. The Contractor shall receive $40,000 from Program Year 97, Title II-A, 5% Older Worker funds and $20,000 of Program Year 1997 Title III. EDWAA 40% Governor's Discretionary Funds. The Contractor shall receive For[y- three Thousand Dollars($43100Q) from Program Year 98, Title 11=A,5%o Older Worker JTPA funds. The Contractor shall receive Thirty-eight Thousand Dollars ($38,000)from Program Year 99, Title II-A Older Worker JTPA funds. C. Budget Narrative. The funds provided under this Contract Amendment#TWO of Thirty-eight Thousand Dollars ($38,000) of PY99 Title 11-A,5% Older Worker will be used for: Deletions to the Original Contract appear in "strikeout" format. Additions to the Original Contract appear in bold, italicized, capital letters or numbers or"redline" format. Page 2 of 6 ADMINISTRATION $3,800 will be used for the following Administrative activities: $1,727 (3%) will be used for a portion of the salary and fringe benefits of the Director, Area Agency on Aging, for management of the grant, and for assuring compliance with program requirements and evaluating outcomes. $863 (1.5%) will be used for the salary and fringe benefits of the Fiscal Officer for budgeting, reporting and audit of the grant. $388 (I%) will be used for the salary and fringe benefits of the Accountant to cost allocate and track expenditures to the grant. $327 (1%) will be used for the salary and fringe benefits of the Client Services Technician for eligibility verification and MIS monitoring staff. $495 will be used for the direct operating costs associated with the Administrative Staff. DIRECT TRAINING $26,196$20,996.00 will be used for the following activities: $1 1,006 (30%)a)$10,006.00 (24%) will be used for the salary and fringe benefits of the Client Service Technician for objective assessments, ISS, skill level evaluations, counseling, testing and case management. $1,700 will be used for one On-The-Job contracts. $4,200 will be used to enroll approximately seven (7)clients in secondary education. $1,125 will be used to enroll approximately five participants into the computer lab for hard skills training. $ 200$2,700.00 will be used for work experience for approximately three participants. $400 will be used for staff training. $865 will be used for direct costs associated with training activities. TRAINING RELATED $7,704 $13,204.00 of Training Related funds will be used for the following: $7,337 (20%)will be used for the salary and fringe benefits for the client Services Page 3 of 6 Technician for outreach, intake initial assessment, orientation, referral,job search assistance, and follow-up. $3000.00 will be used to pay for additional case management time $200.00 will be used to pay for operating expenses related to additional case management time. $200$500.00 will be used for Supportive services for participants. $16T will be used for Direct costs associated with training related activities. $2,000.00 will be used to purchase new computer equipment for the Older Worker Case manager to replace the Vax terminal and an old 386 personal computer. Attachments: A. Attachment 5 is hereby revised and attached to this Amendment#Three. 4. The effective date of this Amendment is March 1,2000 5. Except for the "Special Provisions" contained in the Original Contract, in the event of any conflict, inconsistency, variance, or contradiction between the provisions of this Amendment and any of the provisions of the Original Contract, the provisions of this Amendment shall in all respects supersede, govern and control. The "Special Provisions" shall always be controlling over other provisions in the Original Contract or any amendments thereto. The representations in the Special Provisions concerning the absence of bribery or corrupt influences and personal interest of State employees are presently reaffirmed. 6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE CURRENT FISCAL YEAR ARE CONTINGENT UPON FUNDS FOR THAT PURPOSE BEING APPROPRIATED, BUDGETED, AND OTHERWISE MADE AVAILABLE. 7. THIS AMENDMENT SHALL NOT BE DEEMED VALID UNTIL IT SHALL HAVE BEEN APPROVED BY THE CONTROLLER OF THE STATE OF COLORADO OR SUCH ASSISTANT AS HE MAY DESIGNATE.
