Teague Diversified Feedlot: S'h,Section 8,Township 2N,Range 57W The attorney for the District reported that he had received a letter from Mr. Teague's attorney, Mike D. Shimmin, regarding the progress made in regard to the above entitled matter since the last meeting. A copy of the letter of November 1, 2000, is attached to the minutes of this meeting and by reference incorporated. It was noted that apparently progress is being made in regard to gathering the necessary data concerning historical use and, therefore, the matter was tabled to the next regular meeting. Thomas H. Bradbury Applications Case No. 99-GW-15A-N Consolidated The attorney for the District reported the applicant has filed a Motion for Summary Judgment in regard to the above entitled matter and that the Staff of the Ground Water Commission has filed a purported response to said Motion whereby the Staff and its attorney have urged the hearing officer to rule in favor of the applicant and as against the District as objector. The attorney for the District reported that he has filed his response to the applicant's Motion for Summary Judgment as well as a Motion to Strike the Commission's Staff purported Response. The Board reviewed its current financial status and particularly its cash flow and the unexpected added expense to the District in connection with the Church applications and more recently the Bradbury applications. Upon motion duly made, seconded, and unanimously carried the Board decided to borrow the sum of$14,593.00 against its existing Certificate of Deposit at Morgan Federal Bank f/k/a Morgan County Federal Savings and Loan Association, Number 2205888-06 at a net cost of approximately $63.00. Budget for the Year 2001 The President then brought to the attention of the Board the matter of the adoption of the budget for the District for the year 2001. Notice of the proposed budget was published as required by law in the Fort 1 Morgan Times, Greeley Daily Tribune, Brighton Blade, and Tri-County Tribune. The President reported there had been no objection to said proposed budget. BUDGET MESSAGE In the adoption of its annual budget for the fiscal year 2001,the Board of Directors and concerned parties have prepared the budget based on information regarding expected revenues and expenditures of the District for the coming year. The budget is prepared using the modified accrual basis of accounting and all revenues, expenditures, cash receipts, and cash disbursements are reported in accordance with this basis of accounting. Management is cognizant of future projects and unusual expenditures due to unforeseen litigation and has made provisions for these endeavors. The total anticipated revenue budgeted for 2001 is $127.00 less than the estimated revenue for the year 2000. The amount of property tax budgeted for 2001 is $121.00 greater than the estimated amount to be received for the year 2000. It accordingly appeared that the same mil levy of.0278 assessed for the year 2000,would be appropriate for the budget for the year 2001. The actual estimated expenditures for the year 2000 is approximately $20,000.00 greater than the expenditures for 1999. This expenditure appearing under administration is due solely to a non- reoccurring expenditure of $20,000.00 made to the Department of Interior for a joint well monitoring agreement for the Deer Trail area. All other expenditures appear to be on a level equal to the actual expenditures of 1999 and the estimated expenditures for the year 2000 with the exception of the non- reoccurring $20,000.00 expense. It is also considered by the Board that an unspecified or undetermined amount of the funds may be required for the year 2001 for legal and engineering expenses in connection with pending legal matters involving the Bradbury well applications and matters relating to adoption of amended or new rules and regulations. BOX 213, 401 LOCUST STREET FREDERICK, COLORADO, 80530 2001 BUDGET MESSAGE The attached 2001 Budget for Weld County Tri-Area Sanitation District includes several important features. The District is a Colorado Special District organized and existing pursuant to the provisions of the Special District Act, Title 32, C.R.S. and its governmental functions are subject to the provisions of Article X, Section 20, of the Colorado Constitution. The annual budget for the year beginning January 1, 2001 and ending December 31, 2001, is prepared in accordance with Local Government Budget Laws of Colorado as required for Title 32 Special Districts. The books and records are maintained on the accrual basis of accounting. The revenues are recognized when they are earned and the expenses are recognized when they are incurred. The accounts of the District are organized and presented in accordance with generally accepted accounting principles as applied to a governmental unit operated as an Enterprise Fund. Enterprise Fund accounting is used to account for the operations of governmental units, which are financed and operated in a manner similar to private business enterprises. This District has two separate Enterprise Funds; Sanitary Sewer and Storm Drainage. The District's financial statements for 1999 were audited by Watkins and Schommer of Greeley. The District has engaged Watkins and Schommer to perform the 2000 audit of the District's financial statements. All Reserve Fund balances are deposited with ColoTrust individual accounts or invested in interest bearing accounts at Valley Bank and Trust in Frederick. The 2001 budget adopted lowers the General operating tax levy to 0.129 mills. This is due to the Tabor and 5.5% Statutory Property Tax calculations. The wastewater and storm drainage functions of the District shall be considered an enterprise during 2001 and shall be operated in accordance with the requirement of such status, as set forth in Article X, Section 20, of the Colorado Constitution, and Section 37-4.5-101, et seq., C.R.S. Resolution No. 96-9 to recognize enterprise status is filed at the District office. 2001 BUDGET MESSAGE PAGE 2 The budget includes the maintenance of the sewer plant lagoon system, existing service lines and including funds for increased monitoring of sanitary sewer lines for breakage and deterioration. The District is also working on a ten-year masterplan for plant expansion. Also included are funds to maintain storm drainage channels on the outskirts of the District limits. The District also plans a major drainage project in 2001 to provide the Tri-Town communities with improved storm drainage protection. Fees will be collected at $4.00 per month per single family equivalent for this purpose. The District also collects $650.00 for each new sewer tap purchased to work on the Storm Drainage project. This District is participating with a Regional Drainage group and has been successful in seeking outside funding for these projects. The following goals are an information outline and are not listed in any priority level. 1. Maintaining the Plant Improvement/Investment/Tap Fee Fund for future growth and/or expansion by depositing all new tap fees in this ColoTrust account. The District is working on a ten-year master plan for plant expansion. 2. Continuing with a five-year maintenance plan for our main sewer collection lines. This will include root removal, repairing lines and repair or replace cracked lines. 3. Flood control maintenance for perimeter flood ditches. 4. Continue flood control improvement according to drainage studies. 5. Retaining a solid Capital Reserve Fund for any emergency at the treatment plant and/or collection lines. 6.
