A regular meeting of the Weld County Board of Adjustment was held on Thursday, February 10, 2000, in
Room 210 of the Planning/Public Health Building, 1555 N. 17th Avenue, Greeley, Colorado. The meeting was
called to order by Chairman John Windsor at 3:30 p.m.

The summary of the last regular meeting of the Weld County Board of Adjustment held on October 28, 1999,
was approved as read.
CASE NUMBER: BOA-1005
APPLICANT: Danny Perdew, Faith Tabernacle Church
PLANNER: Kim Ogle
LEGAL DESCRIPTION: Lots 2, 3, 4, 5, 6 & 7, Block 1, Peterson-Alexander Subdivision, being part
of Section 16, Township 5 North, Range 66 West of the 6th P.M., Weld
County, Colorado.
REQUEST: Variance of Building Height in R-1 Zone District.
LOCATION: North of and adjacent to US Hwy 34 Bypass frontage road (28th St) and
east of and adjacent to 71st Ave(WCR 29).
Kim Ogle, Planner, presented Case BOA-1005. Kim stated that the applicant wished a variance in building
height from 30' to 36' in the R-1 district. This site is for a church and the Department of Planning Services'
is recommending approval as this use is not a regular use in the area, but was approved through a Use by
Special Review. Kim stated that the Department of Planning Services' staff feels that the building height
requirement in the R-1 district is intended for residences and that this hearing is to avoid possible future
problems concerning the site. Kim noted that the building height variance would have been a condition of the
USR if the height had been known at that time.
Discussion concerning the height of the cupola on the top of the building and what would be the exact wording
of the variance. Lee noted that the Department of Planning Services' staff feels this variance may not be
necessary as the height limit is most likely for residences, but the department wanted to be sure when granting
the building permit. Joseph Bodine had questions as to whether or not this would have been allowed during
the USR permit. Lee stated that the USR conditions would overrule the existing zoning in the district.
Danny Perdew, Applicant, stated that the architect made a mistake when designing the building concerning
the height which was not caught until recently, being the reason for a variance instead of a condition of the
USR.
The Chair asked if there was anyone in the audience who wished to speak for or against this application. No
one wished to speak.

Arthur Partridge moved to grant the requested variance. Anita Owens seconded the motion.
The Chairman asked the secretary to poll the members of the committee. John Windsor, yes; Don Beierbach,
yes; Norman Nash, yes; Art Partridge, yes; Joseph Bodine, yes; Jack Davis, yes; Gary Stewart, yes; Anita
Owens, yes. Motion carried unanimously.
