RE FINAL PLAN, S #534, FOR A THREE (3) LOT MINOR SUBDIVISION - SHAWN AND
PAULA PETERSBURG
A public hearing was conducted on August 9, 2000, at 10:00 a.m., with the following present:
Commissioner Barbara J. Kirkmeyer, Chair
Commissioner M. J. Geile, Pro-Tern
Commissioner George E. Baxter
Commissioner Dale K. Hall
Commissioner Glenn Vaad
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated July 24, 2000, and duly published July 27, 2000, in
the South Weld Sun, a public hearing was conducted to consider the request of Shawn and Paula
Petersburg for Final Plan, S #534, for a three (3) lot Minor Subdivision. Bruce Barker, County
Attorney, made this a matter of record. Chris Gathman, Department of Planning Services,
presented a brief summary of the proposal and entered the favorable recommendation of the
Planning Commission into the record as written. Mr. Gathman reviewed staff's reasons for
approval as outlined in his Administrative Recommendation, marked Exhibit 2. In response to
Chair Kirkmeyer, Mr. Gathman stated he has no concerns with the application, nor any proposed
changes to the Conditions of Approval. He did state that at a previous hearing regarding this
matter,the Board questioned whether this parcel was created by an illegal land split; however, staff
has determined that in 1975 this parcel was legally divided and conveyed to the current property
owners.
In response to Commissioner Geile, Pam Smith, Weld County Department of Public Health and
Environment,stated the property is located outside the boundary of the St.Vrain Sanitation District;
however, there are two existing septic systems that can adequately service the site. She stated
that although this property was previously used to extract coal, the septic systems will be
engineered and the soil should not be a problem. She further stated if a particular site does not
meet requirements, the size of the proposed lots will allow for other alternatives.
Shawn Petersburg, applicant, was present to answer questions. No public testimony was offered
concerning this matter. In response to Chair Kirkmeyer, Mr. Petersburg stated he has reviewed
and agrees with the Conditions of Approval.

Commissioner Hall moved to approve the request of Shawn and Paula Petersburg for Final Plan,
S#534, for a three (3) lot Minor Subdivision, based on the recommendations of the Planning staff
and the Planning Commission, with the Conditions of Approval as entered into the record The
motion was seconded by Commissioner Geile, and it carried unanimously.
This Certification was approved on the 14th day of August 2000.
