The property is in the S1/2 of the SE1/4 of Section 15, Township 2 North, Range 68 West of the 6th P.M., Weld County Colorado. This parcel of land has been owned and farmed by Margaret Dillon and myself for more than twenty years. We are now interested in development of the property for residential and light industrial/commercial and residential purposes. The Dillon Annexation(West View Parks) is intended to be a master planned residential and industrial development encompassing approximately 69.6 acres immediately north of Weld County Road 20 and west of the 1-25 Frontage Road. Our goal is to provide a community living environment for people who desire to live in a small town with rural character by planning our development to include a variety of housing and industrial commercial opportunities: estate lots, single family detached,business and industrial parcels located adjacent to both natural and active open space opportunities. The road access throughout the community will be designed to provide for safe neighborhoods and reduced traffic speeds. The West View Parks community proposes rural residential street standards that will be designed to enhance the character of the community. The intent of the West View Parks plan is to design more pedestrian friendly streetscapes that compliment, not dictate, good neighborhood design. Community design elements will create the visual amenities that will contribute to making West View Parks a cohesive, well-planned community. An Industrial/Business park will encompass the Interstate Frontage, creating a buffer from the interstate traffic. The sports park and potentially a charter school will provide a second buffer between the Industrial/Business Park and the single-family residential areas. Community design elements include landscaping, berming, planting, entry monument, fence, lighting, parks, pedestrian and bicycle circulation. Treatment along adjacent arterial roads and the internal major collector create the window and the first impression of the West View Parks community. It is intended that treatment along these roadways (landscaping, planting and berming) be designed and integrated in a way to demonstrate the quality and community concept for West View Parks. Entry signage will be an integral part of the landscaping design and therefore will have a uniform appearance throughout West View Parks. Landscape design for the arterial and major collector roadways will be presented at the time of preliminary platting for each parcel and will include similar features and plant material throughout the development. The open space features within West View Parks is 9+ acres (approximately 10%to 15% of the property) in addition to the Godding Ditch, comprised of both natural open space areas and developed play areas to respond to the recreation needs of the community. The Godding Ditch traverses West View Parks from the northwest to southwest and may provide passive recreation opportunities for bikers,hikers, and pedestrians in conjunction with complementary development in adjoining parcels. The design of residential uses adjacent to the Godding Ditch will be done in such a manner so as to encompass the openness of the ditch into development parcels,through the use of view corridors and trail access points. West View Parks will include a community sports park for active play areas, including a family recreation sports facility large enough to include baseball/softbalUsoccer and other compatible youth and family sports recreation uses. A public charter school may also complement the recreational sports facility. Other pocket parks and passive open space areas are to be located throughout the community in varying sizes to respond to the daily recreation needs of the residents and will be more fully evolved with the platting of individual sites. Building in the Frederick area would provide us an opportunity to create a quality, master-planned community that reflects the rural character and family oriented lifestyle of the Frederick community. A family Limited Liability Limited Partnership consisting of myself, my wife Margaret and our three children has been formed to plan the subdivision and complete the development of the property. We plan to sell lots to individual builders as well as groups of lots to tract homebuilders. The goal is to assure a mixture of housing types and styles throughout the development. There are two working oil and gas wells on the property; these sites will be integrated into the industrial/commercial portion of the development. We plan to plat the property within ninety days after annexation. We anticipate that the property will be developed in three or more phases over the next one to ten years. Phasing will be market driven and we anticipate full development completed by 2010. Maps and overlays as required for annexation are attached. Dillon, General Partner, the undersigned landowner, in accordance with Colorado law, hereby petition the Town of Frederick and its Board of Trustees for annexation to the Town of Frederick of the following described unincorporated territory located in the County of Weld, State of Colorado, to-wit: See legal description in Exhibit A, attached hereto and incorporated herein by this reference. Not less than one-sixth of the perimeter of the area proposed to be annexed is contiguous with the Town of Frederick or will be contiguous with the Town of Frederick within such time as required by C.R.S. Section 31-12-104; b. A community of interest exists between the area proposed to be annexed and the Town of Frederick; c. The area proposed to be annexed is urban or will be urbanized in the near future; d. The area proposed to be annexed is integrated with or is capable of being integrated with the Town of Frederick; e. No land within the boundary of the territory proposed to be annexed which is held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate, has been divided into separate parts or parcels without the written consent of the landowner or landowners thereof, unless such tracts or parcels were separated by a dedicated street, road or other public way. f. No land within the boundary of the area proposed to be annexed which is held in identical ownership, comprises twenty acres or more, and which, together with the buildings and improvements situated thereon has an assessed value in excess of two 1 hundred thousand dollars ($200,000.00) for ad valorem tax purposes for the year next preceding the annexation, has been included within the area proposed to be annexed without the written consent of the landowner or landowners. g. No annexation proceedings have been commenced for any portion of the territory proposed to be annexed for the annexation of such territory to another municipality. h. The annexation of the territory proposed to be annexed will not result in the detachment of area from any school district. i. The annexation of the territory proposed to be annexed will not have the effect of extending the boundary of the Town of Frederick more than three (3) miles in any direction from any point of the boundary of the Town of Frederick in any one year. j. Prior to completion of the annexation of the territory proposed to be annexed, the Town of Frederick will have in place a plan for that area, which generally describes the proposed: location, character, and extent of streets, subways, bridges, waterways, waterfronts, parkways, playgrounds, squares, parks, aviation fields, other public ways, grounds, open spaces, public utilities, and terminals for water, light, sanitation, transportation, and power to be provided by the Town of Frederick; and the proposed land uses for the area; such plan to be updated at least once annually. k. In establishing the boundary of the territory proposed to be annexed, if a portion of a platted street or alley is to be annexed, the entire width of the street or alley has been included within the territory to be annexed. The Town of Frederick will not deny reasonable access to any landowners, owners of any easement, or the owners of any franchise adjoining any platted street or alley which is to be annexed to the Town of Frederick, but is not bound on both sides by the Town of Frederick. 3. The owners of more than fifty (50) percent of the area proposed to be annexed, exclusive of dedicated streets and alleys, have signed this petition and hereby petition for annexation of such territory. 4. Accompanying this petition are four copies of an annexation map containing the following information: a. A written legal description of the boundaries of the area proposed to be annexed; b. A map showing the boundary or the area proposed to be annexed, said map prepared and containing the seal of a registered engineer; c. Small Town, Rural Character The master concept plan for the Dillon Annexation (to be identified as "West View Parks") calls for individual clusters and neighborhoods of varying lot sizes and product types. A small area adjacent to the 1-25 frontage road is being identified as either industrial or business use. The P.U.D. concept provides for community clusters of not more than 40 acres each in the overall master plan. Natural greenbelts and a community sports recreational park(soccer/baseball) will buffer the residential neighborhood from the industrial/business park area adjoining the frontage road of Interstate I-25. The rural character of the planned development community is enhanced by the open greenbelts connecting to the community sports park and the Godding Ditch area. The focus of the internal street patterns is a small park in the center of a roundabout roadway connecting the various neighborhood communities within the master plan as referenced on the conceptual plan. This central sports facilities park area will be inviting and recognizable and will include both active and passive facilities for youth and family recreational activities, community gatherings and meetings. B. Diversity Our goal is to have a master planned community that provides a variety of lot sizes and different housing types to encourage diversity as indicated on the conceptual plan. Both the small and large lot communities will provide for social and economical diversity of housing. Our intent is to provide the diversity of housing types in accordance with guidelines established by the Town of Frederick. Attractive product designs will be more fully developed during the platting stage. The rural character of this development will most likely not have rental types of properties. C. Economic Development This development is in proximity to the 1-25 and Highway 52 interchange providing access both to Frederick and major transportation corridors in the area. West View Parks is also adjacent to land previously annexed for future mixed use industrial/business/residential property and adjacent to industrial property directly to the east of 1-25. This business corridor will provide jobs that will in turn provide housing opportunities for employees adjacent to the industrial areas along the west side of this corridor adding to the economic base of Frederick. D. Transportation Future planning calls for the widening of the 1-25 corridor at the Highway 52 interchange to three lanes to be rebuilt in the near future. There will be several access points into both the industrial and residential areas of the development to control traffic flows. E. Parks, Open Space, Recreational Within the West View Parks development, natural greenbelts and community sports recreational parks will buffer the residential neighborhood from the industrial/business park. The Godding Ditch may be utilized in the future as a bike path or walkway to connect to other recreation facilities in areas of the adjoining communities. A central sports park(baseball/softball/soccer field complex will enhance the healthy family oriented atmosphere of the community. This central sports park area will be inviting and recognizable to all residents and will include both active and passive facilities for youth and family recreational activities, community gatherings and meetings. Additionally, open space is planned to encompass areas that are currently utilized for unobtrusive oil production facilities. F. Environmental Issue The industrial/business park section of West View Parks will be located adjacent to the frontage road on the west side of 1-25 and should experience absorb traffic noise. A central sports park (baseball/softball/soccer field complex in addition to a potential public charter school or similar facility will provide a buffer between the business/industrial park and the residential community. Active pocket parks and natural greenbelt areas will be incorporated throughout the community. Xeriscaping will be incorporated into our landscaping plans which will be detailed in the platting process. Several oil and gas wells are located on the property, and it is our desire to plug and abandon all inactive wells. However, if that is not possible, we will work with the Town of Frederick on safety and screening standards. An independent geotechnical engineer will perform soil testing for the community and an individual soil and foundation design study will be prepared for each lot. G. Cultural. Historic and Educational There are no historical buildings located on this property. Future proposed school sites are not within property boundaries. This central sports park area will be inviting and recognizable to all residents of Fredrick and will include both active and passive facilities for youth and family recreational activities, community gatherings and team sports recreation activities. 2 PROJECT INTENT AND VISION STATEMENT for DILLON ANNEXATION for West View Parks The Dillon Annexation (West View Parks) is intended to be a master planned residential and industrial development encompassing approximately 72 acres immediately north of Weld County Road 20 and west of the 1-25 Frontage Road. Our goal is to provide a community living environment for people who desire to live in a small town with rural character by planning our development to include a variety of housing and industrial opportunities: estate lots, single family detached, business and industrial parcels located adjacent to both natural and active open space opportunities. A non-profit homeowners association will be formed to manage the affairs of the property and to oversee the implementation of the covenants established for this community. The Association will be responsible for maintaining all open space. An Architectural Control Committee and Association Board will ensure the overall quality and character of the community is maintained. The road access throughout the community will be designed to provide for safe neighborhoods and reduced traffic speeds. The West View Parks community proposes rural residential street standards that will be designed to enhance the character of the community. The intent of the West View Parks plan is to design more pedestrian friendly streetscapes that compliment, not dictate, good neighborhood design. The open space features within West View Parks is 9+ acres (approximately 10%to 15% of the property) in addition to the Godding Ditch, comprised of both natural open space areas and developed play areas to respond to the recreation needs of the community. The Godding Ditch traverses West View Parks from the northwest to southwest and may provide passive recreation opportunities for bikers, hikers, and pedestrians in conjunction with complementary development in adjoining parcels. The design of residential uses adjacent to the Godding Ditch will be done in such a manner so as to encompass the openness of the ditch into development parcels, through the use of view corridors and trail access points. Building in the Frederick area would provide us an opportunity to create a quality, master- planned community that reflects the rural character and family oriented lifestyle of the Frederick community. COMMUNITY DESIGN ELEMENTS Community design elements will create the visual amenities that will contribute to making West View Parks a cohesive, well planned community. An Industrial/Business park will encompass the Interstate Frontage, creating a buffer from the interstate traffic. The sports park and potentially a charter school will provide a second buffer between the Industrial/Business Park and the single family residential areas. Community design elements include landscaping, benning, planting, entry monument, fence, lighting, parks, pedestrian and bicycle circulation. Treatment along adjacent arterial roads and the internal major collector create the window and the first impression of the West View Parks community. It is intended that treatment along these roadways (landscaping, planting and berming) be designed and integrated in a way to demonstrate the quality and community concept for West View Parks. Entry signage will be an integral part of the landscaping design and therefore will have a uniform appearance throughout West View Parks. Landscape design for the arterial and major collector roadways will be presented at the time of preliminary platting for each parcel and will include similar features and plant material throughout the development.
