Our comments and requirements are as follows: External Roads: WCR 31 is designated as local road in the Weld Couity Comprehensive Transportation plan. The road presently has the required 60 feet of right-of-way. The existing irrigation structure may limit sight distance at the entrance to this subdivision. The developer shall submit a sight distance study for this structure for review before the final pia- will be signed Internal Streets: Internal local streets require 60 feet of right-of-way. Cul-de-sacs require a 65 foot right-of-way radius with a 50 foot edge of pavement radius. The southern most curve does not allow two vehicles to pass. The developer Shall flatten the curve or widen the pavement through this curve (see AASHTO, Widths for Turning Roadways). The developer is encouraged to call the Public Works department to discuss alternatives AUtility Easements: A fifteen (15) foot perimeter and ten (10)foot lot line easement is required for utilities. This shall be corrected before the final plat will be signed. Drainage: The drainage statement was submitted and is accepted. Traffic Report: A traffic impact study is not required. The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service. Water will be provided by the North Weld County Water District and sewer will be provided by septic systems. The proposed lot sizes (minimum of 1.1 acres) and the overall density of one septic system per 2 5 acres meets current Departmental policy. The environmental impact plan provided in the application materials and required in section 6.3.1 of the PUD Ordinance appears to address all potential impacts described in the Ordinance. I3oring information on each lot was submitted to the Department for review. According to the geotechnical report from Horizon Construction Services, LLC dated November 10, 1998 Lots 1 2,3,and 5 may require shallow and/or engineered septic systems because of groundwa:er or claystone. Groundwater was found between 3.5 and 5.5 feet below the surface on Lots 1,2 and 5. Claystone was found at 4 feet on Lot 3. Percolation tests results were submitted in a report dated January 31, 2000. Percolation test results indicate Lots 1,2, and 3 will require engineer design systems. Percolation test results coupled with maximum seasonal high groundwater conditions will require that each system be engineer design or have shallow placement. This information along with the setback requirements between each absorption field and the Eaton Ditch also limits the area available for installation of the absorption fields, and may influence the size of the homes. The Department recommends that the following items be place on the Plat as 2. condition of approval 1. Primary and secondary septic system envelopes and a building envelope were not designated on each lot. Septic system envelopes should meet the setback to the Eaton Ditch as well as other required setbacks as described in the Weld County Individual Sewage Disposal System Regulations 2. Language for the preservation and/or protection of the second absorption field envelope in the development covenants. The covenants should state that activities such as landscaping (i.e. planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt mounds, etc.) are expressly prohibited in the designated absorption field site. 3. Each septic system shall be designed for site-specific conditions, including but not limited to maximum seasonal high groundwater, poor soils, and shallow bedrock. Ditch Maintenance Easement. The ditch has historically asserted tl e position that it has an easement 25 feet wide from the edge of the ditch outward. This is simply the minimum amount of space that is needed to operate equipment which periodically or occasionally must be used to physically maintain the ditch and provide reasonable access for ope•ation of the ditch by our superintendent. As you may be aware, we have litigated this issue in the past and have been upheld at the trial court level that the ditch itself carries with it this prescriptive easement sufficient to maintain the ditch. 25 feet has been the minimum amount that we believe essential to rnaintenance. The plat drawing submitted shows a distance of 25 feet from the centerline of the ditch to the edge of the subdivision's 60-foot wide street right-of-way. Within this 25 feet has been identified a 10-foot"ditch road"which also appears to contain a 5-foot wide trail. We have a major problem with any trail construction or designation within our 25-foot maintenance and construction easement. In theory, you would think they could co-exist, and maybe in some instances they can. However, when we're out there with a backhoe digging out the ditch and piling dirt on the neighbors' trail, they get pesty, thinking that we do not have the right to interfere with their trail use. 'There are large elements of incompatibility between the long historic agricultural ditch operation and urbanization. It simply always works best if all elements of development can be kept as far away as possible from the ditch and certainly not within the 25-foot easement on either side of the ditch from the edge of the ditch outward. Proper building permits shall be obtained prior to any construction or excavation. 2. Building permits are required for any accessory buildings being constructed or moved onto the property. 3. Any buildings placed in the proposed park area will require engineered drawiags, building permits, and plan reviews. 4. A preliminary report from Terracon indicates the possibility of the presence of collapsible and/or expansive soils and expansive bedrock. Building sites may also contain shallow ground water. Basement or crawlspace foundations may not be feasible for all sites. All principal dwellings or buildings of public access will be required to be engineered with these concerns in mind. Such foundation design shall be based on a site-specific geotechnical report or an "open hole" inspection made by a Colorado licensed engineer. 5. All fill materials upon which buildings or structures rest, shall be compacted to a minimum of 90% of maximum density. Detrimental amounts of organic material shall not be permitted in fills. No rock or similar irreducible material with a maximum dimension greater than 12 inches shall be buried or placed in fills. A compaction report will be required in such situations. 6. All buildings or structures shall maintain distances from property lines and adjacent buildings as outlined in Table 5-A of the 1997 Uniform Building Code. 7. At the time an application is accepted for a building permit a plan review will be done, A complete review of the building or structure may reveal other building issues or areas reeding attention. The proposal is to create five lots on 12.7 acres. The average lot size will be approximately one acre. Slope gradients at the site range from approximately 3 to 9 percent. The site has previously been farmed and irrigated. The Eaton Ditch forms the western site boundary. The site will be served by public water and individual septic systems. According to the Natural Resources Conservation Service Soil Survey of Weld Conn y, Colorado, Southern Part, 1980 the site is underlain by loam to clay loam soils that have variable soil properties. The eastern portion of the site contains loam soils that were formed in alluvial and/o-eolian deposits. The soil survey indicates that the loam may be of low strength and prone to excessive settlement upon loading and/or wetting. The western portion of the site contains clay loam soils that was formed from the underling shale bedrock. The soils have a moderate to high shrink swell potential and can also be of low strength. Runoff is moderate to rapid and erosion can be of concern. It will be important that adequate erosion and sediment control be used during site development. It will take some time for the site to fully develop and it will be important that the entire site be seeded with a permanent vegetative cover during the development phase. The survey indicates that the clay loam soils may have severe limitations for the installation of septic systems because of shallow depth to bedrock and slow percolation. It will be important that individual percolation testing be done for each lot. Because of the adjacent ditch, history of irr gation and shallow bedrock it is possible that the site has shallow ground water that can affect the construction of septic systems and basements. A report titled "Environmental and Engineering Geology of the Windsor Study Area, Larimer and Weld Counties, Colorado, Colorado Geological Survey, 1987" shows that the site is underlain by sandy loess soils that may be prone to settling when loaded and wetted; low to moderate swell potential. The soils overlie the Laramie Formation. The Laramie is composed of sandstone, siltstone, stale (claystone) and coal. Clays within the formation can have a high swell potential. 7 Ms. Julie Chester Page 2 January 7, 2000 A preliminary mineral evaluation of the site done by Terracon indicates that the site contains 1 to 15 feet of clayey sand and sandy clay that overlie claystone and siltstone bedrock. The report does not contain any test borings or geotechnical information and was done for a mineral evaluation and not for a geotechnical subdivision evaluation. The primary constraints to development of the site will be collapsible and/or expansive soils and expansive bedrock. The site may also contain shallow ground water that may require the installation of interceptor drains or prohibiting the use of below grade or basement construction. Special septic system designs may be required to prevent ground water contamination. Because detailed subsurface information and test data was not submitted with the application, it is difficult to determine whether or not lot or building envelope layout may be affected by possible constraints. In required, interceptor drains would need to be installed during site development rather than during individual lot development. It may be prudent for the county to require that a geotechnical evaluation be done prior to approval of final plans_ Individual soils and percolation testing should be required for each lot prior to issuance of building permit. The cover letter with the submittal indicated that the site has been previously reviewed by the Colorado Geological Survey. I could not find any record of a recent previous review and have not been provided with a copy of any such review by the applicant. Resubmittals are billed at a lesser rate and I would be happy to adjust the review fees accordingly, prior to payment, if proof of a recent rev ew can be provided.
