HomeMy WebLinkAbout841037.tiff i Z RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 699 - KEITH SADLER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 699 , does not come within the purview of the definition of the terms, "sub- division" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 699 was sub- mitted by Keith Sadler for property located in Part of the SW', Section 33 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided,by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS, the request is to divide the property into parcels of 81. 84 acres and 1. 106 acres, more or less, in order to correct an illegal land split. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The parcel of land on which this request is being made is described as Part of the SW1, Section 33, TIN, R66W of the 6th P.M. , Weld County, Colorado. The property is located 11 miles east of Brighton on Weld County Road 29. The property contains approximately 83 acres of Class IIe (prime) , IIIe (prime) , Tye irrigated and IVe, Vie nonirrigated soils. The parcel of land under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 81.84 acres and 1.106 acres, more or leas. Dr. Sadler would like to correct an illegal lot split in order to obtain a building permit for the 81.84 acre parcel. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2C. of the Weld County Subdivision Regulations submission requirements; and 2. The request complies with Section 9-2E. of the Subdivision Regulations as follows: The 83 acres, more or less, under consideration will be compatible with the existing surrounding land uses and with future development of the surrounding area as permitted by the existing zoning. The proposal is also consistent with the intent of the "A" Agricultural Zone District on which it is located. The proposal was reviewed by the city of Brighton and was found to comply with their long-range Comprehensive Plan. Board of County Commissioners Page 2 - The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan. Therefore, the proposed use is consistent with efficient and orderly development. - The proposal does not exist in an overlay district area. - The proposed lots meet minimum lot size requirements for land division. - The Colorado Division of Water Resources has indicated adequate water service is available for this proposal. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The two lots proposed will have adequate access from Weld county Road 29 and a private access road in the Bil-Lar Subdivision. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. DENVER.COLORADO S0204 5949775 June 26, 1984 Weld County Department of Planning Services 915 Tenth Street Greeley, Colorado 80631 Re: Recorded Exemption Application Dear Sir: This property was inadvertently divided in November, 1972 and apparently was in variance with the Weld County Comprehensive Plan in effect at that time. The reason for the division at that time was the sale of the house which was on the property with the re- tention of the remaining farmland. Now answers to specific questions will be given. Answer to Question 4 : The reason for the division was to sell the house with the approximately one acre of land associated directly with the house and the retention of the 80 some acres of remaining land as farmland without a residence on it. Question 5 : This proposed division I think, is consistent with the policies of the Weld County Comprehensive Plan. The house itself which was sold, is actually physically a part of the Bilmar Develop- ment and is surrounded by other residences although it never was formally apparently divided from the farmland and incorporated into the Bilmar Development. Question 6 : The proposal is consistent with the intent of the zone district in which the subject's property is located. Question 7 : The house in question had been sold some twelve years ago with the acre or so of land with it. The intent at this time is to build a second residential structure on the remaining 80 acres without further division of that 80 acres. el_11.037 Re: Recorded Exemption Application Page two Question 8 : The uses of the two plots will be continued agricul- tural purposes on the larger portion, that is the 80 some acres, and normal residential uses of the one acre which has been sold with the farm. This I feel will be compatible with the future development of the surrounding area, especially since the parcel already separated has been since its onset, a physical part of an already developed section. Question 9 : This proposal will not be inconsistent with efficient and orderly development since no further development of the 80 acres is planned with the exception of one residence to be built on it. Question 10: The house which was sold has its well and septic system now in effect some seventeen years. Attached is a copy of the well permit and the septic permit which has been obtained for the structure to be placed on the 80 odd acres. Question 11: This property is not located in a flood plain, geo- graphic hazard and/or Weld County Airport overlay district.
