Tuesday, August 1, 2000
A regular meeting of the Weld County Planning Commission was held Tuesday,August 1, 2000, in the Weld
County Public Health/Planning Building,(Room 210), 1555 N. 17th Avenue, Greeley,Colorado. The meeting
was called to order by Chairman, Cristie Nicklas, at 1:35 p.m. -

The summary of the last regular meeting of the Weld County Planning Commission held on July 18, 2000,
was approved with a spelling correction on page 5.
CASE NUMBER: Ordinance 119-P
PRESENTER: Dave Sprague
REQUEST: Changes to Ordinance 119-P concerning engineered buildings being allowed as Ag exempt
buildings and small grammatical changes.
Dave Sprague, Weld County Building Official, presented the changes to Ordinance 119-P. Dave noted that
these changes include grammatical changes, rewording for easier understanding in certain sections, and a
change to the Agriculturally Exempt buildings. Dave stated that the Building Trades Advisory Board has
agreed with these proposed changes. Dave stated that a definition for Groundset has been added to Section
11. Dave also noted that the change to the agriculturally exempt buildings allows those buildings that need
engineering to be exempt from building permits. Dave noted that if these buildings were to change in use,
they may require an engineer to sign off on the structure at a later date.
Stephen Mokray asked how the Building Trades Advisory Board (BTAB) felt about the removal of this
requirement. Dave noted that the BTAB likes the lessening of requirements for builders. Cathy Clamp asked
if the possibility of future additional engineering being required is stated on the Certificate of Compliance
(COC)form. Dave noted that the form does note that a change in the use of the building may bring additional
costs for the correct permits. Cathy asked about the changes to the attachment of mobile homes together.
Dave noted that the definition now states that no more than two may be attached for a single family dwelling.
The Chair asked if there was anyone in the audience who wished to speak for or against these ordinance
changes. No one wished to speak.
Jack Epple moved that the changes to Ordinance 119-P be forwarded to the Board of County Commissioners
with the Planning Commissions recommendation of approval. Stephen Mokray seconded the motion.
The Chair asked the secretary to poll the members of the Planning Commission for their decision. John

CASE NUMBER: Z-546
APPLICANT: J. Quarter Circle Company
PLANNER: Julie Chester
LEGAL DESCRIPTION: Part of the N2 of Section 32, Township 6 North, Range 65 West of the 6`h
P.M., Weld County, Colorado.
REQUEST: Change of Zone from R-1 to 1-3.
LOCATION: South of and adjacent to WCR 64 ("O" Street), Northeast of U.S. Highway 85.
Julie Chester, Planner, presented Case Z-546 for a change of zone from R-1 to 1-3. Julie noted that an
application for a Site Plan Review will be required before development will occur on these sites. Julie noted
that specific conditions will be placed on the lots during this process. Julie also noted that the surrounding
area has several comparable land uses and that the residences in the area have a natural buffer between
them and the site. Julie stated that the Department of Planning Services is recommending approval of this
application.
Cristie Nicklas noted that there is a pending Recorded Exemption on the land. Julie noted that the Recorded
Exemption has been approved and just needs to be recorded. Cristie asked if both lots will have tie new
zoning on them. Julie noted that both lots would have the new zoning. Jack Epple had questions concerning
the airport in the area. Julie noted that the development of the property would be required to comply during
the SPR process.
Bruce Johnson, Applicant, noted that he is looking to sell one of the properties to Fred Otis, who would like
to speak concerning the application as well.
Fred Otis noted that he is planning on purchasing one of the lots.
The Chair asked if there was anyone in the audience who wished to speak for or against this application. No
one wished to speak.
Fred Otis did state questions concerning the addition of Conditions of Approval #2 D and #2 E. Mr. Jtis felt
that D is dealt with in separate conditions and did not want to clutter up the plat. Julie noted that she did not
feel this would be a problem. Mr. Otis also had a question concerning Condition of Approval E, as it notes
requirements of the Greeley/Weld Airport to be addressed. Discussion covering the condition followed. Lee
Morrison noted that the Greeley/Weld Airport is not a regulatory board,that the FAA and the Zoning Ordinance
addresses concerns in the Greeley/Weld County Airport Overlay District.
Bryant Gimlin moved to delete Condition of Approval#2 D and the words"Greeley/Weld County Airport and
the", be removed from Condition of Approval#2 E and this condition be moved under Condition of Approval
#3. Stephen Mokray seconded the motion.
The Chair asked if the applicant and potential buyer were in agreement with the Conditions of Approval as
amended. The applicant and buyer stated they are in agreement with these changes.
The Chair asked the secretary to poll the members of the Planning Commission for their decision. John

Bryant Gimlin moved that Case Z-546 be forwarded to the Board of County Commissioners along with the
amended Conditions of Approval with the Planning Commissions recommendation of approval. Stephen
Mokray seconded the motion.

Stephen Mokray commented that he feels this transition from Residential Zoning to Industrial Zoning is too
sudden for surrounding property owners. He also commented that the loss of Prime Farmland, even if it is
already zoned residential, is an important thing to note.
CASE NUMBER: USR-1277
APPLICANT: Earth Balance, Inc.
PLANNER: Robert Anderson
LEGAL DESCRIPTION: Lot A, RE-889,Part of the SW4/NE4 of Section 3,Township 4 North, Range
67 West of the 6th P.M., Weld County, Colorado.
REQUEST: Site Specific Development Plan and Special Review Permit for the Mixing, Blending,Storage
and Wholesale of Herbal Products in the A(Agricultural)Zone District.
LOCATION: North of and adjacent to WCR 48 '/2 and 1/3 mile west of SH 257.
Robert Anderson,Planner,presented Case USR-1277 and read the recommendation into the record. Robert
noted that the Department of Planning Services is recommending approval of this application.
John Folsom asked if the deed for the land is acceptable for this application by the applicant as the owner is
deceased. Robert noted that there is a letter from the estate authorizing Anita Comer to apply.
Anita Comer, Applicant, noted that she is running her sister's business and they are trying to come into
compliance.
Cathy Clamp asked if there are any pharmaceuticals, such as caffeine, being added to the nutritional
supplements being produced at the site. Anita noted that they are not at this time, but that they may in the
future if a client requests it. Concerns about needing a referral from the FDA arose. It was noted that Robert
Anderson, the planner, will send a referral to the appropriate agency before the Board of County
Commissioners hearing for this case.
The Chair asked if there was anyone in the audience who wished to speak for or against this application. No
one wished to speak.
Anita had some questions concerning screening of the business, with deliveries once a day, which wit he
answered by the Department of Planning Services.
Cathy Clamp moved that Case USR-1277 be forwarded to the Board of County Commissioners along with
the Conditions of Approval and Development Standards with the Planning Commissions recommendation of
approval. Stephen Mokray seconded the motion.
