The Department of Planning Services' staff is recommending the deletion of 2.D. 15) which states
"Effective December 1, 1999, Building Permits issued on the proposed subdivision lots shall be
required to adhere to the fee structure of the Windsor Service Area Road Impact Program.
(Ordinance 210)". This condition and note was included, but is not necessary because it was
determined that this proposal is not within the Ordinance 210 area.

We would like to resolve all the concerns the Larimer & Weld Irrigation Company
has regarding our proposed subdivision. We fully support the ditch company's
need to maintain the ditch.
First, we will relocate the trail to the east side of the internal road. I believe this
should resolve your major concern.
Second, please look at the plot drawing again. Pay attention to the locations of
the arrowheads that show the location of the recorded ditch easement. You
should be able to see that the 10-foot "ditch road" is outside of the recorded ditch
easement. The ditch company created this "ditch road" in the spring of 1983. We
have allowed the ditch company to use this space outside of its recorded
easement because we fully support the company's need to maintain the ditch.
Showing the 10-foot "ditch road" on the plot drawing and addressing ditch
maintenance in the covenants and home owners association rules will allow the
ditch company permanent use of that space outside of the recorded easement.
We hope this information demonstrates our support of the Larimer & Weld
Irrigation Company. We want to be good neighbors. We also hope this will
resolve all of the company's concerns. If it doesn't, please contact us so we may
further negotiate any problems.
