The information will be presented with the intent to request a waiver or determination about the five year time period relative to the purchase date of this property. The following is a brief outline of the situation. a: RE 1053 was recorded December 18, 1987 in Book 1 180 as Reception Number 02125414. This exemption created Lot A containing 11.000 Acres and Lot B containing approximately 153 acres. b: The boundary of Lot B of RE 1053 was amended by the plat recorded May 2, 1991 in Book 1297 as Reception Number 02248916 to contain approximately 160 acres. This amendment was done in conjunction with Subdivision Exemption No. 327 which was recorded May 2, 1991 in Book 1297 as Reception Number 02248915. The property owners who completed the above RE and SE were William F. and Toni M. Wickersham. c: Wickersham deeded a parcel of land to Mark D. and Michelle D. Young as recorded August 29, 1994 in Book 1457 as Reception Number 2404424. The property was described by a metes and bounds description and consisted of Lot A of RE 1053 and a portion of Amended Lot B of RE 1053. There was however no mention of the underlying RE. d: Wickersham deeded a parcel of land to Hoshiko Farms, Inc. as recorded December 29, 1994 in Book 1473 as Reception Number 2420767. Lohmann, Jeffery Alan Nissen and Robin J. Nissen deeded their parcel of land to Jeffery Alan Nissen as recorded May 14, 1999 as Reception Number 2694070. g: Jeffery Alan Nissen deeded his parcel of land to LJR Farms, LLC. as recorded June 10, 1999 as Reception Number 2699672. h: Mark D. and Michelle D. Young applied for a RE on their property, which was approved as RE 2603 on November 17, 1999. Their request was to divide their property into a configuration consisting of Lot A containing approximately 11 acres and the remaining property to consist of Lot B. Mr. Young contacted me at King Surveyors, Inc. to completed the surveying for the approved RE 2603. As I had completed the original underlying RE 1053, I was aware of it's existence. I informed Mr. Young that subject to the information recovered during my research I believed that his proposed Lot A already existed. I completed my research and determined that RE 1053 was still in place and that his property description actually contained the existing Lot A and a portion of Amended Lot B of RE 1053. Based upon this information it wasn't necessary to complete this RE. I did inform Mr. Young that I believed the Planning Department however would require the completion of some type of RE to correct the existing situation. Upon bringing the above information to the attention of Ms. Julie A. Chester of the Planning Department they conducted their own research into the situation. The final determination was that the underlying RE 1053 was still in place and that the division of Amended Lot B of RE 1053 constituted an unapproved division of the property. The planning department voided the previously RE 2603 and approved RE 2693 for the purpose of correcting the division of Amended Lot B of RE 1053. This obviously would require that the existing property owners being Mark D. and Michelle D. Young and LJR Farms, LLC would both have to participate and sign the final drawing. I contacted the owner of LJR Farms, LLC. who was Mr. Nissen regarding the situation. I eventually spoke with Mr. Michael J. Pipis, Esq., who is council for LJR Farms, LLC and detailed for him how we had arrived at the current situation. I eventually met with Mr. Nissen on the property after the completion of the survey for RE 2693. Mr. Nissen expressed his concern regarding his ability to request a RE on his property if he were to sign the current drawing. This based upon the current ten year waiting period. I explained to Mr. Nissen that the county would not approve any type of addition division of this property until the existing situation was resolved. Page 2 of 3 • • Mr. Nissen requested that I try to obtain a determination from the planning department to see if the current situation could be grandfathered back to the time when the current situation was created, which was August 29, 1994 when Wickersham deeded to Young. Based upon that date the county only required a five year waiting period before additional requests for RE's would be the controlling factor. I have spoken with Ms. Chester of the planning department, who has informed me that they cannot make that determination. She stated that it would be necessary to present this situation to the County Commissioners for a decision in this matter. I am therefore requesting the opportunity to present this information to the Weld County Commissioners during a work session at their earliest convenience. It is my understanding from my coversation Mr. Nissen that he will be reluctant to sign the current RE 2693 because of the ten year waiting period before he would be allowed to apply for another RE on his property. If this is in fact the case Mr. Young will be unable to divide his property as was originally approved by RE 2603. I would appreciate any assistance that you can give me in this matter to expedite the final resolution of this issue. I would be happy to answer any questions that you may have regarding this matter. Flood Plain Policy Septic systems will not be allowed to be located in the floodway. Septic systems will be allowed in the flood plain, but the system must be installed in a manner as to prevent the infiltration of groundwater into the septic tank and to prevent the release of sewage from the tank during a flood event. If the tank is above the flood plain elevation, no special installation requirements would be necessary. If the tank is not above the flood plain elevation then the access to the tank manhole lids must be covered with 20 mil PVC and sealed with plumbers cement. When the seal is broken, i.e. the tank is opened for pumping, etc., the tank must be re-sealed prior to backfilling again. A backflow preventer or one-way valve, must also be installed in the effluent line between the tank and the absorption field. All other percolation and suitable soil criteria must be met for a conventional septic system to be installed. For inspection purposes, the materials to seal the manhole lids must be on site. The City of Greeley Planning staff has reviewed the application for a recorded exemption from Mark and Michelle Young, located north of and adjacent to WCR 58 and west of and adjacent to WCR 49 section line and wish to forward the following comments. Resolution 7, 1985 by the City of Greeley Planning Commission gave administrative review authority to the Greeley Planning staff for review of recorded exemptions (RE). The resolution indicates we cannot recommend approval on any application where the overall gross density exceeds one dwelling unit per 20 acres outside of the 2010 growth ring. Since this application creates two lots through the exemption process on a 160 acre parcel, we can recommend approval of the request based on Resolution 7. The Greeley Public Works Department noted a reservation of a minimum of 50' of right-of-way from the centerline of WCR 58 would be appropriate to facilitate future development of this area if the proposal is approved. Also, the appropriate setbacks under the applicable zone should also be maintained within the subdivision.
