RE: GRANT REQUEST TO PRE-ADVERTISE CHANGE OF ZONE #540 - JIM AND
BONNIE BATES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has received a request from Jim and Bonnie Bates, Route 2,
36961 Weld County Road 31, Eaton, Colorado 80615, for pre-advertisement of an application
for Change of Zone #540 from the A (Agricultural) Zone District to a PUD (Planned Unit
Development) District with five (5) residential lots and two acres of open space, and
WHEREAS, said property is described as Lot B of Amended Recorded
Exemption #2279, being part of the NE1/4 of Section 33, Township 7 North, Range 66 West of
the 6th P.M., Weld County, Colorado, and
WHEREAS, after study and review the Board deems it advisable to grant said request,
with the hearing date to be set as May 3, 2000, at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request from Jim and Bonnie Bates for pre-advertisement of
the application for Change of Zone #540 from the A (Agricultural) Zone District to a PUD
(Planned Unit Development) District with five (5) residential lots and two acres of open space
be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said
request be, and hereby is, set as May 3, 2000, at 10:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 3rd day of April, A.D., 2000.

COLORADO SUBJECT: Request for Preadvertisement
Jim and Bonnie Bates have submitted a request that the application for Change of Zone #540,
which will be heard by the Planning Commission on April 18, 2000, be preadvertised. If you wish
to approve this request, a hearing before the Board on May 3, 2000, will allow adequate time for
advertising.

The Department of Planning Services' staff is recommending a pre-advertisement for the above
referenced case. The case is scheduled before the Planning Commission on April 18, 2000 and
staff is requesting a Board of County Commissioner hearing date on May 3, 2000, if possible. A
letter from the applicant is attached.

Location: South of and adjacent to WCR 76, West of and adjacent to WCR 31
Parcel ID#: 070733000040 Acres: 12.8 acres
We are submitting an application for a Change of Zone for our five lot PUD
Subdivision, Coalbank Crest. We are requesting pre-advertisement in order to
expedite the process. We feel this request should be granted due to the previous
delays caused by the Department of Planning Services. I have been following the
recommendations of the Planning Department. This has caused me to re-design
the development twice. These re-designs have cost a year in delays and $30,000
in wasted expenses. It should be obvious this request is justified. Thankyou for
