RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST JOE AND ALICE BALDWIN FOR VIOLATION OF THE
WELD COUNTY BUILDING CODE ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Joe and Alice Baldwin, VI #9900271, are allegedly in violation of the Weld
County Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of August, 2000, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Joe Baldwin, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until October 8, 2000, to allow adequate time for the property owners
to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners cf
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Joe and Alice Baldwin to remedy the violation of the
Weld County Building Code Ordinance, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until October 8, 2000,
to allow adequate time for the property owners to bring the subject property into compliance.

May 11, 2000 Telephone call was made. Spoke w/Mr. Baldwin and notified him that we only needed
to get the FH DP to issue the COC and close the violation. 30 day verbal extension was
given to get certificate.
June 16, 2000 No response from Mr. Baldwin.
June 19, 2000 A site inspection was conducted.
June 23, 2000 A Violation was issued.
July 24, 2000 Received a call from Mr. Baldwin stating that he wanted to reso ve the isr ue and
needed a few days to get EHDP.
July 28, 2000 Sent BOCC Hearing Letter for August hearing.

Dear Mr. Baldwin:
The property located at 5050 WCR I remains in violation of the Weld County Building Code Ordinance. i
have scheduled a meeting with the Board of County Commissioners for August 8, 2000 , at 10:00 a.m. to
consider the violation occurring on the property. This meeting will take place in the County Commissioners
Hearing Room, first floor, Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. It is
recommended that you and/or a representative be in attendance to answer any questions the Board of fount,
Commissioners might have about the violation. This would be a prime opportunity for you explain all issue
regardir.g this violation. If you can contact me prior to the hearing and take care of this matter we wil L not
proceed with the hearing. If no contact is made, all plans will continue with the hearing.
The Depaitinent of Planning Services' staff will be recommending that the Board of County Commissi iners
authorize the County Attorney to proceed with legal action to remedy the violation if you and/or a
representative are not available. Our records indicate that you were made aware of the nature of the violation,
the action necessary to correct the violation, and that you were given sufficient time to remedy the no ation If

The building official has determined that the above described property(5050 WCR 1) is in
violation of Section 30 of the Weld County Building Ordinance. No building or structure regulated by
this code shall be erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted,
or demolished unless a separate building permit for each building or structure has been first obtainec
from the Weld County Building Inspection Department. In addition to the required permits, it is required
that you also comply with the Weld County Zoning Ordinance.
It is the intention of this office to assist and cooperate with you without imposing undue hardships:
however, we have no discretion in this matter. If you fail to correct this violation by July 23, 2000. i
will be scheduled for a hearing before the Board of County Commissioners to consider whether to refer
this violation to the County Attorney's office for legal action. You must come in and meet with one if
our planners to verify that you comply with all building and zoning issues and you must apply for the
appropriate permits and pay the total fee for the permit or get a Certificate of Compliance. At time c f the
inspection, it may be required for you to open sections of the living quarters to allow the building
inspectors access for inspection purposes.
Any information you have that may help to resolve this matter will be helpful. This office is ready -cc be

When I built my previous barn on the back half of my property, no permit or
permission was required. Assumed since it was still a legitimate barn ag
building, none would be required. I am faxing the `info' to give you enough
information to talk to the planner. You have been most helpful, thanks!
1. House, barn and current ag out building were all built in around 1960, not
elevated.
2. Property has flood insurance
3. Property is surrounded by a berm that is about a foot higher than the
flood datum line,
4. New barn building is being built over the top of existing ag building
(9X24).
Building will house 2 horses, tractor , hay/feed and tack.

3. Requirements of Section 52 of the Weld County Zoning Ordinance, Geologic Hazard Overlay District, (If
applicable), have been met.
4. Requirements of Section 63 of the Weld County Zoning ordinance, Flood Hazard Overlay Oistr ct,•

applicable), have been met.
5. Minimum setback requirements (Section 31.5.2), Wald County Zoning Ordinance, are 20 feet fro'n the

Dear Joe:
Thank you for your kind letter dated Sept. 7, 1999. My sincere apologies fo r not responding :sooner,
but I was on a business trip, returning from Alabama early this morning. In follow-up to your Sept. 7
communication, I am writing (via Fax) to request that you not issue a violation citation as you said
you would in your letter dated Sept 7, 1999.
Our justification for this request is as follows:
• The building in question is in fact a legitimate Agricultural Building. (horses, hay, full size tractor
and tack storage) Our property is zoned agricultural.
• Upon notification by Frank Ciacato on 8-31-99 we initiated the process to get an Ag Exenption
Certificate that same day. We have been in contact with two people at Weld County Planning
(Sharon and Planner Anne Johnson).
• Through the Weld Planning dept, It has been determined that we must have a flood hazard permit.
I have secured Engineer Jay Freese, of Greeley to work that problem. He has been on site, made
survey measurements and is working the details at this time. We are moving as quickly on this as
is possible.
At this time, we are working to rectify any Weld County process issues and will continue to prevail
on that process as quickly as possible. It is clear to me that under no circumstances is a building
permit required at this time for the Agricultural building. Therefore, it seems like a legitimate. and
reasonable request for us to ask you to hold in abeyance any punitive actions.
Weld County People have been polite, responsive and easy to deal with, even with difficult situations
like the one in which I find myself. We appreciate your immediate attention to this matter.

Subject: Building without an issued permit.
Dear Joe & Alice Jean:
I am writing this letter in reference to a no permit structure that was constructed on the property listed
above. There appears to be a built pole barn structure, in which we have no record of an issued permit,
which is a violation of Section 30 of the Weld County Building Ordinance. No building or structure
regulated by this code shall be erected, constructed, enlarged, altered, repaired, moved, improved.
removed, converted, or demolished unless a separate building permit for each building or structure has
been first obtained from the Weld County Building Inspection Department, to include electrical work. We
have not issued a violation at this time, buy if you fail to correct this violation by September 17. 1499, a
violation will be issued. Please come into our office located at 1555 North 17th Avenue
(located on 0 Street) to apply for the eet) to apply for the building permit and we also ask that you have all fina
inspections completed as soon as possible, once the permit has been issued.
