RE: VIOLATIONS OF THE WELD COUNTY ZONING ORDINANCE
A public hearing was conducted on September 19, 2000, at 10:00 a.m.,with the following present:
Commissioner Barbara J. Kirkmeyer, Chair

The following business was transacted:
I hereby certify that a public hearing was conducted to consider whether to authorize the County
Attorney to proceed with legal action against the individuals named for violations of the Weld
County Zoning Ordinance. Cases were heard as follows:
VI #0000218 - ROBERT AND LAURI DIETERLE: Joe Mendez stated this case has been closed.
In response to Commissioner Geile, Mr. Barker stated no Board action is necessary.
VI#0000157-BRADFORD RAEHAL(CON'T FROM 08/08/2000): Bethany Salzman, Department
of Planning Services, requested this matter be continued to October 10, 2000, at 9:00 a.m.
Commissioner Vaad moved to continue VI #0000157 for Bradford Raehal to October 10, 2000, at
9:00 a.m. Commissioner Baxter seconded the motion. In response to Commissioner Hall, Ms.
Salzman explained on August 8, 2000, she requested the matter be continued because she had
not received a certified receipt indicating Mr. Raehal had been notified. Ms. Salzman stated Mr.
Raehal was not given further notice of today's hearing, but he will receive notice for the October
hearing. The motion carried unanimously.
VI #9900312 - ADOLFO, HORTENCIA, JORGE, AND LUZ MUNOZ: Ms. Salzman gave a brief
description of the location of the site, and presented the case report for the record. She stated the
violation was started on September 9, 1998, regarding burning on the site, and on October 25,
1999,the matter was referred to the zoning compliance office to address issues regarding the large
amount of animals on the site and mobile homes without proper permits. Ms. Salzman stated she
and Mr. Mendez made various attempts to contact Adolfo Munoz in person; however, they only
spoke with his family members. She further stated they tried to contact Mr. Munoz by phone, and
they did receive a certified receipt of the notice for this hearing. Ms. Salzman stated the property
is in violation of Sections 32.2.1, 31.2.2, 31.3.9 of the Weld County Zoning Ordinance because the
site has numerous residences and derelict vehicles, motorcycles, one mobile home, and various
debris. Ms. Salzman reviewed a video of the property indicating the various violations. In response
to Commissioner Baxter, Ms. Salzman stated this property is located on Highway 392,east of Weld
County Road 55.

Mr. Mendez stated there are people currently residing in a mobile home that does not have a
Certificate of Occupancy, and there is a shed with electrical wiring that is not permitted. In
response to Commissioner Geile, Ms. Salzman clarified there are three technical violations which
deal with placing more than one dwelling unit on a parcel, a noncommercial junkyard, and building
code violations. Mr. Mendez stated they did obtain building permits for the mobile home; however,
the inspections were never called for and the other structure does not have permits. Responding
further to Commissioner Geile, Ms. Salzman stated she spoke to Mr. Munoz' daughter on
August 21, 2000, and Mr. Mendez stated he spoke with the son last Friday regarding today's
hearing.
Commissioner Geile confirmed that the persons allegedly in violation of the Weld Count Zoning
Ordinance and Building Code are not in attendance. No public testimony was offered concerning
this matter.
Commissioner Hall moved to accept staffs recommendation to refer VI #0000312 to the County
Attorney, for immediate action. Seconded by Commissioner Baxter the motion carried
unanimously.
Monica Mika, Director of Planning Services, referred to case summary indicating the number of
violation cases that have been closed and wished to commend the staff for dealing with these
issues rather than bringing them before the Board. She stated by addressing these violations,they
resolve health and safety issues.
In response to Commissioner Vaad, Ms. Salzman stated she had requested Mr. Munoz remove or
screen the derelict vehicles. Responding to Commissioners Vaad and Hall, Ms. Salzman stated
that although she did not speak with Mr. Munoz, she did speak with his family members who do
understand English and were aware of the violation issues. In response to Commissioner Baxter,
Ms. Salzman stated they have received reports and there was evidence that people are living in
the house, the mobile home that has not been inspected, the derelict mobile home, and in the
shed.
