RE: APPROVAL OF AMENDED RECORDED EXEMPTION #1870 - BO`r nrErt V E D
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat
known as Amended Recorded Exemption #1870, does not come within the purview of the
definition of the terms, "subdivision" and "subdivided land", and
WHEREAS, the request for Amended Recorded Exemption #1870 was submitted by
Boyd Meyer, 5413 E. Harmony Road, Fort Collins, Colorado 80525, for property which is
described as Lot B of Recorded Exemption 1870, located in Section 24, Township 6 North,
Range 67 West of the 6th P.M., Weld County, Colorado, being more particularly described in
the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be
recorded, in order to expand the size of Lot B of Recorded Exemption #1870, and
WHEREAS, this request is to divide the property into parcels estimated to be
approximately 9.2 acres and 44 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is,
exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Amended Recorded Exemption #1870
by Boyd Meyer is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic
system shall be installed according to the Weld County Individual Sewage
Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. All approved accesses shall be clearly shown on the plat.
B. State Highway 392 Is designated on the Transportation Map as a
principal arterial road, which requires 75 feet of right-of-way from the
centerline. The Colorado Department of Transportation has
jurisdiction over all accesses to State Highways. The 75 feet of right-of-
way shall be delineated on the plat.
C. The applicant shall provide evidence to the Department of Planning
Services that an access permit from the Colorado Department of
Transportation was granted for access to Highway 392 or evidence that
the applicant has complied with the requirements of the Colorado
Department of Transportation.

D. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum
setback and offset requirements for the zone district in which the
property is located. Pursuant to the definition of"setback" in the
Weld County Zoning Ordinance#89, the required setback is
measured from the future right-of-way line.
2) Any future structures or uses on site must obtain the appropriate
zoning and building permits.
3) Prior to the release of building permits the applicant shall submit
evidence to the Department of Planning Services that the lot has
an adequate water supply of sufficient quality, quantity and
dependability.
4) Prior to the release of building permits on Lot/or B, the applicant
will be required to submit a recorded deed describing the lot upon
which the building permit is requested with the building permit
application. The legal description on such deed shall include the
lot and recorded exemption number.
5) Should noxious weeds exist on the property or become
established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Ordinance #169-A.
6) The Right to Farm Covenant, as stated on Page 7-1 of the Weld
County Comprehensive Plan, shall be placed on the plat. '/
3. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall
be prepared in accordance with the requirements of Section 11.7 of the Weld
County Subdivision Ordinance. The plat shall be submitted within sixty (60) days
from the date of approval by the Weld County Board of Commissioners. The
applicant shall be responsible for paying the recording fees.

The Department of Planning Services' staff has reviewed this request and recommends that this request
be denied for the following reasons:
'I. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance
with Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance. as follows
a. Section 11.4.2.4- Consistency with the purpose of efficient and orderly development as expressed
in Section 1.3 of the Weld County Subdivision Ordinance.
1) Section 1.3.1 - Assisting orderly and integrated development. As a result of this amended
Recorded Exemption and RE-2578, also proposed by Mr. Boyd Meyer, on an adjacent parcel,
this amended Recorded Exemption (AmRE-1870) will create two lots that are considered
"island lots." That is, the lots do not have a boundary that is contiguous with the nearest
county road or. in this case, State Highway 392. On August 9, 1999, Department of Planning
Staff recommended "denial"for a recorded exemption (RE-2503), for Mr. Ed Orr, on land that
is adjacent to the site owned by Mr. Boyd Meyer. Department of Planning Staff is
recommending denial of AmRE-1870 because of concerns with this application that are similar
to those posed by RE-2503.
2) Section 1.3.7 - Safeguarding the interests of the public. the homeowner. and the subdivider.
This application does not take into account the interests of the future owners who will be
responsible for acquiring any utilities that do not currently exist on the site. Additionally, there
are not adequate provisions for the continued maintenance and upkeep of the access road.
Should the Board of County Commissioners approve this request, the Department of Planning Services'
staff recommends the following conditions be attached:.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. A 30-foot wide joint access easement extending across Lot A from State Hwy 392, for the benefit
of both Lots A and B of RE-2578 and Lot B of AmRE-1870, shall be clearly shown on the plat. The
joint access easement shall be dedicated for the use as shown utilizing the language set forth in
Section 11 .7.1.12.5 of the Weld County Subdivision Ordinance.
B. All approved accesses shall be clearly shown on the plat.
C. State Hwy. 392 Is designated on the Transportation Map as a principai arterial road, that requires
75 feet of right-of-way from the centerline. Colorado Department of Transportation (CDOT) has

6) RIGHT TO FARM COVENANT
Weld County is one of the most productive agricultural counties in the United States. The rural
areas of Weld County may be open and spacious, but they are intensively used for agriculture.
Persons moving into a rural area must recognize there are drawbacks, including conflicts with
longstanding agricultural practices and a lower level of services than in town.
Agricultural users of the land should not be expected to change their long-estabiished
agricultural practices to accommodate the intrusions of urban users into a rural area. Well run
agricultural activities will generate off-site impacts, including noise from tractors and
equipment; dust from animal pens. field work, harvest, and gravel roads; odor from animal
confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; the use of
pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and
reservoirs cannot simply be moved "out of the way" of residential development without
threatening the efficient delivery of irrigation to fields which is
essential to farm production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware)with more than 3,700 miles of state and county roads outside of municipalities. The
sheer magnitude of the area to be served stretches available resources. Law enforcement
is based on responses to complaints more than on patrols of the county and the distances
which must be traveled may delay all emergency responses, including law enforcement.
ambulance, and fire. Fire protection is usually provided by volunteers who must leave their
jobs and families to respond to emergencies. County gravel roads, no matter how often they
are bladed, will not provide the same kind of surface expected
from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may
not be cleared for several days after a major snowstorm. Snow removal for roads within
subdivisions are of the lowest priority for public works or may be the private responsibility of
the homeowners. Services in rural areas; in many cases, will not be equivalent to municipal
services.
Children are exposed to different hazards in the county than in an urban or suburban setting.
Farm equipment and oil field equipment, ponds and irrigation ditches. electrical power for
pumps and center pivot operations, high speed traffic, sand burs. puncture vines. territorial
farm dogs, and livestock present real threats to children. Controlling children's activities is
important, not only for their safety, but also for the protection of the farmer's livelihood.
3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office
of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements
of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60)
days from the date of approval by the Department of Planning Services. The applicant shall be responsible
for paying the recording fees.
4. Planning Staffs approval of this recorded exemption is based upon satisfying the above conditions. Should
an applicant be unwilling or unable to meet any one of these conditions, within 60 days of approval, then
this case will be forwarded to the Board of County Commissioners with a recommendation for denial.

On August 20, 1999, Mr. Boyd Meyer applied for three land use applications
Planning staff has found that the application is not in compliance with Section 11.8.7 of the
Weld County Subdivision Ordinance. For this reason we are requesting the case be reviewed by
the Board of County Commissioners.
Department of Planning Services' staff has the following concerns:
1. This Amended Recorded Exemption is to redraw the boundaries of Lot B to extend the
eastern boundary toward the section line. While Department of Planning Staff does not have
a problem with the proposal to amend lot B, this application for an amendment was presented
along with two other cases, RE-2578, and SE-789. RE-2578 and SE-789 together will create
three lots that are considered "island lots." That is, the lots do not have a boundary that is
contiguous with the nearest county road or, in this case, State Highway 392.
2. On August 9, 1999, Department of Planning Staff recommended "denial" for a recorded
exemption (RE-2503), for Mr. Ed Orr, on land that is adjacent to the site owned by Mr. Boyd
Meyer. Department of Planning Staff is recommending denial of AmRE-1870 because of
concerns with this application that are similar to those posed by RE-2503.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider the application and determine if the standards of Sections 11.2 through 11.8 of the
Weld County Subdivision Ordinance have been met and adhere to the goals and policies of
the Weld County Comprehensive Plan.

With the proposal of this lot line adjustment, the development will not be considered an urban
scale development. With the existing lots being 53.2 acres of non-prime grass pasture ground, the
development will not interfere with any prime farmland operations or irrigation operations of its
own or any surrounding farms. A few small surrounding residences exist that coincide with this
existing farm nicely.

With no crop production. and the size and use of the land, the extended lot will be very
compatible with the surrounding properties that consist of additional farms and ranches.

within as expressed in the Weld County Zoning Ordinance, as amended, and the Weld County
Comprehensive Plan:
Being located within the A District and on non-prime agricultural ground the proposed R.E.
should not interfere with any agricultural production or activities. Uses By Right with the
Agricultural District allows residential units and farming activities upon the land.
Efficient and Orderly Development:
While safeguarding the interests of the public with a new development that does not take away
from the natural beauty of the county. With the safety of fire and rescue,and the convenience of
utilities, such as a public water supply,electricity and telephone,without hindering any of the
surrounding farming operations by keeping existing irrigation for the needs of the existing farms
and-ranches and preserving all of the surrounding farm producers, the proposal will be content

Thanks for the opportunity to review this recorded exemption. The City of Greeley Planning
staff has reviewed the application for a recorded exemption from Boyd Meyer, located south of
and adjacent to Highway 392 and approximately 1 mile west of Weld County Road 27 and wish
to forward the following comments.
Resolution 7, 1985 by the City of Greeley Planning Commission gave administrative review
authority to the Greeley Planning staff for review of recorded exemptions (RE). The resolution
indicates we cannot recommend approval on any application where the overall gross density
exceeds one dwelling unit per 20 acres outside of the 2010 growth ring. Since this application
creates two lots through the exemption process on a 53 acre parcel,we can recommend approval
of the request based on Resolution 7. The Greeley Public Works Department noted a reservation
of a minimum of 50' of right-of-way from the centerline of Highway 392 would be appropriate to
facilitate future development of this area if the proposal is approved. Also,the appropriate
setbacks under the applicable zone should also be maintained within the subdivision.

DISCUSSION:
The applicant, Mr. Boyd Meyer, is requesting approval of an amended recorded exemption
to move an existing lot line. The recorded exemption will not create any new parcels.
The subject property is located within the Town's Community Influence Area and is
depicted as Very Low Density Single Family Residential on the Town's Land Use Plan
map. The Windsor Comprehensive Plan states that the Very Low Density Single Family
Residential land use depiction provides for "...single-family residential detached homes at
very low densities at a maximum density of one dwelling unit per acre." No new building
sites will be created as this amended recorded exemption simply moves an existing lot line.
Therefore, the proposed recorded exemption is consistent with the Town's Land Use Plan
map.
The subject property is not included on the Town's Circulation and Transportation Plan
Map, however, it appears that both parcels will utilize an existing access onto State Highway
392. The applicant is also proposing a new recorded exemption (RE-2578) which accesses
State Highway 392. This being the case, staff recommends approval of this recorded
exemption subject to the following requirements:
1. All Colorado Department of Transportation requirements, including access permit
review and right-of-way dedication, shall be satisfied.
2. Due to the increasing number of single-family residences along State Highway 392
and the safety concerns associated with additional individual accesses, staff
recommends that, where possible, all parcels involved in both recorded exemptions
share an existing access to SH 392.

The access shall be ccnetructed.maintained and used in accordance with the terms and conditions of this permit,
including the State Highway,Accesa Code and listed attachments. This permit may be revoked by the issuing
authority If at any time the permitted access and its use violate any of the terms and conditions of this permit.The use
of advance warning and construction signs,flashers,barricades and fiaggers are required at ail t:mea during access

DEVICES,Part VI.The Issuing authority,the Department and their duly appointed agents and employees shall be held

Access is to he located on State Highway 392. a distance of 1777 feet east front
Mile Post 8 on the south/right side.

OTHER TERMS AND CONDITIONS:
1. This permit is only for the use and purpose stated in the Application and Permit.
A change in use of the property which results in a change in the type of driveway
operation may require reconstruction. relocation. or conformance of the driveway
to the Access Code.
2. This access shall continue to exist until such time that other reasonable access
to an alternative street is available and permitted.
3. Reconstruction or improvements to the access may be required when the permittee
has failed to meet required specifications of design or materials. If any con-
struction element fails within two years due to improper construction or material
specifications, the permittee is responsible for all repairs.
4. The two existing accesses to be removed and barrow ditch to be returned to match
adjacent borrow ditches.

1. Driveway shall be constructed 24 feet wide with 20-foot radii. (As per Exhibit "B")
2. The access approach shall be surfaced immediately upon completion of earthwork
construction and prior to being used.
3. Surfacing shall consist of 3 inches of ABC Class 6 and shall extend from the
highway travelled way to the right of way line. Specifications for these materials
are attached.
4. The first 20 feet beyond the closest highway lane, including speed change lanes,
shall slope down and away from the highway at a 2% grade to ensure proper drainage
control.
5. The horizontal axis of the access shall be at a right angle to the centerline of
the highway and extend a minimum of 40 feet beyond the outside edge of the nearest
lane.
6. An access that has a gate across it shall be designee so that the longest vehicle
using it can completely clear the travelled way when the gate is closed.
7. The side slopes of the access approach shall be 6:1.
8. Drainage to the State Highway right of way shall not exceed the historical flow.
9. If frost is present in the sub-grade, no surfacing material shall be placed until
all frost is gone or removed.
10. Owner is responsible for any utilities disrupted by the construction of this
driveway and all expenses incurred for repair.
11. Survey markers present must be preserved in their original positions. Notify
350-2173 upon discovery of any such markers.
12. Accesses which require a break in the right of way fence shall not allow livestock
to enter the highway right of way.
13. Cattle guards shall not be permitted in the State highway right of way.
14. COPY OF THIS PERMIT MUST BE ON THE JOB WITH THE CONTRACTOR.
