shade structures, hay storage buildings require a permit before any work is started. (In some cases,
engineered foundations are required.) Likewise, any demolition or excavation work requires

Dear Ms. Chester:
I have received and reviewed Longs Peak Dairy's Use by Special Review Permit application,
Case Number USR-1258, for expansion of the existing operation to a 2000 head dairy southwest
of Johnstown. In addition, a site inspection was made to view the dairy and surrounding
properties.
The size of the proposed facility will require it to adhere to Confined Animal Feeding Operation
(CAFO) Regulations. There appears to be adequate evidence in the plan that these regulations
have been considered in the planning phase.
The plan calls for up to 20 employees (the questionnaire mentions 16 employees in response 5a,
and 20 in 5b), which is within industry standards for a dairy of this size.
On question 5e, a table is shown titled "Longs Peak Dairy - Animal Unit Table." I would suggest
that "Unit"be changed to "Number"to avoid possible confusion with CAFO, EPA, and other
possible regulations that consider a mature dairy cow to be 1.4 animal units.
Weld County Extension has no objection to this proposal. If there are any questions, please do

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Weld County Zoning Ordinance Use by Special Review Standards for an agricultural service
establishment. Our comments and requirements are as follows:
COMMENTS:
The main access to the facility if from WCR 42 which is designated on the Weld County Transportation Plan Map
as a local paved road. The access to the residence and oil field is from WCR 13 which is designated as an arterial
status road.
REQUIREMENTS:
Access: There are three existing access points onto WCR 42. The eastern most access point accommodates
a feed alley which is critical to the operation. The main access point to the dairy may be widened to accommodate
two-way traffic. The west access shall be closed to reduce multiple accesses.
Traffic Counts: As weather permits, Weld County Public Works Department will be performing traffic counts at
this location.

The Weld County Department of Public Health and Environment has reviewed this application.
We have the following comments:
In February 1999, in response to complaints and observations of the facility, our Department
notified the facility that its operation did not comply with the Confined Animal Feeding
Operation Control Regulations (CAFO Regulations). The issues of non-compliance were as
follows:
• The facility did not have evidence that the facility's four(4) wastewater retention ponds
were constructed in accordance with the CAFO Regulations. Also, that numerous tree's
were growing within the boundaries of the northern-most retention ponds. These are
violations of Section 81.4(A) of the CAFO Regulations.
• Stormwater runoff from the pens, located on the western portion of the facility, appeared
to be directed into a creek rather than into a retention structure. This is a violation of
Section 81.3(A) of the CAFO Regulations.
In order to address the above issues the facility submitted a manure and wastewater management
plan and made physical changes to the facility. However, there remains one (1) issue of non-
compliance on the property. The facility has yet to remove one large tree stump in the northern-
most pond. The presence of the stump indicates that the pond does not comply with the CAFO
Regulations, as seepage is likely occurring via the stump in excess of what is allowed. The
applicants are aware of the issue and have agreed to remove the stump once they can de-water
their lagoons. We have recommended a condition of approval that addresses the removal of the
stump. Please keep in mind that the stump will have to be removed regardless of the outcome of
the USR process.
Our recommendation is as follows:
We have compiled numerous recommended conditions and standards pertaining to this
application. We have separated the proposed conditions and standards into conditions of
approval and development standards.
The following are recommended to be conditions of approval:

1. Prior to recording the plat:
A) The facility shall demonstrate compliance with the Confined Animal Feeding
Operations Control (CAFO) Regulation and the additional requirements outlined
below. This shall be demonstrated by submitting a comprehensive manure and
waste water management plan(the Plan), for a 2,000 head dairy,to the Weld
County Department of Public Health and Environment for review and approval.
This plan shall include, but not be limited to the following:
(1) Demonstration that all manure stockpile areas and waste water collection,
conveyance, and retention facilities are adequately sized and constructed to
handleand retain process waste water and the storm water run-off
generatedlfrom a twenty-five year, twenty-four hour storm event. This
shall be conducted by a Registered Professional Engineer .
(2) Demonstration that any existing or proposed waste water retention
structure has been or will be constructed in accordance with the criteria
described in the CAFO Regulations. The demonstration shall be
conducted by a Registered Professional Engineer.
(3) A site map demonstrating the layout of the site. This should include the
locations of all pens, structures, feed storage areas, any water courses
through the property, manure storage areas, lagoons, etc.
(4) A surface contour map which demonstrates all surface water control
features on the site. This should include surveyed surface elevations,
indicate flow direction, run-on and run-off control features, etc.
(5) Demonstration that the facility has the ability to manage and/or land apply
manure and waste water at agronomic rates in accordance with the CAFO
regulations.
(6) Demonstration that adequate measures are in place to prevent any
discharges except those which are allowed by the CAFO Regulations.
(7) Other necessary measures which are required in order to comply with the
CAFO Regulations.
B) In accordance with CAFO, the applicant shall submit the facility's manure and
waste water management plan to the Colorado Department of Public Health and
Environment for review and comment.

C) A dust abatement plan shall be submitted to the Weld County Department of
Public Health and Environment for review and approval.
D) A fly control plan shall be submitted to the Weld County Department of Public
Health and Environment for review and approval.
E) An odor control plan shall be submitted to the Weld County Department of Public
Health and Environment for review and approval.
F) The tree stump that exists in the northern end of the northern-most retention pond\ "
shall be removed and the ponds liner repaired in accordance with the CAFO
, Regulations. A report that certifies that the repaired liner complies with the
CAFO Regulations shall be submitted to Weld County Department of Public
Health and Environment for review and approval. The report shall be certified by
a registered professional engineer.
The following are recommended to be development standards:
1. Fugitive dust shall be controlled on this site. The facility shall be operated in accordance
with the approved dust abatement plan at all times.
2. All liquid and solid waste shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
3. There shall be no permanent disposal of solid wastes, as defined in the Regulations
Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2), at this site.
4. The facility shall maintain compliance with Confined Animal Feeding Operations
Control Regulations (5 CCR 1002-19) and, Section 47 of the Weld County Zoning
Ordinance, as amended.
5. The maximum permissible noise level shall not exceed the light industrial limit of 70
db(A), measured according to Section 25-12-102, C.R.S.
6. Any required NPDES Permit shall be maintained in compliance with the Water Quality
Control Division of the Colorado Department of Public Health& Environment.
7. All construction on the property shall be in accordance with the requirements of the Weld
County Building Code Ordinance, as amended.
8. The facility shall not discharge run-off or other waste waters to surface or groundwater

with exception to what is allowed by the Confined Animal Feeding Operations Control
Regulations.
9. Wastes materials, not specifically addressed by other development standards, shall be
handled, stored, and disposed in a manner that controls fugitive dust, blowing debris,
and other potential nuisance conditions.
10. The applicant shall remove, handle, and stockpile manure from the livestock area in a
manner that will prevent nuisance conditions. The manure piles shall not be allowed to
exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or
pollutant runoff The surface beneath the manure storage areas shall be of materials
which are protective of State waters. These areas shall be constructed to minimize
seepage or percolation of manure contaminated water. In no event shall the facility
impact or degrade waters of the State in violation of the Confined Animal Feeding
Operations Control Regulation (5 CCR 1002-19).
11. The facility shall be operated in accordance with the approved odor abatement plan.
Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution
threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control
Regulations. Additional controls shall be implemented at the request of the Weld County
Department of Public Health and Environment in the event odor levels detected off site of
the facility meet or exceed the level of fifteen-to-one dilution threshold, or in the
judgement of the Weld County Health Officer, there exists an odor condition requiring
abatement.
12. The facility shall maintain records on-site, available for inspection during business hours,
at all times, which demonstrates the following:
A. That the waste water collection and storage facilities are adequately constructed,
and sized to handle a 25-year 24-hour storm event.
B. The manner in which manure and waste water has been removed and applied to
land.
C. The method in which waste water and/or manure will be applied to land, including
the procedure which will be used to insure that agronomic rates are not exceeded.
13. A spillage retention berm shall be required around any fuel container with a volume
greater than 50 gallons. The volume retained by the spillage berm should be greater than
the volume of the largest tank inside the berm.

14. The facility shall be operated in a manner to control flies. The facility shall be operated
in accordance, at all times, with the approved fly control plan. Additional fly control
measures shall be implemented at the request of the Weld County Department of Public
Health and Environment in the event that flies (which can be determined to be associated
with the facility) are in such a number to be considered a nuisance condition. The plan
shall also be implemented in the event the Weld County Department of Public Health and
Environment receives a significant number of fly (associated with facility) complaints,
and in the judgement of the Weld County Health Officer, there exists a fly condition
requiring abatement.
15. Any septic system located on the property must comply with all provisions of the Weld
County Individual Sewage Disposal System Regulations.
16. There shall be no burning conducted at the site, with exception to burning defined as
"agricultural open burning" as defined by Regulation No. 1 of the Colorado Air Quality
Control Commission Regulations.
17. The facility shall be operated in accordance with the approved manure and waste water
management plan.

The Weld County Department of Public Health and Environment(WCDPHE)has reviewed the Longs Peak
Dairy*s Manure and Waste Water Management Plan(the Plan),dated January 13, 2000. We have also
reviewed the supplemental report submitted by CDS Engineering Corporation,dated February 25, 2000. The
Plan and supplemental report were submitted to address our February 16, 1999, and June 4, 1999, letters
concerning alleged violations of the Weld County Zoning Ordinance(WCZO)and the Confined Animal
Feeding Operation Control Regulations(CAFO Regulations)at the Longs Peak Dairy.
With exception of the tree stump that remains in the northern-most retention pond,the Plan and supplemental
report adequately address all outstanding issues. However,as we have discussed, in order to close this matter
the tree stump must be removed. Please submit a plan of correction and time line concerning the removal of
the stump. The plan should include the method of removal and methods to be used to repair the pond*s lining
material in accordance with the CAFO Regulations. The plan and time line should be submitted within 10
days of receipt of this letter.
Please keep in mind that our review generally centered around the alleged violations described in our previous
letters and general compliance with the CAFO Regulations at the facility's existing allowed working capacity.
The Plan appears to be written for an expanded facility;this was not considered in our review. Should the
facility receive a permit to expand an updated Plan will be required to be submitted.
