HomeMy WebLinkAbout840333.tiff RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN OPEN CUT DRY GRAVEL PIT - MONTE HEINRICH WHEREAS , the Board of County Commissioners of Weld County, Colorado , pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 20th day of June, 1984 , at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Monte Heinrich, 26849 Weld County Road 388 , Kersey, Colorado 80644 , for a Use by Special Review for an open cut dry gravel pit on the following described real estate, to-wit: Part of the Ezj Section 9 , Township 5 North, Range 64 West of the 6th P .M. , Weld County, Colorado WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. This request is in compliance with the Weld County Comprehensive Plan and the Weld County Extraction Plan, Mineral Resources , Volume II . The Weld County area in question is located in a resource conservation area. The Weld County Extraction Plan states that extraction shall be encouraged in resource conservation areas , as long as appro- priate extraction standards are followed. The proposal is consistent with the Comprehensive Plan policies which allow uses of an industrial nature to occur where the resources are available (i. e. , gravel and sand operations as noted on pages 62-63 of the Comprehensive Plan) . The proposal is consistent with the intent of the Agricultural Zone District in that the proposed use does not interfere with other agricultural activities in the area or the County, and as a Use by Special Review, the activity can take place in the district. c. The activities proposed will be compatible with existing agricultural and rural residential uses in the neighborhood, as well as with projected development in the future. d. No overlay districts affect the site. e. Use by Special Review Operation and Design Stand- ards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado , that the application for a Use by Special Review for an open cut dry gravel pit on the here- inabove described parcel of land be, and hereby is, granted sub- ject to the following conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The prescribed Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the subject property until the Use by Special Review plat has been delivered to the Depart- ment of Planning Services Office and the plat has been recorded in the office of the Weld County Clerk and Recorder. 3. The followingnote being placed on the Use by Special Review Permit plat: NOTE: The Mined Land Reclamation Board has the author- ity to issue permits for mining and reclamation activi- ties. Activities related to mining and reclamation are, therefore, under the jurisdiction of the Mined Land Reclamation Board; however, Weld County has jurisdiction of those matters outlined in the Operation Standards . The uses permitted on said described parcel shall be the extraction of sand and gravel as described in the application materials on file with the Department of Planning Services. 2. The open-cut gravel operation shall comply with Section 44.4 Operation Policies. Any violation of these regulations shall be grounds for enforcement of Section 44.5, cancellation of Permit. 3. Vehicular traffic shall ingress and egress onto Weld County Road 388 as shown on the submitted Use by Special Review Plat. 4. If truck hauling for USR 633 increases to more than ten (10) truck loads per day the applicant shall submit and have approved a dust abatement program to the Department of Planning Services. 5. The property owner and/or operator shall apply for a well permit with the State Engineer, Division of Water Resources, to comply with CRS 37-90-137. 6. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 7. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 8. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 9. The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 10. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. Assistant County Attorney Lee Morrison read this application into the record. Mike Mullen, Planning Department representative, read the favorable recommendation of the Planning Commission into the record and stated that ten Operation Standards have been recommended. Jerry McRae, engineer representing the applicant, came forward to answer questions of the Board. He stated that the applicant has no problems with the proposed Operation Standards, although Operation Standard 5 does not appear to be necessary since this is to be a dry pit. After further discussion;Commissioner Brantner moved to approve the Use by Special Re- view requested by Monte Heinrich, including the ten Operation Standards as proposed. Commissioner C. Carlson seconded the motion which carried unanimously. It can be in the form of metes & bounds survey or a descrip- tion by reference to township, range, and section, to at least the nearest quarter- quarter section. Where applicable, the street address or lot number(s) may be used. E.'WIBIT — Mining Plan This can be a general discussion of the methods, equipment, phases or stages of the operation and those areas of land affected 1,y each. The plan should be correlated with the map and should show where extraction will begin, and which direction, if any, it will proceed. 3 -3- EXHIBIT C - Map This map should clearly define the permit boundaries and contain sufficient information to determine the location of the affected land on the ground and existing and proposed roads or access routes to be used in connection with the mining operation. All immediately adjacent landowners of record must be shown. The quarter section corner, section line, or any other locatable points should also be shown on this map. EXHIBIT D - Wildlife, Water Resources, Vegetation and Soils Information Each of the above-mentioned subjects must be addressed as outlined in the applicable RULE. EXHIBIT E - Reclamation Plan As with the mining plan, this should be a general discussion of the methods, equipment, phases or stages of the reclamation process and those portions of land affected by each. If possible, the plan should be closely correlated with the map. If not, the narrative must be comprehensive enough to draw an accurate verbal picture of the expected appear- ance of the area after completion of reclamation. EXHIBIT F - Proof of Compliance with Local Government Zoning In accordance with 34-32-115(4) (e) , the Board must make a finding that the operation will be in compliance with local zoning or subdivision regulations. You are not required to submit this information, but a submission would assist the Division's pro- cessing of the application. When the Division notifies the local government of the existence of this application, it will request information regarding compliance with applicable local law. It is intended that operators may concurrently come into compli- ance with local requirements at the same tire the Division is processing this applica- tion. Information regarding the status with local government will be helpful. EXHIBIT G - Source of Legal Right to Enter This could be a copy of the lease, deed, abstract of title, or current tax receipt. An acceptable alternative would be a statement acknowledged by a notary public that the operator has the legal right to enter and mine. EXHIBIT H - Reclamation Costs For a 110 permit, if the operator requests financial warranty to be less than $5,000.00, the operator must submit facts to support such a request. Otherwise, a financial warranty of $5,000.00 will automatically be set. For all 111 permits, the financial warranty shall be $2,500.00 per acre. EXHIBIT I - Terms of Governmental Contracts (111 Applications only) For Special 10-Day (Ill) permits, the operator must submit a copy of the contract or other proof that proves the necessity of a special 10-day permit. The operator must also submit evidence of the financial warranty provided under the governmental contract, if it was required. 4 • . . . -4- NOTICE PROCEDURES After the application is considered "filed" (pursuant to RULE 1.1(10) with the Mined Land Reclamation Division, notice procedures outlined in RULE 3.2 and/or 4.2 must be followed. The site is a gravel terrace approximately 3/4 miles North -of the South Platte -River. The site is bordered on the North by the Ogilvy Irrigation Canal and on the West and South thy the owner's property. The land adjoininig to the East is presently fallow and at some -time in the past has been used for gravel excavation. The land is above the flood plain and the only known groundwater is in a seep ditch about 70-0 feet South of the site and 10 feet lower in elevation. The present access road to the improvements in the Northwest corner will be gravelled -and improved to provide truck access to ipit entrance at the Southeast Corner of the site. Mr. Heinrich has been approached by several small contractors and oil companies working in the immediate area to purchase the gravel for site and road improvements . Under this use, -the pit will probably not be in- tensively mined , but will be operated continuously through the anticipated life of 3 to 4 years . Removal of a portion of the gravel terrace would also allow the irrigate-d pasture to be enlarged by extending it to the North. NO. 6616 = = 1 n• A - 3 EXHIBIT B - MINING PLAN The Soil Conservation Service general soils information and report indicate 8 to l0" of pale gravelly sand on the surface. The mining plan will be to strip as much of these fines as possible off the surface area to be excavated under -each phase of the mining. This topsoil will be stockpiled during the initial year of mining and thereafter as stripped will be placed and spread on the previously mined areas not being used. Any stockpiles of material to to used as topsoil and remaining more than one year will be shaped to a maximum 4h to lv slopes to protect from erosion and seeded per the Soil Conservation recommendations . The Mining Plan will be to start at the Southerly edge of the pit with the first gravel excavated being used to improve the access road. Thereafter, as required , a loader will be used to fill trucks to haul to the construc- tion sites . Material will be used as "pit-run" and no stockpiles of material will be required. Excavation will proceed across the Southerly face of the pit to the North with the side banks being shaped as the gravel is removed. Shaping iof the North face of the pit will complete the mining portion of the project. All side slopes of the pit will to graded to -a -5 horizontal to 1 vertical slope for reclamation. The bottom of the pit will be levelled at about 0.6% slope tD match the existing pasture on the South. The irriga- tion system will be re-constructed to serve the new field. Topographic information shows the mineable quantity of gravel to be 45,100 CY or about 82000 Tons . Based on an average of 20,000 to 30,000 Tons/year removal rate, the anticipated life of this gravel pit is 3 to 4 years . All excavation will be dry. The gravel at this site has not been tested. However, based on visual in- spection, knowledge of the old pit on the adjoining property to the East, farm work an the property and information from the Soil Conservation Ser- vice, the site would be a good source of "pit run" material . This would adequately supply the market Mr. Heinrich would serve. B - 1 ENVIRONMENTAL CONCERNS The impact of this gravel pit will The minimal . Other than the Heinrich residence , the nearest residences are about 1/3 mil-e to the Smith. There will be a -small increase in truck traffic to the site to remove the gravel . however, County Road No. 388 presently handles many farm and cattle trucks serving the area. Due to the size and location on the owners property, no offsite drainage problems will exist. The Jiivision of WildliTe and Soils Conservation Ser- vice reports follow with their comments . McRae McRae and Short, Inc. 1227 Eighth Ave. Greeley, CO 80631 Dear Mr. McRae: The following is information which you requested regarding the Use by Special Review Permit for a gravel mining operation for Monte Heinrich located in the NE- Sec. 9, Township 5 N, Range 64 W of the 6th P.M. , Weld County, Colorado. The total area to he included in the plan is less than 10 acres. The soils on this site, as indicated by the southern Weld County soil survey, are Ustic Torriorthents with a moderately steep slope. The surface layer is pale brown gravelly sand approximately 10 inches thick. The underlying mate- rial to a depth of 60 inches is also pale brown gravelly sand. The surface layer can be distinguished from the underlying material by its higher incidence or organic matter and better soil development. I have inclosed a copy of the soils map and description for your review. The current land use for the proposed gravel pit could be described as irrigated pastureland. Vegetation consists primarily of an introduced, cool-season grass mixture dominated by Smooth Bromegrass. There are few, if any, native grass species occurring. For this reason, it is impossible to provide you with a current range condition rating. 1 have, lowever, enclosed a vegetative inven- tory showing the approximate composition by plant species which are currently in existence. For the purpose of reclaiming this area, it is essential that the topsoil, down to a depth of 8 to 10 inches , be stockpiled for future use. If this is not done, it will be necessary to transport topsoil in later on from another site and the expense will be much greater. Topsoil that is stockpiled for more than one year should be protected from erosion. To do this, it is recommended that the stockpiled soil be seeded to an adapted plant cover to cut down on the incidence of wind and water borne soil particles. Prior to replacing the topsoil, the area should be reshaped so that slopes do not exceed a 4:1 slope, otherwise, water erosion may occur before the newly seed- ed vegetation has had a chance to establish itself. . D - 2 Once the topsoil has been replaced, several seed types may be used to revege- tate. I have assumed that the area will be converted back to its original land use of irrigated pastureland and have recommended the following species selection: LBS. /AC. FOR TOTAL LBS. If a spring seeding is desired , it should probably be doNe before May 15 to take ad- vantage of the optimum temperature conditions. A Late summer or early fall seed- ing can be done between August 15 and the end of September, any later than this and the risk of winterkill is increased- Non-irrigated seedings or cool-season species are probably better accomplished in tire fail of Ike year , usually near the end of October. A fall seeding f this type should be done when the „round is sufficiently cold enough to prevent any premature germination which care also lead to winterkill.. - Seed should he planted to a depth of 1 /2 to 3/4" with the use of a grass drill equipped with a satisfactory feeding mechanism, agitator, double disk furrow openers and packer wheels. If a broadcast method of seeding is desired, the seed should he lightly raked into the soil and the seeding rate mentioned earlier should be doubled. A straw or hay mule h should then be applied at the rate of 4000 lbs . /ac. of air dry material and crimped into the soil to prevent blowing. Other methods listed in the attached mulching standards and specifications may also he used. Included in mapping are small areas of soils that have pockets of sandy loam and loam in the underlying material. Typically the surface layer is pale brown gravelly sand about In inches thick. The underlying material to a depth of fPt inches is pale brown gravelly sand. Permeability is rapid. Available water capacity is low. The effective rooting depth is 60 inches or more. Surface runoff is medium, and the erosion hazard is moderate. The potential native vegetation is dominated by little bluestenr, sicdeoats grama, sand reedgrass, blue grama, hairy graina, swiLc hgrass, and need leand thread. Potenii it production ranges from 700 pounds per acre in favorable years to 12.00 pounds in unfavorable years. As range condi- tion deteriorates, the tall and mid grasses decrease, blue grama and hairy grama increase, and forage production drops. Management of vegetation should be based on taking half or less of the total annual production. Deferred graz- ing is practical in improving range condition. Seeding and mechanical treatment are impractical. Windbreaks and environmental plantings generally are not suited to these soils. Onsite investigation is needed to determine if plantings are feasible. Wildlife populations are limited because the necessary habitat elements are lacking. Because most of the acreage is rangeland, only rangeland wildlife, for example scaled quail and antelope, are typical. Extreme care is needed in managing livestock grazing in order to provide suitable habitat on these soils. Potential is poor for urban and recreational develop- ment The chief limiting soil features are the loose, coarse textured soil, steep slopes, and rapid _permeability. The applicant has provided insufficient information concerning the use of water in the mining operation. In order for us to comment, we would need to know the _quantities of water to be used for dust control, washing, and other purposes. We would also need to know the sources of water for the operation and the legal right to use these water -sources. The uses permitted on said described parcel shall be the extraction of sand and gravel as described in the application materials on file with the Department of Manning Services. 2. The open cut gravel operation shall comply with Section 44.4 Operation Policies. Any violation of the-se regulations shall be grounds for enforcement of Section 44.5, cancellation of Permit. 3. Vehicular traffic shall ingress and egress _onto Weld County Road 388 -as shown on the submitted Use by Special -Review Plat. 4. If _truck hauling for I1SR 633 increases to more than 10 truck loads per day the applicant -shall submit and have approved a dust abatement program to the Department mf Blanning Services. 5. The property owner and/or operator shall apply for a swell permit with the State Engineer, Division of Water Resources to comply with CAS 37-90-137. 6. The applicant -shall comply with the design standards for the Use by Special Review, Section 211.5 et seq. , of the Weld County Zoning Ordinance. 7. The applicant -shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 8. Representatives or members of the Weld County Health Department and Weld County Department of Blanning Services shall be granted access onto the site at any seasonable time in order to insure the operations carried out on the site Comply -with the Development Standards stated hereon and all applicable Weld County Regulations. 9. The Use by Special Review -shall be limited to the plans shown hereon and governed by the Standards as -stated above and all applicable Weld County Regulation-s. Any material deviations from the plans and/or Standards as -shown or -stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of bounty Commissioners before such _changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of 3lanning Services. 10. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards.
