RE: DELEGATE AUTHORITY TO CONDUCT ELECTION FOR THE COUNTY OF WELD
TO THE WELD COUNTY CLERK AND RECORDER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, with the passage of Weld County Ordinance 218, the Board has referred
the issue of the issuance of a sales and use tax to a vote by the registered electors on the
November 7, 2000, General Election ballot, and
WHEREAS, the Board deems it advisable to delegate authority to conduct the elections
for Weld County, Colorado, to the Weld County Clerk and Recorder, and
WHEREAS, the Board has previously approved a form agreement to be used by local
governments to delegate such authority to the Clerk and Recorder, a copy of which is attached
hereto as Exhibit "A," which form has the Board sign as a party to the agreement on behalf of
Weld County, Colorado, and
WHEREAS, because the Board cannot sign an agreement to agree with itself, in order
to complete the delegation of authority to the Clerk and Recorder for the election required by
Ordinance 218, the Board hereby delegates such authority to the Clerk and Recorder in
accordance with the terms and conditions set forth in the agreement form attached as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Clerk and Recorder be, and hereby is,
authorized to conduct elections for the County of Weld, State of Colorado, in accordance with
the terms and conditions set forth in the agreement form which is attached hereto as Exhibit A.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
*yllowing vote on the 11th day of September, A.D., 2000.
