LEGAL DESCRIPTION: SE4 SE4 SE4 Section 30, Township 3 North, Range 65 West of the 6th P.M., Weld County, CO LOCATION: North of and adjacent to WCR 28 Section Line; east of and adjacent to WCR 39 SIZE OF PARCEL: 10 acres PARCEL NUMBER 1213 30 000007 THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS REQUEST BE DENIED FOR THE FOLLOWING REASONS: 1. The submitted materials are not in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services's staff that the applicant has not shown compliance with Section 24.3 of the Weld County Zoning Ordinance, as follows: a. Section 24.3.1.1 --That the proposal is not consistent with the Weld County Comprehensive Plan. The proposal is fora USR to allow vehicle service and repair on part of the applicant's property. The applicant expects to park no more than ten (10) automobiles and other assorted vehicles on site per day. Vehicles will be stored on site adjacent to the building. There will be employees on site to make Anchondo-USR 1275, page-2 repairs to the vehicles. Per the application, there will be no one living on :he premises. A. Goal 3 state "discourage urban scale residential, commercial, and industrial development which is not located adjacent to existing incorporated municipalities. The facility is located outside of the urban growth boundary area for both Fort Lupton and Hudson,the nearest communities. Further, P.Goal 2 requires adequate facilities and services to assure the health, safety, and general welfare of the present and future residents of Weld County. The applicant has not provided documentation stating that adequate water service in terms of quality, quantity, and dependability is available to the site for fire suppression and for daily use. The applicant has submitted a Commercial Well Permit application stating the well will have a maximum pumping rate of 15 gallons per minute. The Platteville/ Gilcrest Fire Protection District is requiring evidence of 1500 gallons per minute at 20 pounds per square inch for a period of two hours sustained for this site. b. Section 24.3.1.2 --The proposal is not consistent with the intent of the Agricultural Zone District. Section 31.1 of the Weld County Zoning Ordinance states " Agriculture in the county is considered a valuable resource which must be protected from adverse impacts resulting from uncontrolled and undirected business, industrial and residential land uses." Planning staff concurs that an adverse impact will result from locating the business at the proposed site. c. Section 24.3.1.3--The vehicle service and repair shop would not be compatible with the existing surrounding land uses. The surrounding properties are zoned for agricultural uses. The surrounding property is very rural in nature with limited homes. Fire suppression of this facility will be a major concern with no water on site and with a fire district response time of approximately fifteen (15) minutes. d. Section 24.3.1.4--The vehicle service and repair shop is incompatible with the rural land uses. Without adequate water for fire suppression, the proposed facility fails to meet the minimum standard for fire protection, and fails to provide adequate provision for the protection of the health,safety and welfare of the inhabitants of the neighborhood and the County. e. Section 24.3.1.7 -- Adequate provisions for the protection of health, safety, and welfare of the inhabitants of the neighborhood and County cannot be attained by Development Standards and Conditions of Approval. The facility does not have water. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. Anchondo-USR 1275, page 3 Should the Weld County Planning Commission determine that this use does meet all the application requirements of Section 24.7, the Department of Planning Services' staff recommends the following conditions be attached: 1. Prior to scheduling the Board of County Commissioners hearing: a. The applicant shall provide documentation stating that adequate water service in terms of quality, quantity, and dependability is available to the site for both potable use and for fire suppression on site. b. The applicant shall provide a list of surrounding property owners, listed by address and accompanied by a signed affidavit. c. The applicant shall provide a list of surface owners, and accompanied by a signed affidavit. d. The applicant shall provide a check payable to the Clerk to the Board for twenty (20) dollars for advertising of the public hearings. e. The applicant shall provide the original front cover sheet signed by the Title Company attesting to the accuracy of the information contained in the Title search. Should the applicant be unable or unwilling to provide the requested documents within thirty :30) days of this hearing, this case will be referred to the Weld County Attorney's office for further action. 2. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review Plat prior to recording the plat. The completed plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 30 days of approval by the Board of County Commissioners. (Dept. of Planning) 3. Prior to recording the plat: A. The applicant shall submit a waste handling plan to the Weld County Department of Public Health and Environment. Evidence of Health Department approval shall be submitted to the Weld County Department of Planning Services. The plan shall include at a minimum, the following: (Dept. of Public Health & Environment) 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). Anchondo-USR 1275, page 4 2) A list of the type and volume of chemicals expected to be stored or site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 4. The Plat shall be amended to delineate the following: a. The applicant shall delineate on the plat, customer parking, loading zones, anc a traffic circulation plan throughout the site. (Dept. of Public Works) b. The applicant shall delineate on the plat any proposed signage. (Dept. of Planning. c. The applicant shall delineate the proposed landscaping plan on the plat. The location, number, size and species of all plant material, including ground covers shall be identified. (Dept. of Planning) d. Weld County Road 39 is designated on the Transportation Plan Map as a collec-or status road, which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 40 feet from the centerline of Weld County Road 39 shall be delineated on the plat as right-of-way reservation for future expansion of Weld County Road 39. (Dept. of Public Works) e. Access to the site shall be a minimum of twenty-four (24) feet in width, with a fort/ (40) foot turning radius. (Dept. of Public Works) f. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved access point. If a drainage culvert is required, a 15-inch CMF' is the County minimum size. If the applicant chooses to place a larger culvert. please contact the Department of Public Works to adequately size the culvert. (Dept. of Public Works) g. The applicant shall submit a Storm Water Drainage Plan to the Weld County Public Works Department for approval. The Plan shall identify how the drainage will be handled that is generated from the proposed building and parking area. It should be designed to release water at a quantity and rate not to exceed the historic rate. The applicant shall submit evidence of approval by the Public Works Department to the Department of Planning Services. Upon approval the location of the facility shall be placed on the plat (Dept. of Planning Services, Public Works) 5. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. (Dept. of Planning) Anchondo-USR 1275, pag.t 5 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Ruben and Ruby Anchondo USR-1275 1. The Site Specific Development Plan and Special Use Permit is for a business permitted as a use by right in the Commercial Zone District (Vehicle Service and Repair Shop) in the Agricultural Zone District, as indicated in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. (Dept. of Planning) 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance, as amended. (Dept. of Planning) 3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act 30-20-100, C.R.S.,as amended)shall be stored and removed for final disposal in a manger that protects against surface and groundwater contamination. (Dept. of Public Health and Environment) 4. No permanent disposal of wastes shall be permitted at this site, (Dept. of Public Health and Environment.) 5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. (Dept. of Public Health and Environment:) 6. Fugitive dust shall be controlled on this site. (Dept. of Public Health and Environment',, 7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103, Colorado Revised Statutes, as amended. (Dept. of Public Health and Environment) 3. Adequate toilet facilities shall be provided for the public. (Dept. of Public Health and Environment) 9. An individual sewage disposal system is required for the proposed office and shall be installed according to the Weld County Individual Sewage Disposal Regulations. No waste generated from the vehicle repair services shall be disposed of in this system. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. (Dept. of Public Health and Environment) 10. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and Anchondo-USR 1275, page 6 handled in a safe manner. Reference 25-8-205.5 Colorado Water Quality Control Act and Rules and Regulations thereof. (Dept. of Public Health and Environment) 11. The facility shall utilize the proposed on-site commercial well. (Dept. of Public Health and Environment) 12. If applicable, the applicant shall obtain a storm water discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. (Dept. of Public Health and Environment) 13. The proposed access and parking area shall have a minimum of three (3) inches of aggregate course and be graded and drained to provide all weather access. (Dept. of Public Works) 14. The facility shall maintain compliance with the Uniform Building Code as stated in the referral response from the Department of Building Inspection. 15. All signs must be is accordance with Section 42 of the Weld County Zoning Ordinance (Dept. of Planning) 16. There will be no outdoor storage of materials associated with the automotive machine shop as indicated in application materials. (Dept. of Planning) 17. Hours of operation shall be from 8:00 a.m. to 6:00 p.m. Monday thru Friday and 9:00 am to 12:00 noon Saturday as indicated in application materials. (Dept. of Planning) 18. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance, as amended. 19. The property owner or operator shall be responsible for complying with the Operaton Standards of Section 24.6 of the Weld County Zoning Ordinance, as amended. 20. Personnel from the Weld County Departments of Public Health and Environment and Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 21. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. Tibbals, Jr. 6444 South Quebec Englewood, CO 80111 Subject: Ruben arid Ruby Anchondo Use by Special Review (USR 1275) Application Dear Mr. Tibbals: This is a follow-up letter to our conversation of June 26, 2000. During the course of this conversation you confirmed that your client, Ruben Anchondo, has not applied for a Commercial Well permit as indicated in the application materials. Further, your client was waiting for Board of County Commissioners approval prior to proceeding with acquiring the Commercial Well Permit. Given this information, the Department of Planning Services' informed you of their intention to recommend denial of your clients application for the Vehicle Service and Repair Establishment due to no water on site. An adequate water supply is required for any permitted uses in the County per Section 24.5.1.1 of the Weld County Zoning Ordinance, which states, "adequate water service in terms of quality, quantity, and dependability is available to the site to serve the uses permitted " Staff further noted that the Weld County Department of Building Inspection is requiring an automatic fire extinguishing system for the 9800 square foot structure. Further, the Platteville/ Gilcrest Fire Protection District is requiring evidence of adequate flow of 1500 gallons per minute at 20 pounds per square inch for a period of two hours, as well as a fire hydrant installed within three hundred (300)feet of any commercial structure. The Fire District also states that "due tc the location of this building, and the proximity to the closest fire department responding, measures of fire protection must be highly prioritized." As Mr. Anchondo has failed to provide evidence of adequate water, the proposed site fails to meet the minimum standard for fire protection, and fads to provide adequate provision for the protection of the health, safety and welfare of the inhabitants of the neighborhood and the County You further indicated that you were going to speak with Mr. Wes Scott, Platteville/ Gilcrest Fire EXHIBIT 13 Tibbals, USR 1275 June 27, 2000 page 2 Protection District Manager regarding the requirement for meeting the minimum fire protection standard. Should Mr. Scott require all fire protection measures be implemented as per his referral then there was some speculation on your part to withdraw the application on behalf of your client Please note, you may withdraw the application, however, Mr. Anchondo will continue to be in violation of the Weld County Zoning Ordinance for the Non-Commercial Junkyard, Violation Case Number VI-9800181 that consists of twenty to twenty-five (20-25) derelict vehicles, two (2) camper shells, a school bus, and a boat. Mr. Anchondo has attempted to screen these elements with two (2) semi-trailers and two (2) mobile homes. Both the derelict vehicles and the type of screening are in direct violation of the Weld County Zoning Ordinance. To bring the property into compliance and close the violation case file, all derelict vehicles must be removed from the property, screened from all adjacent properties and public rights-of-way or have current license plates and be in running condition. If screening is utilized, the screening plan shall be approved by the Department of Planning Services' prior to installation. Please note, screening only works if the property is a noncommercial junkyard. Thus, if there is a commercial junkyard or other business such as a vehicle repair facility on site, screening does not bring the property into compliance and close the violation file. Should your client elect to not proceed with the Use by Special Review application process or elect to not bring the property into comploiance with the Weld County Zoning Ordinance, your case will be forwarded back to the County Attorney's office for further action. Please notify the Department of Planning Services' of the direction in which you wish to proceed given this information by Friday June 30, 2000.
