This project falls primarily under the purview of the Weld County Planned Unit Development/Subdivision Ordinance 173-E standards. Our requirements are as follows: REQUIREMENTS: Typical Road Cross Section: The typical road cross section (Sheet 1 of 3) shows three inches of Class 6 aggregate base course. As per Item #4.6.9.6 of the subdivision regulations, the minimum depth is four inches of Class 6 aggregate base course. This should be corrected on the plat prior to recording. Storm Water Drainage: Item G of the Development Guide refers to storm water drainage. The applicant is indicating that a storm water drainage study shall be provided to Weld County Public Works and the Department Planning Services prior to recording the plat. As of this date, I have not received this document. Improvements Agreement: The applicant has submitted an Improvements Agreement According Policies Regarding Collateral for Improvements (Private Road Maintenance). I have verified the quantities and unit costs in Exhibit A and all items appear to be adequate for the project. All additional items should be verified through the Department of Planning Services. Dust Suppressant: I have been in contact with Linn Leeburg, the applicant's representative, regarding drafting an Improvements Agreement to provide adequate dust suppressant during construction of the PUD. Department of Public Health an ` i\ • Environment COLORADO CASE NO.: S-511 NAME: Karen Libin; Peaks at Mountain View The Weld County Department of Public Health and Environment has reviewed this proposal. Our staff have also observed the site. The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service. Water will be provided by the Left Hand Water District and sewer will be provided by individual sewage disposal systems. The minimum lot size of 4.8 acres and the overall density of one septic system per 8 acres meets current Department policy. We recommend the following conditions be part of any approval: 1) Water service shall be obtained from the Left Hand Water District for each lot. 2) A Weld County Septic Permit is required for each proposed home septic system and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 3) The "Right to Farm" covenant shall be placed on the plat. 4) In the event that 5 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. 5) During development of the site, all land disturbance shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Department of Public Health and Environment, a fugitive dust control plan must be submitted. 6) In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods which are technologically feasible and economically reasonable in order to minimize dust emissions. The projected student impact upon the St. Vrain Valley School District of 5 single family units on 40.15 acres is a total of 4 students. Any students living in this subdivision would attend Erie Elementary School and Erie Middle /High School under the present school boundaries. However, due to potential growth in these schools this development and other existing developments in this feeder could be placed in another attendance area in the future. Bus transportation would likely be required. While this development does not impact the middle/senior school capacity, the elementary is already over capacity. In addition, there are other approved developments in these attendance areas which will, together with this proposal, have a significant cumulative impact on these schools. As the volume of developments increases in this attendance area with no alleviation of the existing overcrowded conditions, the ability to provide the same quality education for these new students that is provided students in other areas becomes increasingly difficult. The District had previously opposed this development because it would add to the enrollment of an already overcrowded school and because there was no land dedication or cash in-lieu arrangement available to mitigate the impacts. However, the developer has signed an agreement which will require the payment of a cash in-lieu payment prior to obtaining a building permit. While this does not provide funding for school construction it does provide for school land purchases. The builder will need to pay the fee at the District offices in order to obtain a receipt which should then be presented to the County building officials as proof of payment. One condition in the agreement identifies that a note must be added to the final plat pertaining to the fee requirement. This must be done before recording the document.
