SPECIAL REVIEW USE QUESTIONNAIRE Hall-Irwin Corporation
This letter in conjunction with the attached DMG Reclamation Permit application will serve as
the Special Review Use Questionnaire.
Proposed Use of Property
Hall-Irwin Corporation is proposing to expand the mining operation at the Firestien property tc
include three additional parcels (refer to Extraction Plan Map for locations of the parcels). The
applicant will continue to use the existing processing site to process the materials excavated in
the expansion area.
Truck Traffic
Truck traffic is not anticipated to change as the materials will be transported across the site to the
processing area rather than using County Roads. All trucks will continue to exit the property on
Weld County Road 27. The majority of the trucks will proceed north and continue either on
Weld County Road 27 or travel east on "O" Street. Trucks will cross the Weld County Road 21
(83`° Avenue)bridge. Thus, the existing Road Maintenance Agreement is still appropriate for
this site.
Consistency with the Weld County Comprehensive Plan
This application is consistent with the Weld County Comprehensive Plan. The mining operation
will promote the following goals and policies:
• CM.Policy l: Access to future mineral resource development areas should be considered
in all land-use decisions in accordance with Colorado State Law. No Weld County
governmental authority which has control over zoning shall . . . permit the use of.any area
known to contain a commercial mineral deposit in a manner which would interfere with
the present or future extraction of such deposit by an extractor. This property is situated
within one of the principal aggregate deposits in the County. According to the County
Sand, Gravel Resources Map, the resource is classified as F1 - floodplain deposit of
relatively clean and sound gravel.
• CM.Goal 2: Promote the reasonable and orderly development of mineral resources.
• CM.Goal 3: Minimize the impact of surface mining on surrounding land uses, roads and
highways. The operator has minimized the impact of the mining operation by
surrounding the processing area by stockpiles to minimize noise, watering the haul roads
and stockpiles as necessary to control dust and by entering into a road maintenance
agreement with the County.
• CM.Goal 4: Minimize hazardous conditions related to mining activities and the mining
site. The applicant will comply with all federal, state and local regulations.
• CM.Goal 5: Provide for timely reclamation and reuse of mining sites in accordance with
the Comprehensive Plan, Subdivision and Zoning Ordinances. This site will be
reclaimed into agricultural land (cropland, fish hatchery, reservoir). These uses are
consistent with the County Comprehensive Plan and regulations.

Consistency with Weld County Zoning Ordinance
This applicant will conduct operations in a manner which is consistent with the operations
policies set forth in Section 44.4 of the Weld County Zoning Ordinance.
Compatibility with Surrounding Land Uses
The surrounding land uses are primarily agricultural. There are several residences along Weld
County Road 641/2. There are other permitted sand and gravel extraction operations in the
general vicinity. This amendment will not increase the amount of traffic in the vicinity of the
site, nor will it bring the need for additional housing or support services to the area.
Compatibility with the surrounding uses will be assured by setbacks, noise limitations and othe-
restrictions on the operation. The Weld County Comprehensive Plan does not project future
development near this property and it is not in a municipality's urban growth boundary.
Method of Mining Operation
The applicant will continue to employ the same mining method as permitted in the original USR.
Please refer to Exhibits C through F in the DMG application for details of the mining plan and
the reclamation plan. These plans also address: the anticipated mining and reclamation
schedules, the size of the area and stages to be worked at any one time and the location of
stockpiles. Exhibit I describes the depth and thickness of the mineral deposit and the
overburden. There will be no permanent structures associated with mining this amendment area.
There will be no animals allowed near the mining activities at the site.

The applicant will continue to utilize the same equipment and facilities as permitted in the
original USR application:

Employees
The applicant anticipates there will be a maximum of two shifts and forty employees working o❑
the site.
Adequate Water Supply
The applicant has sufficient water rights for the mining, concrete and asphalt operation. The
operation will continue to obtain drinking water from the Shark's Tooth Pipeline. Please refer to
Exhibt G of the attached DMG application for details.
Sewage Disposal
Hall-Irwin will continue to utilize the existing septic system for the scale house and portable unit
for the processing area.
Stormwater Drainage
Hall-Irwin prepared a Stormwater Management Plan per Colorado Department of Public Health
and Environment, Water Quality Control Division regulations as part of the permitting for the
original operation. The operator will continue to follow this plan to manage stormwater.
Landscaping/Final Reclamation
Refer to the Exhibits E and F for details on proposed reclamation procedures and landscaping.
Exhibit D (Mining Plan) contains the mining and reclamation schedule.
Adequate Protection of the Health, Safety and Welfare of the Neighborhood and the County
The applicant will comply with all conditions of State and local permits thus ensuring the
protection of the health, safety, and welfare of the inhabitants in the site vicinity and in the
county. Please refer to Exhibit M of the DMG application for a list of permits the applicant is
obtaining.
Floodplain Hazard Area
A portion of this property lies within the Cache La Poudre River floodplain (per FIRM map
panel number 080266 0608 D, dated September 27, 1991. Per Sections 53 and 26 of the Weld
County Zoning Ordinance, a Flood Hazard Development Permit application is included as part of
this application.
Dust Abatement Plan
Hall-Irwin Corporation will continue to comply with the existing dust abatement plan for the
Firestien site.

Dear Mr. Gathman:
This letter provides the information requested as Condition 2 of the Special Review Permit
Administrative Review Report.
Oil and Gas Activities
• Mary Tigges owns mineral rights on parcels 1 and 2. The Extraction Plan illustrates that
mining activities will be setback from existing oil and gas wells and gas lines. Exhibit N of
the Division of Minerals and Geology 112 Permit application contains the sand, gravel and
aggregate mining lease between Mary Tigges and Hall-Irwin Corporation. This illustrates
Mrs. Tigges' support of the mining operation. I have also enclosed copies of the certified
letters mailed to Brooks Exploration Company and the Jane Ray Dietrich Living Trust
(mineral leasehold owner). Neither party has indicated they have any concerns with the
proposed mining operation.
• Enclosed is an opinion letter from Certified Professional Landman William G. Crews which
shows that the Roberts property (parcel 3) does not appear subject to any oil and gas
leases. This letter also states that the development of future oil and gas wells "as a practical
matter...likely would never happen because 25% of the mineral owners would he paying
(and risking) 100% of well costs."
Threatened and Endangered Species
• Enclosed is a letter from District Wildlife Manager Larry Rogstad indicating that the site is
not suitable habitat for Preble's meadow jumping mouse or Ute Ladies Tresses Orchid.
Concerns of Adjacent Property Owner
• Enclosed is a letter signed by Robert C. Burroughs, representative for the Estate of Mary
E. Etter indicating we have adequately addressed the Etters' concerns.

RE: Hall-Irwin Corporation's Firestien Use by Special Review Permit
Dear Mr. Burroughs:
We appreciate the comments you sent to Weld County regarding Hall-Irwin Corporation's proposed
expansion of the Firestien mining operation.
1. Adequate adjacent support — We do not anticipate that the mining operation will effect the
stability of the Etters' property. On June 20, 2000, Rocky Mountain Consultants, Inc.
reviewed exploratory boring data and the mining plans to ensure that the mining operation will
not negatively impact any man-made structures within 200 feet of disturbed areas. The findings
state: "From a geotechnical standpoint, the sand and gravel will form most of the mine siopes.
These soils are generally strong and stable, particularly when dewatered....ln our opinion,
gravel mining related disturbances, and subsequent reclamation activities should not impact
these structures." I have enclosed a copy of these findings for your information.
2. Proximity to the Estate domestic well— Hall-Irwin Corporation will install a monitoring well on
the Tigges property, in proximity to the Estate domestic well for the residences. Hall-Irwin will
monitor the groundwater levels closely to ensure that the Estate well is not negatively impacted
by the proposed mining operation. In the event that the well is impacted, the operator will be
responsible for rectifying the situation.
3. Berms/setback—The operator will place berms along the western portion of each section as it
is being mined. Hall-Irwin has committed they will not mine within 25 feet of the property line
Again, we do not anticipate any "support" problems.
4. Underground drain tiles — Hall-Irwin will ensure that the drainage which discharges
southeasterly into Parcel I continues to flow to the Cache La Poudre River.

You have asked us for our comments concerning the mineral this to Lot B of Recorded
Exemption No. 2665704, being a part of the SE%of Section 30, Township 6 North,
Range 66 West, Wald County. You also requested that we address sand and gravel
versus oil and gas deretopment concerns.
Title to the minerals under the involved parcel is as follows:

In that certain Warranty Deed dated January 9, 1971, recorded in Book 638 under Rec.
No. 1560335, Marie K Weinmeister reserved an undivided ' interest in and to all oil,
gas and other minerals under the involved parcel. The reservation went on to state
"However, the grantor, her heirs and assigns, hereby release all right to enter upon the
surface of said land, or any portion, thereof,for the purpose of conducting exploring,
prospecting, drilling, mining, producing and refining operations, or any one or more of
them with respect to the within described lands.' This release of surface use is most
unusual.
In that certain Warranty Deed dated April 10, 1975, recorded on Book 736 1657915,
Robert J. Rotthaus, Eugene W. Freeman and Henry F. Markus made their deed to
David L. and Elizabeth A. Firestien subject to the Weinmeister reservation and also
subject to "Reservation to Robert J. Rotthaus, Eugene W. Freeman and Henry F.
Markus, as tenants in common, in and to an undivided one-fourth interest in and to all
oil, gas and other minerals under the above described property,'
There were no,subsequent mineral reservations; the current surface owners own the
remaining minerals.

The property does not appear to be subject to any valid oh and gas leases. The
Firestein 1-30 well, which was operated by Brooks Exploration, Inc, has been plugged
and abandoned, and there is no other well which would have further extended the old
Amoco leases under which the Firestein well was originally drilled. Inasmuch as the
reservation by Weinmeister does not have surface rights, only the interest of Robert J.
Rotthaus, Eugene W. Freeman and Henry F. Markus could present problems with sand
and gravel operations. While the Rotthaus et al. parties may be entitled to use a

minerals from Rotthaus et al. there would be no foreseeable oil and gas activity on the

Morrison v. Socolofsky, 600 P.2d 121 (Colo. App. 1979) and other cases cause one to
conclude that a mineral reservation by itself does not grant the mineral owner a right to
destroy the surface of the land, There must be a specific and express reservation of a
right to destroy the surface, and not just a broad reservation of a right to use the
surface, Additionally, Ms. Weinmeister specifically excluded surface rights in her
reservation.
The cases in Colorado make clear that the ultimately dispositive issue is what the
parties to the conveyance actually intended. There is no way to determine intention
from examination of deeds, and there is no way that one can determine whether
contrary extrinsic evidence might exist.
We find it hard to believe that the Rotthaus et al. reservation was intended to include
