CASE SUMMARY
March 2, 1998 Five day letter was sent to Mr. and Mrs. Forchette. A site inspection was conducted
and revealed that a noncommercial junkyard and the number of dwelling units located
on the property were not in compliance with the Weld County Zoning Ordinance.
April 9, 1998 Progress inspection conducted by Sharyn Frazer and Sheble McConellogue. Mad of
the noncommercial junkyard was cleaned up with a few tires and miscellaneous debris
remaining.
April 16, 1998 Recorded Exemption (RE-2181) was conditionally approved. (See attached).
July 8, 1998 Memo to the file from Sharon Marquez stating that she spoke with Mrs. Forchetttr on
the telephone on behalf of Monica Daniels-Mika. It was explained to Mrs. Forchette
that no progress was occurring on the recorded exemption because the applicant had
not met the conditions of approval so the mylar plat could not be recorded.
December 8, 1998 Letter from Monica Daniels-Mika to Mr. and Mrs. Forchette stating that the co iddrons
of approval had not been met and the mylar plat was not submitted for recording. A
time frame of three weeks was granted to allow the applicants to bring the property into
compliance or the situation would he referred to Code Compliance to proceed with the
violation process.
February 3, 1999 Thirty day letter sent.
February 26, 1999 Mr. Forchette called and discussed the options available regarding the mobile home
located on the property. A zoning permit application for a medical hardship was
mailed to both Mr. Forchette and Tom Owens,who had been unofficially representing
the Forchettes.
February 26, 1999 Tom Owens called and spoke with Sharyn Frazer. He stated he had recommended to
Mr. Forchette that he communicate with the Department of Planning Services to resolve
the issues occurring on the property.
March 9, 1999 Mr. Forchette called and spoke with Sharyn Frazer. He stated that he didn't think they
would be able to qualify for a medical hardship, which was an avenue ava fable to
bring the property into compliance. Sharyn Frazer recommended that he set up an
appointment with Monica Daniels-Mika, to discuss other possible options.

March 11, 1999 Mr. and Mrs. Forchette came into the Department of Planning and met with Mot,ica
Daniels-Mika and Sharyn Frazer regarding the situation occurring on the property. It
was determined that the department would grant some additional time to allow VII-. and
Mrs. Forchette to make a decision.
March 31, 1999 Letter sent to Mr. and Mrs. Forchette scheduling them to appear before the Boanl of
County Commissioners at violation hearings on April 13, 1999, at 10:00 a.m.
The Department of Planning also recommends that the County Attorney be authorized to proceed with Icgal
action against any other persons occupying the properties, any persons claiming an interest in the propert es, and
any persons acting in active concert with the identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or the Weld County
Attorneys Office.

a meeting with the Board of County Commissioners on April 13, 1999, at 10:00 a.m., to consider the violatons
occurring on the property. This meeting will take place in the County Commissioners' Hearing Room, First Floor,
Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners might have about
the violations.
I he Department of Planning Services' staff will be recommending that the Board of County Comm stoners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indi_ate that

Dear Mr. and Mrs. Forchette:
The uses on the above described property are being considered as a zoning violation of Sections 31.2 rid 4 4 of the
Weld County Zoning Ordinance. In the letter from Monica Daniels-Mika, Director, dated December 8, 1990, you were
asked to supply written documentation that the conditions of approval on Recorded Exemption 2181, had been met.
As a result, Case Number RE-2181, is considered closed. The structures located on the property require the appropriate
permits.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we have
no discretion in this matter if you fail to correct this violation. I have scheduled a meeting with the Board of County

Dear Mr and Mrs Forchette,
On January 10, 1998, you applied for recorded exemption 2181. Recorded Exemption 2181
was conditionally approved by planning staff on April 16, 1998. As a condition of this approval
you were given sixty (60) days to meet the conditions and record the mylar.
To date, we have not been made aware of any attempts to meet these conditions. If you are
having difficulty in satisfying these conditions, or should you wish not to proceed with thiE
recorded exemption, then the Department of Planning Services will need to be notified in writing
of your decision. Additionally, the mobile home used for storage, and the manufactured home
must both be appropriately permitted or this case will be referred as a violation to code
compliance.
We are well aware of the difficulty in meeting conditions associated with land use cases ,and are
willing to work with all of our clients. I have included a copy of the staff recommendation -`or your
review, and will be available to answer any questions and concerns you have. If I do not hear

I spoke with Mrs. Forchette this morning on behalf on Monica Daniels-Mika. Mr. Forchette had left a message
on Monica voice mail inquiring about the stasis of RE-2181. I told Mrs. Forchette that there had been no progress
on the RE because the applicant had not come into compliance with the terms of the RE. I asked Mrs. Rachotte
if that information answered her husbands questions. She indicated that it did, and said she would let Mr.
Forchette know.

The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (ISDS) regulations.
2. Any existing septic systems(s)which are not permitted will require an I.S.D.S. Evaluation prior to the
issuance of the required septic systems. In the event the systems(s) is found to be inadequate, the
system(s) must be brought into compliance with current regulations.
3. No permanent disposal of wastes shall be permitted at this site
4. The existing NCU 18:81:7 shall be vacated.

5. Prior to recording the following notes will be placed on the plat:
5.1 The applicant shall either validate the use of the manufactured home on this site or remove the
manufactured home from the site.
5.2 The mobile home used for storage on this site is in a state of disrepair and must be demolished A
demolition permit will be necessary to conduct this activity.
5.3 All proposed or existing structures will or do meet the minimum setback and offset requirements for the
zone district in which the property is located.
5.4 All accesses shall be clearly shown on the plat.
5.4.1. LOT a ,will be granted one residential/agricultural access with no circle drives. No
additional accesses will be granted.
5.4.2 LOT b, will have access onto WCR 24 %. The existing access will be useo.
5.4.3 An additional 10 feet of road right of way needs to be reserved and shown or the plat
5.4.4 All future structures will obtain appropriate building and zoning permit.
6. Prior to release of building permits, the applicant shall:
6.1 Submit evidence to the Department of Planning Services that the lots have adequate water supply
of sufficient quality, quantity and dependability.
6.2 Submit evidence that the wells proposed for the parcels have been registered by the State of
Colorado and have the capacity to meet both domestic and farm uses. The number of animal units
may be restricted based upon the availability of water to the site. A determination of animal units
will be made at the time of building permit issuance.
7. The applicant shall submit a Mylar plat to the Department of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7
of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of
approval by the Department of Planning Services. The applicant shall be responsible for paying the recording
fees.
Additional Comments: A site inspection on 4-8-98 made by Sharyn Frazer determined that the noncommercial junk yard
previously cited on this property has been closed.

On April 1, 1998, I spoke to Tom Owens, (representative and real-estate agent for the property owners Donald
and Jackie Forchette), about his request to change the boundaries for Lot A and Lot B of the post recopied
exemption. I responded to Mr. Owens by stating the Department of Planning Services is reluctant to honor this
type of request, but have done so on occasion, especially when it seemed to make sense in terms of land use
application. I also informed Mr. Owens, that because both Mr. Forchette and Mr. Toth both signed the recorded
exemption both signatures would need to accompany any proposed change to the configuration of Lot A and
Lot B.
Mr. Owens stated that he understood, and would talk to the property owners and Mr. Tooth about acquiring
these signatures.
