PARCEL NUMBER: 1311 02 000083 CASE SUMMARY March 2, 1998 Five day letter was sent to Mr. and Mrs. Forchette. A site inspection was conducted and revealed that a noncommercial junkyard and the number of dwelling units located on the property were not in compliance with the Weld County Zoning Ordinance. April 9, 1998 Progress inspection conducted by Sharyn Frazer and Sheble McConellogue. Mad of the noncommercial junkyard was cleaned up with a few tires and miscellaneous debris remaining. April 16, 1998 Recorded Exemption (RE-2181) was conditionally approved. (See attached). July 8, 1998 Memo to the file from Sharon Marquez stating that she spoke with Mrs. Forchetttr on the telephone on behalf of Monica Daniels-Mika. It was explained to Mrs. Forchette that no progress was occurring on the recorded exemption because the applicant had not met the conditions of approval so the mylar plat could not be recorded. December 8, 1998 Letter from Monica Daniels-Mika to Mr. and Mrs. Forchette stating that the co iddrons of approval had not been met and the mylar plat was not submitted for recording. A time frame of three weeks was granted to allow the applicants to bring the property into compliance or the situation would he referred to Code Compliance to proceed with the violation process. February 3, 1999 Thirty day letter sent. February 26, 1999 Mr. Forchette called and discussed the options available regarding the mobile home located on the property. A zoning permit application for a medical hardship was mailed to both Mr. Forchette and Tom Owens,who had been unofficially representing the Forchettes. February 26, 1999 Tom Owens called and spoke with Sharyn Frazer. He stated he had recommended to Mr. Forchette that he communicate with the Department of Planning Services to resolve the issues occurring on the property. March 9, 1999 Mr. Forchette called and spoke with Sharyn Frazer. He stated that he didn't think they would be able to qualify for a medical hardship, which was an avenue ava fable to bring the property into compliance. Sharyn Frazer recommended that he set up an appointment with Monica Daniels-Mika, to discuss other possible options. It was determined that the department would grant some additional time to allow VII-. and Mrs. Forchette to make a decision. March 31, 1999 Letter sent to Mr. and Mrs. Forchette scheduling them to appear before the Boanl of County Commissioners at violation hearings on April 13, 1999, at 10:00 a.m. The Department of Planning also recommends that the County Attorney be authorized to proceed with Icgal action against any other persons occupying the properties, any persons claiming an interest in the propert es, and any persons acting in active concert with the identified parties. Mr. Forchette had left a message on Monica voice mail inquiring about the stasis of RE-2181. I told Mrs. Forchette that there had been no progress on the RE because the applicant had not come into compliance with the terms of the RE. In the event the systems(s) is found to be inadequate, the system(s) must be brought into compliance with current regulations. 3. No permanent disposal of wastes shall be permitted at this site 4. I responded to Mr. Owens by stating the Department of Planning Services is reluctant to honor this type of request, but have done so on occasion, especially when it seemed to make sense in terms of land use application. I also informed Mr. Owens, that because both Mr. Forchette and Mr. Toth both signed the recorded exemption both signatures would need to accompany any proposed change to the configuration of Lot A and Lot B.
