RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST JAMES WENZINGER FOR VIOLATION OF THE WELD
COUNTY BUILDING CODE ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, James Wenzinger, VI #9900318, is allegedly in violation of the Weld
County Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of July, 2000, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, James Wenzinger, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until July 11, 2001, to allow adequate time for the property owner to
resolve the property line dispute and bring the subject property into compliance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against James Wenzinger to remedy the violation of the Weld
County Building Code Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until July 11, 2001, to
allow adequate time for the property owner to settle the property dispute and bring the subject
property into compliance.

December 03, 1999 Contact was made by Jill and cell number was acquired 307-920-1753.
December 06, 1999 Contact was made with Mr.Wenzinger regardingthe violation. A3 '/ Monthe>temion
was requested due to Mr. Wenzinger going out of Town and he will be either be
scrapping the mobile home, removing it off the property of will be getting the required
inspections prior to selling the property.
December 06, 2000 An extension letter was sent out until March 31, 2000.
April 20, 2000 Phone call was made to Mr. Wenzinger. He stated that there was an issue with the
property lines for WCR 47, where it was unknown where the actual property ineL or
easement is for the property (Bruce, the County Attorney, is involved w/the case)
Held of for 45 days to check on status with property lines.
June 23, 2000 Contact was made w/ Mr. Wenzinger, and no progress has been made with the
property line issues. I stated that the violation was scheduled for the Board of County
Commissioners Hearing.
June 23, 2000 Sent BOCC Hearing Letter for July hearing.

Dear Mr. Wenzinger:
The property located at 15151 WCR 47 remains in violation of the Weld County Building Code Ordinance. I
have scheduled a meeting with the Board of County Commissioners for July 11, 2000 , at 10:00 a.m. to consider
the violation occurring on the property. This meeting will take place in the County Commissioners' Hearing
Room, first floor, Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. It is recommended
that you and/or a representative be in attendance to answer any questions the Board of County Commissioners
might have about the violation. This would be a prime opportunity for you explain all issues regarding this
violation. If you can contact me prior to the hearing and take care of this matter, we will not proceed with the
hearing. If no contact is made, all plans will continue with the hearing.
The Department of Planning Services' staff will be recommending that the Board of County Commiss oners
authorize the County Attorney to proceed with legal action to remedy the violation if you and/or a
representative are not available. Our records indicate that you were made aware of the nature of the violation,
the action necessary to correct the violation, and that you were given sufficient time to remedy the violation. If
you have any questions concerning this matter, please call me.

I spoke w/ Mr. Wenzinger regarding the violation. He had mentioned that the mobile home
is now being used for storage only and he didn't think it needed the inspections. He will he
going out of state for a few months and is requesting a 3 '/z month extension until he returns
and then he will be either scrapping the mobile home, removing it off the property or will
be getting the required inspections prior to selling the property. There is currently an issue
regarding the property line in which Bruce (the County Attorney) is involved. He will he
sending in a request in writing for the 3 'h month extension (until the end of Ma ch 2000)

70.5.1 of the Weld County Building Ordinance. Required inspections for all mobile, manufactu-ed and
factory built homes and Certificate of Occupancy. The Weld County Building Ordinance requires that all
manufactured home permits be completed within 180 days after the permit is issued. Permit PR 9730039
expired September 15, 1998.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however,we have no discretion in this matter. If you fail to correct this violation by December 10, 1999. it
will be scheduled for a hearing before the Board of County Commissioners to consider whether to refer
this violation to the County Attorney's office for legal action.
