RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION #2823 - HOMEWARD
CONCRETE STEPS OF ROCHESTER, INC., C/O LOUIS BLANDA
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Recorded Exemption #2823 was submitted by Homeward
Concrete Steps of Rochester, Inc., c/o Louis Blanda, 4600 Weld County Road 31, Fort Lupton,
Colorado 80621, for property which is located in part of the S1/2 of Section 10, Township 1
North, Range 66 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, this request is to divide the property into parcels estimated to be
approximately 74.309 acres and 4.5 acres, and
WHEREAS, after reviewing the Planning staff's concerns and hearing the testimony
presented, the Board determined that said request shall be denied for the following reasons:
1. It is the opinion of the Board of County Commissioners that this proposal evades
the purpose of the Weld County Subdivision Ordinance as defined in
Section 1.3.
2. The Board feels this division would be inconsistent with efficient and orderly
development.
3. The Board feels this proposal is not consistent with the Weld County
Comprehensive Plan.
4. The Board feels this proposal will create a flaglot, which is not consistent with
Section 10.5 of the Weld County Subdivision Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request for Recorded Exemption #2823, submitted by Louis
Blanda be, and hereby is, denied.

The Department of Planning Services'staff has reviewed this request and recommends that it be denied for the following
reasons:
1. It is the opinion of the Department of Planning Services'staff that the applicant has not shown compliance with
Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance, as follows
A. Section 11.4.2.4- Consistency with the purpose of efficient and orderly development as expressed in
Section 1.3 of the Weld County Subdivision Ordinance.
1) Section 1.3.1 -Assisting orderly and integrated development. Weld County Planning Services'
Staff maintains that further division of this property does not assist in orderly or integrated
development of Weld County.A.Goal 4 of the Weld County Comprehensive Plan states-Provide
a mechanism for the division of land which is agriculturally zoned. The intent of this goal is to
maintain and enhance the highest level of agricultural productivity in Weld County.
2) Section 1.3.2-Promoting the health,safety, and general welfare of the residents of the County.
Continued increases in the number of residential or small lots in predominantly agricultural areas
may detract from the health, safety and welfare of the indigenous residents of the area as well
as residents of the County.Continued urbanization of rural Weld County further pressures already
strained services, such as but not limited to, fire protection and law enforcement services.
3) Section 1.3.10-Preserving agricultural land and promoting its most productive agrarian use. The
preservation of prime farmland is one of the primary goals of the Weld County Comprehensive
Plan.A. Goal 9 states "The minimum lot size of parcels in the Agricultural zone district should
remain at 80 acres to encourage parcels large enough to retain viable farming operations or to
accommodate modern agricultural equipment and irrigation practices." Further land division of
this type through the Recorded Exemption process is expected to diminish agrarian uses of the
area.

B. Section 10.5 - Lot Size Standards. Section 10.5.10 - A flag lot configuration shall be avoided
when possible. The proposed Recorded Exemption would result in the creation of an island lot with
access dependent on Lot A.
Should the Board of County Commissioners approve this request, the Department of Planning Services' staff
recommends the following conditions be attached:
1. In accordance with the Weld County Ordinance 219, for all applications, including amended applications, for
recorded exemptions, subdivision exemptions associated with a recorded exemption,and site plans approved
administratively on or after September 13, 2000, notice that such approval includes a determination of
compliance with Article XXVIII,shall be published once,at the cost of the applicant,not more than fourteen(14)
days after the approval of the application,in the newspaper designated by the Board of County Commissioners
for publication of notices.The notice shall describe generally the type of application approved and the specific
parcel or parcels affected and the basis for determining compliance with Article XXVIII,and shall state that any
interested person who wishes to appeal such determination of compliance to the Board of County
Commissioners must do so in writing within fifteen(15)days of the date of publication of the notice. No building
permits shall be issued for the development until the end of such fifteen(15)day appeal period.The cost of such
publication shall be paid for by the applicant.
2. A Weld County septic permit is required for any proposed home, The septic system shall be installed according
to the Weld County Individual Sewage Disposal System (I.S.D.S.)regulations.
3. Prior to recording the plat:
A. In accordance with Weld County Department of Public Works Ordinance #180, Lot A shall be
granted one residential access. Direct access from a public road shall be limited to one access per legal
parcel for residential use, no circle drives or additional accesses shall be granted. The road shall be
graded and drained to provide all weather access.Access shall be placed in such a location as to have
adequate sight distance in both directions.
B. Lot B shall use the existing residential/agricultural/oil and gas/ditch road access points necessary
for agricultural operations as no additional accesses shall be granted.
C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the
Weld County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe (CMP) is
Weld County's minimum size. If the applicant chooses to place a larger culvert please contact
the Weld County Department of Public Works to adequately size the culvert.
D. Weld County Road 31 is designated on the Weld County Transportation Plan Map as a local
gravel road,which requires 60 feet of right-of-way at full build out.There is presently 60 feet of
right-of-way.Atotal of 30 feet from the centerline of Weld County Road 31 shall be delineated
right-of-way on the plat. This road is maintained by Weld County.
E. A 30 foot wide joint easement extending across Lot B from Weld County Road 31,
for the benefit of Lots A and B, shall be shown clearly on the plat. The joint access
easement shall be dedicated for the use as shown using the language set forth in
Section 11.7.1.12.5 of the Weld County Subdivision Ordinance. The easement shall
be graded and drained to provide all weather access.
F. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset requirements
for the zone district in which the property is located. Pursuant to the definition of setback in the
Weld County Zoning Ordinance, the required setback is measured from the future right-of-way
line.
2) Any future structures or uses on site must obtain the appropriate zoning and building permits.
3) Prior to the release of building permits,the applicant shall submit a recorded deed describing the
lot upon which the building permit is requested with the building permit applications. The legal
description on such deed shall include the Lot designation and Recorded Exemption number.
4) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that the lot has an adequate water supply
of sufficient quality, quantity and dependability.
5) Should noxious weeds exist on the property or become established as a result of the proposed
development the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Weld County Ordinance 169A.
6) In accordance with Section 10.5.10 of the Weld County Subdivision Ordinance, the flag lot
Configuration will be avoided where possible.The minimum width of a flag lot is 30 feet.
7) RIGHT TO FARM COVENANT: Weld County is one of the most productive agricultural counties
in the United States. The rural areas of Weld County may be open and spacious, but they are
intensively used for agriculture. Persons moving into a rural area must recognize there are
drawbacks, including conflicts with longstanding agricultural practices and a lower level of
services than in town.
Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area. Well run agricultural
activities will generate off-site impacts, including noise from tractors and equipment;dust from
animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and
manure;smoke from ditch burning;flies and mosquitoes;the use of pesticides and fertilizers in
the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved
"out of the way"of residential development without threatening the efficient delivery of irrigation
to fields which is essential to farm production.
Weld County covers a land area of over 4,000 square miles in size(twice the State of Delaware)
with more than 3,700 miles of state and county roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources. Law enforcement is based on
responses to complaints more than on patrols of the county and the distances which must be
traveled may delay all emergency responses, including law enforcement, ambulance,and fire.
Fire protection is usually provided by volunteers who must leave their jobs and families to
respond to emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities mean that
roads from subdivisions to arterials may not be cleared for several days after a major snowstorm.
Snow removal for roads within subdivisions are of the lowest priority for public works or may be
the private responsibility of the homeowners. Services in rural areas,in many cases,will not be
equivalent to municipal services.
Children are exposed to different hazards in the country than in an urban or suburban setting.
Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps
and center pivot operations, high speed traffic,sand burs, puncture vines,territorial farm dogs,
and livestock present real threats to children. Controlling children's activities is important,not only
for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for
their children.
3. The applicant shall submit a Mylar plat to the Weld County Department of Planning Services to be recorded
in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the
requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty
(60)days from the date of approval by the Weld County Department of Planning Services. The applicant shall
be responsible for paying the recording fee.

Dear Commissioners:
Mr.Blanda has requested a Recorded Exemption on part of the Southwest Quarter of Section 11,Township 2 North,
Range 67 West of the 6th Prime Meridian. The 78.8+/-acre parcel is East of and adjacent to Weld County Road 31
and 1/2 mile South of the Weld County Road 12.
Department of Planning Staff asserts that the application is not in compliance with Section 11.8.7 of the Weld County
Subdivision Ordinance.For this reason we are requesting the case be reviewed by the Board of County Commissioners.
Planning Staff is recommending denial of the Recorded Exemption application Number 2860,for the following reasons:

RECORDED EXEMPTION QUESTIONAIRE
ITEMS REQUIRED FOR SUBMITTAL
1. Water supply statements addressing the following:
a. Domestic use. The statement will include evidence that a water supply of sufficient quality, quantity and
dependability will be available to serve all proposed lots. A letter from a water district, municipality, or a well
permit are examples of evidence for domestic use.
b. Irrigation water. The statement will include the type and quantity of irrigation water to the site, whether
irrigation water has been removed from the site and, if so, when.
2. A statement explaining that the proposed lots will have an adequate means for the disposal of sewage in compliance
with the requirements of the underlying zone district and the Weld County Health Department. A copy of the septic
permit or a letter from the sewage disposal facility must accompany the application.
3. A description of how the property is being used. When the parcel(s) is located in the agricultural zone district, the
description shall include approximate acreage of prime and nonprime farmland as defined in the Weld County
Comprehensive Plan, number and types of livestock and any existing improvements such as the principal residence,
labor home, mobile home, manufactured home, barn, outbuildings, irrigation ditches, and oil well production facilities
on the property.
4. The reason for the proposed recorded exemption with an explanation how each lot will be used.
5. A description of the location, size, and present use of the area where the proposed new lot(s)will be created.
6. A statement describing any unique physical characteristics on the site, if applicable.
7. A statement indicating that all proposed or existing structures will or do meet minimum setback and offset
requirements for the zone district in which the property is located.
8. A statement indicating whether the applicant is willing to place a conservation easement on the property to maintain
farm production or open space.
9. A statement indicating whether a building envelope will be designated on any of the lots.
10. A statement explaining how the proposal is consistent with the Weld County Comprehensive plan and any adopted
municipal plan, and any approved intergovernmental agreement(s), if applicable.
11. A statement explaining how the proposed uses will be compatible with existing surrounding land uses.
12. A statement explaining how the proposal is consistent with the intent of the district it is located within as expressed
in the Weld County Zoning Ordinance, as amended, and the Weld County Comprehensive Plan.

13. A statement explaining how the proposal is consistent with efficient and orderly development as defined in the Weld
County Subdivision Ordinance, Section 1.3; as defined below:
Assist orderly and integrated development.
Promote the health, safety, and general welfare of the residents of the County.
Ensure conformance of land subdivision plans with the public improvement plans of the County and its
various municipalities.

Prevent and control erosion, sedimentation, and other pollution of surface and subsurface water.
Prevent flood damage to persons and properties and minimize expenditures for flood relief and flood control
projects.
Restrict or regulate building in flood hazard overlay district areas, shoreland, areas covered by poor soils or
in areas poorly suited for building or construction.
Prevent loss and injury from land slides, mud flows, and other geologic hazards.
Provide adequate space for future development of schools and parks to serve the population.

The Weld County Public Works Department has reviewed this proposal; the following requirements are
recommended to be a part of any approval:
COMMENTS:
WCR 31 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot
right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as
amended), the required setback is measured from the future right-of-way line.

REQUIREMENTS:
The Weld County Public Works recommends approval with concerns of this application.
In accordance with Section 10.5.10 of the Weld County Subdivision Ordinance (Ordinance 173, as
amended), the flag lot configuration will be avoided where possible. The minimum width of a flag lot is
30 feet. This flag lot is one-half mile in length. (Lot A)
The right-of-way or easement shall be a graded and drained road to provide all weather access. (Lot A)
The applicant shall utilize the existing residential access to this parcel, and no additional accesses shall
be granted. (Lot B)
Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a result
of the proposed development, the applicant/landowner shall be responsible for controlling the noxious
weeds.

In consultation with the Natural Resources Conservation Service (NRCS) ,
we have reviewed the above referenced case and have the following
comments .
SOILS/LIMITATIONS: The soil found on the proposed lot is classified as
Olney loamy sand. These are deep, well drained soils with a loamy sand
surface and a sandy clay loam subsurface. This soil has moderate
permeability and water holding capacity. There are severe limitations
for shallow excavations but only slight limitations for basements . The
soil has moderate limitations for septic tank absorption fields, due to
slow percolation.
PRIME FARMLANDS: This soil is not considered as `prime farmland' .
SOIL EROSION POTENTIAL: Water runoff is slow but the hazard from wind
erosion is high.
OTHER: Due to the close proximity of the irrigation canal, an on-site
investigation is highly recommended before any construction is started.
